MODEL RELEASE
By signing below, I (Client) am agreeing to allow Beth DeMund and all event vendors to share images from my session on social media and for marketing purposes without compensation.
CONTRACT
The $149(+tax) session fee is non-refundable and due at booking. If the fee is not submitted within 24 hours, this contract will be null/void and the session will be cancelled.
Images will be delivered via online gallery 1 week after the date of the session. Viewing gallery will be active for 7 days and all choices must be made and downloaded within the 7 days. After 7 days, your gallery will be deleted unless you purchase the 2 year archival option for an additional $100. Your chosen images will include a print release if requested. Images will be made available for immediate download after your order is processed. *If you choose to purchase the additional 2 year archival option, the gallery will be reopened to download your images for 24 hours, for each request made.
The content of the gallery is in descretion of Beth DeMund. Beth will select the best images and edit them at her artistic discretion as work that best represents her abilities as a custom photographer. Under no circumstances is she required to provide any unedited images from the session. Additional edits or image enhancements requested beyond the photographers standard workflow will be an additional fee of $50 per image.

Beth DeMund Photography will retain the full copyright on all images (including digital files) and reserves the right to display, publish/etc. for any reason. Client is prohibited from further editing of images. Client is also prohibited from using photos in contests without written consent from Beth DeMund. Client may not, for any reason sell their images to any third party. Client will be granted printing rights in writing for the images purchased and is allowed to download and use digital files for printing purposes.
TERMS AND CONDITIONS
- Upon signature, the Studio/Photographer shall reserve the time and date agreed upon. Unless the Studio is able to full replace the cancelled reservation, all sitting fees and retainers are non-refundable, even if the event is rescheduled or canceled for any reason.
- If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the studio/photographer, photographer may elect to use an alternate location or reschedule the portrait.
- No part of any order, including previews, will be delivered until the balance is paid in full.
- The Studio/Photographer reserves the right to use images created under this contract for advertising, display, publication or other purposes. The
Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Studio/Photographer in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of this Studio/Photographer.
Studio/Photographer may substitute another photographer to take the photographs in the event of Studio/Photographer’s illness or of scheduling conflicts. In the event of such substitution, Studio/Photographer warrants that the photographer taking the photographs shall be a competent professional.
- If the Studio/Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Studio/Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of all monies paid.
- Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
- The charges in this Contract are based on the Studio’s/Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
- NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without Studio’s/Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties.
- This Contract incorporates the entire understanding of the parties and is governed by the laws of Maricopa County, AZ (City/County, State). Any modifications of this Contract must be in writing and signed by both parties.
- By attending this event, I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that Beth DeMund Phogotraphy, LLC can not guarantee that I will not become infected with the Coronavirus/Covid-19.
By attending this event I agree:
* I am not experiencing any symptom of illness
* I have not traveled internationally within the last 14 days.
* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as noncontagious by state or local public health authorities.
I hereby release and agree to hold Beth DeMund Phogotraphy, LLC harmless from and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses, and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act that may otherwise arise in any way in connection with any services received from Beth DeMund Phogotraphy, LLC.
I understand that this release discharges Beth DeMund Phogotraphy, LLC from any liability or claim that I, my heirs, or any personal representatives may have against the salon with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Beth DeMund Phogotraphy, LLC.
