Hillside Palms RV Park Rules with Application & Agreement Scroll to the Bottom to Click Agree Button This field is required. A. Application 1. Application Process: All prospective tenants or buyers of mobile homes, tiny homes, or RVs within Hillside Palms RV and Mobile Home Park, hereinafter referred to as “Hillside Palms” or “Park,” must meet personally with the owners or managers, Angaleza Adams or Acacia Hansen, and submit a formal application for residence. Any convictions for drug-related crimes, violent crimes, sexual crimes, property damage, theft, driving under the influence, felonies, or domestic violence are grounds for not being approved to live in the Park. If approved, tenants will be permitted to move into the Park according to the time and space designated by the manager. 2. Fair Housing Practices: Hillside Palms has no restrictive covenants or policies, implied or written, that bar residency based on race, religion, familial status, sexual orientation, or gender identification, in compliance with the federal Fair Housing Act (42 U.S.C. § 3601 et seq.). 3. Single Family Dwellings and Subleasing Restrictions: Hillside Palms spaces must be owner-occupied by one single family, not multiple families living in the same RV, tiny home, or mobile home. Two adult persons are permitted per space. Two or more families purchasing or occupying a home are not allowed. If a minor family member resides temporarily, rent will increase by $50.00 per person/month to cover extra water use. All adult persons must submit an application and be approved in writing by Hillside Palms management before moving in. Unapproved applicants will not be permitted to reside in the Park, regardless of their relationship with the existing tenant. Subleasing, Airbnb, or any form of vacation rentals are strictly prohibited for all tenants. Only the owner of Hillside Palms RV Park may engage in subleasing or offering Airbnb or vacation rental services. Unauthorized subleasing or rentals by tenants will result in immediate enforcement action, including potential eviction, per Utah Code § 57-16-6. 4. Monthly Rental Agreement: All rental fees are month-to-month. This application is for long-term tenants. Any prior yearly contracts are no longer valid. RVs, tiny homes, or mobile homes must be owner-occupied unless written permission is granted by Hillside Palms. As the Park upgrades some spaces from mobile home/RV to RV-only spaces, units that are unsightly or in disrepair may be required to move out upon sale. The Park reserves the right to require owners to relocate or demolish immovable units at their expense. Tenants must comply with requests to move due to ongoing construction, reconstruction, or upgrades, with sufficient notice provided. 5. Approval in Writing: Approved applicants will receive written confirmation. To secure a space, a non-refundable deposit is required, credited to the last month’s bill. If the applicant declines the space, the deposit is non-refundable. 6. Abandonment, Unoccupied Units, Death, and Incarceration: Units must be occupied. If a tenant cannot occupy the unit (e.g., due to abandonment, extended hospitalization, or healthcare needs), arrangements must be made to maintain the unit and pay rent. For abandonment with no contact for 30 days, the unit will be considered abandoned per Utah Code § 57-16-13. In case of death, successors must apply per Item D (Sale of Units). An emergency contact or next of kin must be provided in the application. If incarcerated for over 30 days, tenants must arrange to move the unit and pay all fees. Convictions for felonies, drug-related crimes, or any violent crimes are grounds for immediate eviction, per Utah Code § 57-16-6. 7. Renovations or Property Improvements: Park management reserves the right to issue a 60-day notice to any tenant, including those with mobile homes, tiny homes, or RVs, to vacate their rented space to facilitate renovations or property improvements deemed necessary by the owner to enhance the property’s value or functionality. Tenants are responsible for removing or demolishing their mobile home, tiny home, or RV at their own expense within the 60-day period, in accordance with Utah Code § 57-16-4(3)(b) and § 57-16-14. B. General 1. Rental Fee Payment: Rent is due on the 5th of each month, payable at the Self-Pay Station Box at 600 East (under 24-hour video surveillance) or mailed to Hillside Palms RV, 175 N. 600 E. #51, St. George, Utah 84770. Payments received after the 10th incur a $50.00 late fee, due with the next month’s rent unless arrangements are made. Tenants have a minimum 5-day grace period after the due date before a 5-day eviction notice for non-payment is issued, per Utah Code § 57-16-5. Accounts 30 days past due will be turned over for collections and legal action. Three consecutive late payments constitute a breach, resulting in tenancy-at-will status and a 5-day eviction notice per Utah Code § 57-16-6. Returned checks incur a $50.00 fee. Rent ranges from $550–$750/month (as of 2023), plus metered electricity, and may increase with economic conditions, with 60 days’ written notice per Utah Code § 57-16-4(3). 