NOTE: MyAutoStorage will not be liable for the following: 1. Damage caused by leaking fluids, battery acids, and/or cooling system anti-freeze originating from your own vehicle. 2. Damage caused by industrial fallout or acts of God. Articles left in vehicle. All items left are at your own risk. Damage or loss of loose parts. Cracked or chipped windshields. It is the responsibility of the client to inform MyAutoStorage if wheels or rims have been painted within the last 6 months, Failure to do so will result in MyAutoStorage denying any claim for damage to rim paint. Damage to oil pans or suspension parts that are 4” or less above the ground. Damage to oil pans that are 4" below the arms MyAutoStorage will not be responsible for any vehicle with air ride suspension should it fail while in MyAutoStorage’s care resulting in damage being done to the vehicle, MyAutoStorage will be held harmless for any repair costs. Mechanical functions, including but not limited to exhaust assembly, alignment, suspension, brakes including parking brakes, steering, batteries or tuning of engine because inspection of these items isn't practical at time of vehicle intake.
MYAUTOSTORAGE’S LIABILITY Notwithstanding that this contract is governed by Ontario Regulation 643/05, if a value is declared on the face of this bill of lading, the carrier's maximum liability shall not exceed $250,000 CON per motor vehicle or a lump sum value of $1,500,000. CON per load. To the extent that an increase in valuation over and above these limits is required by the shipper, MyAutoStorage must be notified in writing prior to loading Payment of the excess valuation shall be in the amount of 50 cents per $100 of excess valuation. This is to be paid forthwith with confirmation of payment provided by MyAutoStorage. Failure to provide the payment of excess fees owing prior to the date of the shipment will limit MyAutoStorage’s liability to $2.00 per pound per article that is damaged and/or lost. This declared value must be reflected on the face of this contract. Value will not be inferred from any other source including, but not limited to, oral communication and/or documentation provided by the shipper and/or receiver. 8. Damage caused by freezing or cooling system and/or batteries. Damage to radio antennas that extend more than 3° above the fender or hood level. 9, Auto rental accruals will not be honoured, Pickup and delivery schedules are not guaranteed, DECLARED VALUE 10.
