• Indoor/ Outdoor Sessions - Waiver of Liability Release: By agreeing to a photography session with Nest Photo Studio (NPS) and/or it's partnership company French Media Group, LLC, I am hereby waiving, releasing, and discharging NPS and all its affiliates, from any and all liability, including but not limited to, property damage, property theft, illness or actions of any kind which may hereafter occur to me or my family including my traveling to and from this event. NPS is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release NPS and photographer from any claims against their person or their business. The client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against NPS or French Media Group, LLC for any reason.
  
  
• Nest Photo Studio takes the utmost care with respect to the exposure, development, and delivery of images. However, in the event that the studio fails to comply with these terms, the studio’s liability is limited to the refund of previously paid retainers. Nest Photo Studio cannot be held responsible for portrait damages incurred as a result of improper handling, dropping, framing, or hanging. Prints should be hung away from moisture, temperature changes, direct sunglight and/or sticky fingers.
  
  
• Session fees will be collected in advance of your photography session. A session may not take place without the fee paid and Session Agreement signed. Cancellation of session will result in a credit to your account for the amount paid in lieu of a refund in a form of session credit only. If a session is cancelled with less than 24 hours notice, the session fee will be forfited. For Sessions between November 1st - December 31st each year, please note that sessions are not subject to cancellation for any reason, including illness, but you may gift the session if paid a la carte (non-member pricing) to someone else. In case of cancellation or need to move, you agree to the session fee being forfited and/or session deducted from your membership account. An attempt to reschedule may be made by the studio but only based on avaailability and is not guarenteed. 
  
  
• Nest Photo Studio retains all copyright ownership of all images created as a result of this contract. Images may not be reproduced for commercial purposes or print products duplicated for any reason without our express written permission, including scanning. Unauthorized copies are subject to a $500 per image per incident penalty or $15,000, whichever is greater. 

• The delivery of digital images or galleries from your photography session will be completed within a maximum of 2 weeks from the session date. Please note that a minimum purchase of the 5-photo package is required for all sessions. Nest Photo Studio is not responsible for any issues related to lost delivery notifications, including but not limited to undelivered emails or text messages. It is the client's responsibility to ensure they provide accurate contact information and to check their email and spam folders for notifications. The studio is not liable for any delays or issues beyond the provided delivery timeframe once the images have been sent to the client.

Non-Members

• Gallery Access and Image Availability: Following the photography session, non-members will be provided with a gallery link to access and view their session images. This link will remain active for a period of one (1) year from the date of the photography session ("Gallery Access Period"). During the Gallery Access Period, images can be purchased and downloaded to the non-member's personal device.
  
  
• Expiration of Gallery Link: After the expiration of the Gallery Access Period, the gallery link will be deactivated, and the images will no longer be accessible. The photographer will not retain or maintain any copies of the images after the Gallery Access Period ends, and the non-member will forfeit any ability to retrieve or access the images beyond that point.
  
  
• No Guarantee of Image Availability After Gallery Expiration: The photographer makes no guarantee that any images will be retrievable or available for purchase or download once the Gallery Access Period has expired. It is the responsibility of the non-member to download and secure their images within the one-year timeframe provided.

Members

• Gallery Access and Image Availability: After the first photography session, members will receive a gallery link to access and view their session images. The gallery link will remain active for as long as the individual maintains their membership. During the active membership period, images can be downloaded to the member's personal device.
  
  
• Expiration of Membership and Post-Membership Access: Upon expiration of the membership, the former member will have a grace period of one (1) year from the date their membership expires to download all images from their gallery onto their personal device.
  
  
• Deactivation of Gallery After Grace Period: After the one-year grace period following membership expiration, the gallery link will be deactivated, and the images will no longer be accessible. The photographer will not retain or maintain any copies of the images beyond this period. It is the responsibility of the member to ensure all images are downloaded within the one-year grace period provided after membership expiration.

By signing, you acknowledge that you have read and agree to the stated terms of the Session Agreement and are the authorized party to represent all adults (persons over the age of 18) and provide consent for this photography session and images. You also acknowledge that you have legal guardianship with ability to make binding decisions on behalf of any minors (persons under the age of 18) for this photography session and images.