2. Property Damage or Loss: Hillside Palms, its owners, managers, workers, or subcontractors are not liable for personal or property loss or damage to tenants’ or guests’ property or vehicles due to actions by others, fire, electrical issues, theft, or acts of God (e.g., water, sewer, flood, uneven ground, falling rocks, or land movement). Tenants assume all liability for driving, parking, check-in/out, and residing in the Park, per the Hold Harmless Agreement (Section F). 3. Self-Conduct: Tenants are responsible for their actions, conduct, and that of their family and guests. Tenants are liable for costs due to misconduct or damage. No firepits, open-flame grills, semi-permanent/permanent swimming pools, jacuzzis/spas, standard trampolines, playground equipment, fireworks, or any fireworks-related activities are allowed, due to fire hazards and safety concerns, in accordance with Utah Code § 53-7-225. 4. Noise/Traffic/Smoking: Excessive noise from music, television, sports, ATVs, motorcycles, or other sources between 9:00 p.m. and 8:00 a.m., or at any time if disturbing to neighbors, is prohibited. Excessive visitors/guests or unlawful nuisance activity (e.g., disproportionate foot/vehicle traffic, unsightly/broken-down vehicles) is not permitted. Any type of smoking (e.g., tobacco, vape, or other substances) that invades another resident’s rented space, causing disturbance or discomfort, is considered a private nuisance and is prohibited, per Utah Code § 57-16-6. Violations of noise, traffic, smoking, or visitor rules may result in eviction, per Utah Code § 57-16-6. 5. Unlawful Substances and Behavior: Use, possession, or distribution of unlawful drugs/substances or alcohol consumption by those under 21 is prohibited and will be reported to law enforcement, resulting in immediate eviction. Stalking, harassment, threats, domestic disputes, or abusive behavior toward tenants, staff, or management will also result in immediate eviction and reporting, per Utah Code § 57-16-6. 6. Television: For tenants staying over three months, cable TV is available via TDS. Tenants are responsible for signing up, paying for service, and providing necessary cables/equipment. Digital cable boxes are required, and tenants must return boxes to TDS upon termination of service. 18-inch satellite dishes are permitted. 7. Internet: Free Wi-Fi is available for short-term guests on the upper level, with no tech support or guarantees for speed/streaming. No refunds/credits are provided for connection issues. Long-term tenants may arrange dedicated high-speed internet through TDS, CenturyLink, InfoWest, or Starlink, or check with their cell phone provider for potential hotspot services, handling all costs and setup. 8. Power: Electricity is billed monthly with rent. Tenants are responsible for all connections and cables. Hillside Palms is not liable for power failures, surges, lightning, or short circuits. Tenants must use an RV-rated outdoor power-surge protector to protect against power fluctuations. Failure to use an RV-rated surge protector may result in liability for damages to the tenant’s unit or park infrastructure. 9. Yard/Lot Care: Tenants must maintain their rented space, keeping it clean and free of debris, garbage, or unsightly items (e.g., broken appliances, boxes). Units must be kept in good repair (e.g., paint, awnings, skirting). Management will conduct periodic inspections. Violations will receive a notice with a reasonable correction period. Failure to comply incurs a $100/month fee until resolved. Tenants on larger lots (most lower lots, #47, #48) are responsible for yard care, trimming, and clearing old growth. Optional basic yard care is available for $50/month. 10. Sewer & Water: Sewer is included with rent. Tenants must notify Hillside Palms for sewer blockages, and only Tony at Roto-Rooter is approved for repairs. Tenants may be charged for non-compliant repairs or after-hours calls. Do not flush feminine products, wipes, paper towels, non-RV-rated toilet paper, or unapproved chemicals. Water is included, but fines may apply for leaks, wasteful use, or per-person fees based on local restrictions. Tenants must use an RV-rated water pressure regulator and ensure leak-free, airtight sewer connections to prevent damage or odors. 11. Pets: Only dogs (under 20 pounds) and cats are allowed, with one dog per space unless written permission is granted. A $50/month fee applies per dog. Dogs must be on a 6-foot leash and under control; cats must be primarily indoors and tended when outside. Pet waste must be cleaned immediately, sealed in bags, and disposed of in the trash dumpster. No outdoor cat litter boxes or kennels/dog runs are allowed. Fines start at $100, escalating by $100 per violation ($200, $300, etc.). Three violations result in eviction. Service dogs are permitted per law. Unattended or aggressive dogs will be reported to Animal Control, with biting dogs grounds for immediate eviction. Tenants are responsible for pet safety (e.g., A/C, food, water) during power outages. 