A. Model Release

I hereby give to Elegant Aces Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

a) To copyright the same in the photographer’s name or any other name that he/she may select;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; and there will be no compensation to the above.

B. Liability

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

Elegant Aces is not liable to deliver every photo that is taken during the session. The final editing and overall look of the photos will be based on the photographer's technical and artistic style. If specific style is desired, please indicate that in Notes to Photographer above.

C. Copyright & Penalty

Elegant Aces Photography retains ALL copyrights to all images created during client’s session. A limited PRINT RELEASE will be given with digital files to print portraits for PERSONAL USE. Personal use includes, but is not limited to, social media posts, physical print orders, invitations or cards, etc. Elegant Aces Photography asks that you tag, and or mention, us in your social media posts. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission.

Before submission of my remaining balance as mentioned below, it is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Elegant Aces Photography. This applies to "sneak peek" images posted to photographer's social media in complience with a model release. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file ($350).

D. Photo Session Payment Agreement, Retainer & Policies

I understand that my session is not confirmed nor begin until a non-refundable retainer of $25 is paid to Elegant Aces. I understand that my remaining balance is due within 30 days. Should the remaining/final balance not be paid my images will not be released to me on an online gallery format.

Weather cancellations will be made at the photographer's discretions. Tardiness of my session will not delay my session. My session will remain within the scheduled time frame. If I need to reschedule I will give contact prior to 48 hours notice of said reserved session date, otherwise I forfeit transfer of my retainer for a new session date. I will do my best to reschedule my session within 2 weeks of original session date. I cannot always guarantee an available date two weeks out but will try my best to accommodate photographer's schedule.

I understand that my photos will not be released immediately, that the photographer has two weeks (for 1-2 hour sessions) to edit and release my photos to me. For longer sessions (weddings, events, etc.), the photographer has at least 30 days to edit and may gradually release my photos to me during that time. "Sneek Peek" photos may be found on photographer's social media between one and two weeks after the session.

Elegant Aces accepts cash, checks, or online payments through Paypal, Venmo and Apple Cash. Please make checks payable to Emily O'Neill.

Payment Method

By signing (draw your signature) below I certify that I am at least 18 years of age. I have read this portrait agreement/waiver/contract and fully understand the contents thereof. I agree that I have the legal authority to grant these permissions and accept all responsibility for such. Once the JPEG files are delivered to the client, it is the client’s responsibility to protect and retain their images. The files will not be duplicated under any circumstances. The client will receive JPEG files only. No RAW images will be delivered to the client. The client will have 30 days after notification to download the images. If the images are not downloaded within the 30 days, there will be an archive fee of $50.00 to re-upload the photos.
