  • LOCOMOTIVE STORAGE AGREEMENT (2024)

  • By signing and submitting this form you the 'Client' are agreeing to the the terms set out below: -

    1. Members who do not renew their membership by the 31st March must remove their locomotives/rolling stock from BHME premises immediately. Failure to do so will result in the club following “The Torts (Interference with Goods) Act 1977”(see below) and issuing an abandonment notice. The process is as follows.
      1. A notice of abandonment will be issued to the owner of the locomotive/rolling stock. All reasonable attempts will be made to locate the owner.
      2. The owner of the locomotive/rolling stock will have 28 days to arrange collection of their property.
      3. Following this 28-day period the club has the right to sell the property for a reasonable market value.
      4. Following the sale, the owner has the right to claim any profit less expenses.
    2. Membership for the sole purpose of Loco Storage will not be accepted.In order for a member to store rollingstock on the club premises they must be an active member and attend Ravensprings park either supporting the clubs activates such as the public events or maintaining the club. The committee will decide on an individual case basis.
    3. Loco’s that have been out of steam ticket for 2 years must be removed unless actively being worked on to return to service.
    4. All rollingstock stored on site must be in safe working order and be able to be used at the benefit of the club. Any rollingstock not fit or safe for use must be stored off site. Driving trucks can be stored with the loco as long as the loco complies with rule 3.
    5. Indemnifying Brighouse and Halifax Model Engineers (BHME) from any responsibility towards your locomotive/rolling stock whilst it is stored at Ravensprings Park. This includes theft, any type of damage be it accidental, deliberate act of vandalism, fire, building collapse or any other cause. Note - you may wish to take out suitable insurance via a reputable company to cover for any loss or damage whilst your locomotive/rolling stock is stored at Ravensprings Park. BHME does not guarantee that shed locking mechanisms meet insurance standards, it is your responsibility to make sure that your insurance cover is valid.
    6. The Club’s Public Liability Insurance Cover is as follows.
      1. £5M while on official club activities including meetings at other clubs
      2. £1M Individual Liability away from Club Premises, but not on official club activities   Further details available from the Treasurer.

  • I agree that I have indemnified BHME as stated in this agreement whilst I take advantage of the storage of my rolling stock and to this Agreement being stored electronically for the duration of said storage and for 3 years after I have removed the item.