12. Respect for Rented Spaces, Prohibition on Playground Use, and Parental Responsibility: • Respect for Rented Spaces: Adults and children shall not enter another resident’s rented space (including individual RV lots or assigned areas) unless acting in a good-faith, neighborly manner, such as with an express invitation or mutual agreement. Entering another resident’s rented space uninvited, or after a neighbor has expressed that they do not want visitors, is inappropriate, constitutes a private nuisance, and violates park rules, subject to enforcement under Utah Code § 57-16-6. • Management Access to Rented Spaces: Park management, including authorized staff, may enter any rented space to deliver bills, messages, notifications, violation notices, or to conduct maintenance, inspections, or other park operations, as permitted under Utah Code § 57-16-4. • Nuisance Behavior: Any activity in rented spaces or common areas that disturbs the peace, safety, or enjoyment of other residents, such as uninvited entry onto another resident’s rented space, causing damage, or smoking (e.g., tobacco, vape, or other substances) that invades another resident’s rented space, is considered a private nuisance and is prohibited, per Utah Code § 57-16-6. • No Designated Play Areas: The RV park is not designated as a playground, and no areas within the park are designed or maintained as safe play spaces for children. Children are prohibited from using common areas, streets, or other park facilities for recreational play, including but not limited to running, biking, or sports activities, due to safety hazards. • Parental/Guardian Responsibility: Parents or legal guardians are responsible for supervising their children at all times within the park to ensure their safety and compliance with park rules. The park does not provide designated safe play areas. Parents or guardians must ensure children do not engage in activities that endanger themselves or others, climb surrounding hills, throw or climb rocks, play in streets, ride skateboards/scooters, or damage/disrupt other tenants or park property, per Utah Code § 57-16-6. • Unsafe Areas for Play: The Redhill storage lot, all RV parking areas, and other common areas are designated as unsafe for children’s play due to utility connections (e.g., electrical, water, or sewer hookups), hilly terrain, and frequent vehicle traffic (e.g., cars, trailers). Children are prohibited from playing, loitering, or engaging in recreational activities in these areas. 13. Speed Limit: The speed limit is 5 miles per hour, posted and enforced via cameras. Violations incur a $100 fine on the rent bill, with police notification and potential eviction after three violations, as speeding constitutes reckless driving and endangers persons/property, per Utah Code § 41-6a-601. 14. Parking: Only two daily-use vehicles per space are allowed. No stored, for-sale, broken-down, or extra work vehicles are permitted. Parking on grass, yards, sidewalks, or in front of neighbors’ spaces without permission is prohibited. Excess vehicles may be towed at the owner’s expense. Semi-trailers or large commercial vehicles are prohibited, and parking in fire lanes is not allowed. Maintenance crews are exempt for work trucks/trailers. 15. Inoperable or Abandoned Property: Unsightly or inoperable vehicles not used daily are prohibited and may be towed at the owner’s expense. Property abandoned for 30 days is considered legally abandoned and subject to action per Utah Code § 57-16-13. 16. Vehicle Washing or Repairs: Major repairs (e.g., engine overhauls, transmission work, spray painting, oil changes) are prohibited. Inoperable vehicles or those in disrepair will be towed after one warning. Minor repairs (e.g., points, plugs, tire changes) are allowed if completed quickly and all chemicals cleaned immediately. Vehicle washing is not permitted in the Park; use a car wash. 17. Insurance: All vehicles, RVs, tiny homes, or mobile homes must comply with state laws, including registration and insurance. Unregistered or uninsured units are not permitted. 18. Guests: Guests or children staying over 7 days require written approval after submitting a tenant application and passing a background check. Approved guests may stay up to 27 days, with a $50/person/month fee for water use added to the bill. 19. Trash and Garbage: Trash must be in plastic bags and placed in designated dumpsters at the west end of upper and lower areas. Do not use receptacles belonging to nearby motels or furniture stores. Dumpster rules are posted and enforced. 20. Complaints: Valid written and signed complaints will result in a written warning to the violating tenant, with a 7-day period to correct the violation, per Utah Code § 57-16-6. A second violation incurs written notification, correction instructions, and fines. A third violation may result in additional fines and a 15-day eviction notice, with the violator liable for court costs and damages as permitted under Utah Code § 57-16-6. 21. Right of Enforcement: The park owners reserve the right to deny entry to any party or vehicle violating rules or park standards and to add or change rules with 60 days’ written notice, per Utah Code § 57-16-7. 