SERVICE CONTRACT
The following contract and its terms will set forth an agreement between Dream City Photo Booth (Provider) and {name}(Client) for photo booth services to take place on the stated event date of {chooseYour39}. This written contract sets forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.
SERVICE PERIOD
Provider agrees to have a Photo Booth operational for a minimum of 80% during the requested hours; occasionally, operations may need to be interrupted for maintenance of the Photo Booth. In the event Provider is unable to supply a working Photo Booth for at least 80% of the Service Period, Client shall be refunded a prorated amount based on the amount of service received. If the printer fails to print out photos on site, an online gallery is provided where all photos can be downloaded. If desired by Client, Provider can send all printed photos via mail at a later date.
PAYMENT
The non-refundable booking fee (deposit) is $100.00, which goes towards the total cost of service. The event is reserved as soon as the booking fee is received. The remaining amount is due 2 weeks in advance of Client's event date. Client may also choose to pay in full the day of booking. If the balance has not been collected by the due date, then Provider reserves the right to cancel the saved date. If Client desires to continue with the date, a new booking fee is required along with the total paid in full that same day upon signing of the new contract. Exceptions can be made depending on the Client’s circumstances.
ACCESS, SPACE & POWER FOR PHOTO BOOTH
*ATTENTION*: {name} will need to arrange for the following:
- At least a 10' x 10’ area for setup.
- Minimum 9ft tall ceiling.
- Flat/solid floor required.
- Power (3 prong outlet from a reliable power source within 50 feet (along a wall) of the setup area) The circuit must be free of all other connected loads. If power outage occurs during the event, the booth will need to be rebooted/restarted.
Photo booth must not be placed outdoors during "un-enjoyable" weather conditions and storm predicted forecasts or any day below 50 degrees Farenheight to ensure working order of the equipment and comfort of the staff. If you choose to place the booth outdoors and the forecast shows undesirable conditions as mentioned, we will require an alternative space for the booth to be placed indoors.
DATE CHANGES & CANCELLATIONS
Any request for a date change must be made in writing (email preferred) at least 30 days in advance of the original event date. Change is subject to photo booth availability and receipt of a new Service Contract. If there is no availability for the alternate date, the deposit shall be forfeited and event canceled. Any cancellation occurring less than 30 days prior to the event date shall forfeit 50% of payments received due to loss of booking other potential clients, as well as materials prepared and ordered for the event.
IDLE TIME
Idle time can be arranged with the client at an additional cost. An example of idle time is when the booth is paused, or inactive, to allow client’s party to focus attention on desired moment such as speeches, etc.
Example of Idle time: Booth is booked for 4 hours. It is operational from 5pm-6pm and from 7pm-10pm. Between 6pm-7pm, the booth will be IDLE (at the client’s requested time).
This must be arranged no later than 2 weeks prior to the event date. Dream City Photo Booth will arrive 60-90 minutes prior to the service start time and depart 30-60 minutes after the service end time. If Provider is required to arrive or depart outside of these windows, then idle hours will be charged via invoice.
FUEL SURCHARGE
Travel costs are covered in any package up to a 15-mile radius from zip code 84115. A separate fuel surcharge of .75 cents per mile (round-trip) will be billed for any trips that extend outside of the 15-mile radius. If travel exceeds 45 miles one way, an additional charge will be made to compensate the traveling attendant's time.
DAMAGE TO PROVIDER'S EQUIPMENT & REFUSAL
The client shall provide safe and appropriate working conditions, as well as crowd control if warranted. Client acknowledges that they shall be responsible for any damage or loss to the Provider's Equipment caused by:
a) any misuse of the Provider's Equipment by Client or its guests (invited or uninvited) or
b) any theft.
CONFLICTS & PROTECTION
Client acknowledges Provider shall have the right to decline service individually to client's guests at event (invited or uninvited), for misuse of equipment, inappropriate photos or unruly behavior.
In the event of an unsolved conflict between Provider and Client, Client agrees to solve and settle any arguments via arbitration. If there is any conflict during event (including but not limited to Client’s demands of service from Provider that is outside of service agreement, or something of a threatening nature against Provider and its employees), Provider has full right to cancel the services with a 50% refund to Client, excluding travel fees, if any, for safety and protection purposes. Partial refund only applies if Provider has served under ½ of the contracted booking time, otherwise there will be no partial refund.
INDEMNIFICATION
Client agrees to indemnify Provider against any and all liability associated with the use of pictures taken within the Photo Booth, it's representatives, employees or affiliates at Client's event.
DIGITAL FILE DELIVERY
Within five days after the event, you will receive an email with a link to your digital files as soon as they become available on our website. It is up to you to forward information to your guests unless you prefer the information to be handed out at the event after their booth session is done. For special instruction as such, please contact us immediately with your request.
ON-SPOT REQUESTS:
Day of event requests to extend the time for the booth will be accepted unless Dream City Photo Booth has obligations after the original contracted time. Feel free to check with our attendants and they will let you know. Last minute design requests are not accepted 48 hours prior to event.
MISCELLANEOUS TERMS
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties.
