Title: The Artist/Owner warrants that the Artist has created, and has unencumbered title to, all artwork consigned hereunder.
Period of Auction, Exhibition and Sale: Artwork accepted for exhibition and sale will be held for the full period of exhibition as determined by Studio 23.
Return of Artwork: Artwork accepted for exhibition and sale must be picked up by the Artist within two (2) weeks after the period of the exhibition. On the 31st day after the notice or period of the exhibition, Studio 23 reserves the right to treat the artwork as a donation.
Liability: Studio 23 is acting solely as a representative of the Artist, and neither it nor its members shall be liable for loss or damage to artwork, storage crates, personal belongings, or other related items on the premises (or exhibited elsewhere within the sole discretion and under the control of Studio 23) due to theft, loss, fire, or destruction of any kind other than those caused by Studio 23’s negligence.
Insurance: The Artist is responsible for the proper insurance coverage during the period of transportation and exhibition.
Sale Prices: Prices for artwork consigned hereunder are set by the Artist. The Artist is encouraged, but is not required, to sell the artwork submitted for exhibition.
Commission: Studio 23 shall receive a commission of 40% of the sale price of the designated artwork to be displayed and sold during the exhibit. Designated auction donations proceed go entirely to Studio 23. Artists will receive an auction donor form that may be used as a tax receipt as determined by the artist's tax advisor.
Payment: Payment on all sales shall be made to the Artist within thirty (30) days after the event on December 11, 2020.
Reproduction Rights: The Artist reserves all rights of reproduction of consigned artwork. Studio 23 may publish photographs of all artwork for promotional and/or education purposes as it may deem appropriate.