22. Litter and Vandalism: Littering incurs a $100 fine per violation. Vandalism or theft incurs a $500 fine per violation, plus repair/replacement costs, and may include criminal prosecution and eviction with damages as permitted under Utah Code § 57-16-6. 23. Surveillance, Texting, and Emails: Tenant acknowledges and is agreeable that The Park uses cameras and video surveillance, and activities may be recorded. Tenants also agree to receive emails and texts for park-related communication. 24. Home Businesses: No home-based businesses are permitted within Hillside Palms RV Park. This includes, but is not limited to, any commercial activities, services, or operations conducted from a tenant’s rented space or unit. Clients, customers, or business associates are not allowed to visit the Park for the purpose of receiving services, picking up items, dropping off items, or engaging in any work-related transactions. Remote phone or computer work/employment is permitted for tenant only. Violations of this rule constitute a private nuisance and may result in enforcement actions, including fines, warnings, or eviction, per Utah Code § 57-16-6. C. Violations & Evictions Receiving three warnings for violating park rules within a 12-month period is grounds for a 15-day eviction notice, per Utah Code § 57-16-6. Single violations warranting immediate eviction include: rent/electric fees over one month past due after a 5-day notice; vandalism; theft; violence; harassment; threats; nuisances, including excessive noise (TV, music, equipment, devices, vehicles, voices, instruments, honking horns), excessive visitors/guests, smoking that invades another resident’s rented space, unauthorized subleasing/Airbnb/vacation rentals, or use of fireworks/fireworks-related activities; disruptive, disrespectful, or criminal activity (e.g., drug use/possession/distribution); or behavior making others feel unsafe. Evictions are at the discretion of Hillside Palms management. Evicted tenants forfeit paid rents/utilities and are liable for court costs and damages as permitted under Utah Code § 57-16-6, including daily rental value for remaining in the premises post-notice. D. Approval of Purchaser and Subsequent Tenants Tenants may sell their mobile home, tiny home, or RV per Utah Code § 57-16-14 and park rules, provided the unit is in good condition. Tenants must notify the manager in writing of intent to sell and ensure all rents/utilities are paid. At the owners’ request, any mobile home, tiny home, or RV may be required to be moved out of the Park at the seller’s or owner’s expense with 60 days’ written notice, for any reason, including but not limited to RV park upgrades, repairs, renovations, or change of use of that particular area of the park or property, per Utah Code § 57-16-4(3)(b) and § 57-16-14. Buyers intending to reside in the Park must: 1. Complete a Hillside Palms Long-Term Application online, agreeing to all rules and providing a valid photo ID for all residents. 2. Provide proof of the RV, tiny home, or mobile home’s legal name, model, and year. 3. Meet with owners/manager to discuss sale details and obtain approval for the unit to remain, based on unit condition and compliance with park rules. 4. Await written acceptance based on application and background checks, which may include criminal, credit, and rental history, per Utah Code § 57-16-4(6)–(10). 5. Pay first and last month’s rent. If unapproved, buyers cannot reside in the Park, and the unit must be moved within 30 days at the seller’s expense, with rent owed until vacated. E. Renovation or Remodeling of Trailers Renovation or remodeling plans for mobile homes, park models, or tiny homes (e.g., decks, sheds, stairs, awnings, exterior design/colors) must be submitted and approved in writing by management; approval will not be unreasonably withheld, per Utah Code § 57-16-7. No permanent installations are allowed; units must retain axles and remain non-permanent. F. Hold Harmless Agreement By submitting this application, tenants agree to indemnify and hold harmless Hillside Palms RV and Mobile Home Park, its officers, owners, employees, and authorized agents from and against all claims, losses, damages, injuries, or liabilities arising from the tenant’s or their guests’ activities in the Park, including but not limited to reserving, visiting, parking, staying, or living in the Park; damages or injuries caused by other tenants, guests, visitors, contractors, or third parties; or events such as fire, theft, or acts of God (e.g., flood, wind, falling rocks, uneven ground, landscape materials, trees/plants, or insects). Tenants assume responsibility for risks associated with driving, parking, storing property, and connecting or disconnecting to utility hookups (e.g., water, sewer, electricity), provided such risks are not caused by the Park’s negligence or willful misconduct. Tenants are required to use an RV-rated outdoor power-surge protector to protect against power fluctuations, and failure to do so may result in tenant liability for resulting damages to their unit or Park infrastructure, per park rules (Section B.8).
