This Contract Limits our Liability - Please Read it Carefully
NO LIABILITY OF LANDLORD
License Holder understands and agrees that neither Landlord nor any operator hired by Landlord shall be liable for loss of or damage resulting from any cause whatsoever to (a) any vehicle in the Parking Facilities; (b) the contents of any such vehicle; (c) the accessories to any such vehicle; or (d) any property left in the Parking Facilities. License Holder understands and agrees that a material condition to Landlord's agreement to let License Holder use the Parking Facilities is that such use is at License Holder's sole risk. Landlord will not be liable to License Holder for the unavailability of License Holder's reserved stall caused by unauthorized persons parking in such stall nor will any unavailability entitle License Holder to any refund, deduction, or allowance.
RELEASE AND INDEMNIFICATION OF LANDLORD
License holder expressly releases and discharges Landlord and its agents, employees, and contractors from and against, any further waives, any and all claims, demands, cause of action for damages, including, but not limited to, personal injury, death, and property damage arising out of or in condition with the use of the Parking Facilities (including, but not limited to, any damage caused by towing).
SUBLETTING OF MONTHLY PARKING SPACE IS PROHIBITED
This practice is prohibited and may lead to cancellation of your parking privilege. This includes any temporary use of the License Holder's card key by another party with the License Holder's knowledge.

CARD KEY - PROPER USAGE
ACCESS CARDS & LICENSE PLATE RECOGNITION
All monthly parkers are issued a parking card that allows access into and out of the parking garage. A $25.00 activation fee payable to "Elite Parking Services" is required for each parking card issued and is not refundable upon termination of monthly parking. The card is composed of viable plastic and may become warped if exposed to heat. Should your card become warped or damaged, please bring the card to the parking office for replacement. A $25.00 fee will be assessed to replace a lost card. Monthly parkers may also request to activate the license plate recognition (LPR).
CARD KEY - PASSBACK
Each monthly parker will be issued a numbered parking card and choose to register LPR for their vehicle that will enable access into the parking garage. An electric system ensures that only one vehicle card is allowed in the garage at any time. The card readers at each gate will accept a card only when a vehicle is present to activate it. The same will pertain to the LPR readers. Once a vehicle uses the monthly keycard or LPR to enter the parking garage, the keycard or LPR will not allow re-entrance until after the same vehicle that entered has exited the parking garage. A charge of $25.00 will be charged upon exiting to any person violating the passback rule.
All monthly parkers must park above the 2nd gate. The electronic system ensures that each vehicle entering the garage must also enter the 2nd gate within 10 minutes of main entrance gate. Exceeding the time limit will cause the person to be in the passback system and charged $25.00.
LOST OR STOLEN CARD KEYS
FORGOTTEN / NON OPERABLE CARDS
If you have forgotten your parking card, or it is inoperable due to passback, the electronic system will deny access to the parking garage and you will be subject to the visitor parking rates. If your card does not operate properly, it is essential that you notify the parking facility management immediately so that the situation may be corrected. A charge of $25.00 may be assessed.
All monthly parkers must park above the second (2nd) gate. Valet Parkers must bring their vehicle to the sixth (6th) level. Once you have passed through the main entrance gate, you must continue past the second (2nd) gate or your card will be electronically voided from the system and further key card access will be denied. Failure to park in your assigned area may result in deactivation and a $25.00 reactivation fee. Valet parkers must park on P6A & P6B exterior parking decks.
PARKING IN NON-DESIGNATED AREAS
PHYSICALLY CHALLENGED STALLS
VALET PARKING (valet services suspended until further notice)
All valet parkers must park their vehicles on floors P6A and P6B. Valet parkers have the option to park their own vehicles in the first available stall. A valet attendant is also available should you decide to use the building's valet service. Keys must be given to the valet attendant and should not be left in the vehicle unattended.Valet hours of operation are as follows 7AM to 6PM, Monday through Friday. After 6PM, keys may be picked up from the parking attendant at the parking booth on Level P1 (located at the entrance/exit of parking garage). If parking booth is closed, please see Security (located across the parking booth).
RELOCATION & TOWED VEHICLES
No overnight parking in the Davies Pacific Center Garage from 10:00 pm to 4:00 am unless approved by Property Management. Any vehicle found parking overnight from 10:00 pm to 4:00 am will be charged $25.00. If this procedure is violated and/or the $25.00 fee is not paid, parkers are subject to losing parking privileges at Davies Pacific Center. Card key will be deactivated, and parkers are subject to losing parking priveleges at Davies Pacific Center.
VEHICLE INFORMATION (LICENSE PLATE RECOGNITION)
The maximum height allowance for this parking garage is 6' 1"
The parking office is Ste 116 on the street level. Office hours are Monday through Friday, 8:00am to 5:00 pm.
This agreement licenses holder to park one vehicle in the parking facility. Only rental space license guarantee, and no bailment is created. The management shall not be responsible for fire, theft, damage, or loss to said automobile or any other article left in it. This constitutes the entire contract, and customer, by signing, acknowledges receipt of a copy hereof and acknowledges that he/she has read and agrees to abide by the foregoing and by the rules and regulations of the Elite parking facility. A copy of these rules and regulations, will be sent to you via email upon submission.
Please note - Filling out this online form and agreeing to the monthly parking agreement does not guarantee a parking spot.
Application for Overnight ParkingParkers Information
Vehicle MUST be removed from garage by or on end date.
No vehicle may be parked for longer than 48 hours at a time.
Limitations of Liability: Building Owner(s), Building Management, Parking Management, their officers, employees and agents shall not be responsible for any claims deriving from fire, theft, damage, and/or loss to vehicles and/or articles left in vehicles parked in this garage. Owner/Driver of vehicle parks at his/her sole risk. Failure to remove your vehicle by the end date specified above may result in the towing of your vehicle at your expense. Vehicle must be in good running order. For safety reasons, any vehicle that leaks any fluid that is determined to pose a possible danger to persons and/or other vehicles and/or other property and/or the building itself, will be immediately removed from the garage with the related expenses being applied to your account. We will attempt to contact you, yet are not obligated to do so as safety is our first priority.
All parking fees must be paid in advance for the time the vehicle will be parked overnight. Any use of your access card while your vehicle is parked in the garage will result in the immediate termination of your parking privileges and possibly the immediate removal of your vehicle from the parking garage.
This is only a request and approval is not guaranteed. Building Management and/or Parking Management reserve the right to deny any request without reason. This request is not approved until the Parking Manager has signed off.

All cancellations must be submitted at least 30 days prior. Parking access card will need to be returned to the parking facility management prior to the last day of the month.
