HILLSIDE PALMS RV PARK RULES WITH APPLICATION & AGREEMENT Scroll to the Bottom to Click Agree Button *This field is required. A. APPLICATION 1. All prospective tenants or buyers of mobile homes or RVs within Hillside Palms RV and Mobile Home Park, hereinafter referred to as “Hillside Palms Or Park,” must meet personally with the owners of Hillside Palms or its Managers, Angaleza Adams, or Acacia Hansen and submit a formal application for residence. If the applicant’s application is approved, they will be permitted to move into the Park according to the time and space designated by the Manager. 2. FAIR HOUSING PRACTICES: Hillside Palms has no restrictive covenants or policies, implied or written, which would bar residency based on race, religion, familial status, sexual orientation, or gender identification. 3. SINGLE FAMILY DWELLINGS: Hillside Palms spaces must be OWNER OCCUPIED by one single family, not multiple families living in the same RV, tiny home, or mobile home. Two adult persons are permitted per space. Two or more families purchasing or occupying a home will not be allowed. If it becomes necessary to have a minor family member reside with you temporarily, the rent will increase by $50.00 per person/month to cover the extra water used by each individual. All adult person(s) must submit the application and be approved in writing by Hillside Palms RV Park management before moving in. If their application is not approved, they will not be permitted to move into the Park, regardless of their relationship with the existing tenant. (NO UNIT MAY BE SUB-LEASED OR RENTED ON ANY BASES. NO AIRBNB OR VACATION RENTALS ALLOWED) 4. MONTHLY RENTAL AGREEMENT: All rental fees are month to month. This application is for those with the intention of staying Long-Term. Any other yearly contracts signed or created before this application will no longer be honored or valid. RVs/Mobile Homes must be owner-occupied unless authorized permission from Hillside Palms has been given in writing. Hillside Palms is upgrading and converting some spaces in the Park from a Mobile Home/RV park to RV spaces. Therefore, units older than ten (10) years, unsightly, in disrepair, or units considered mobile homes may be required to move out upon the Sale of these mobile homes. We reserve the right to require the owner of a unit to move the Unit or demolition the Mobile Home if it is immovable, all at their own expense. Hillside Palms RV Park will be continuously completing construction projects, reconstruction, and/or upgrading to the Park going forward. Tenants will be expected to comply with all requests to move and will be given sufficient time to do so. 5. APPROVAL IN WRITING: If approved, you will receive that approval and confirmation in writing. Once a space is available, and you would like to secure the space, you will then pay a NON-REFUNABLE DEPOSIT that will be credited on your first month’s bill. If you choose not to take the space for any reason, that deposit is non-refundable. 6. ABANDONMENT, UNOCCUPIED UNITS, DEATH, AND INCARCERATION: Units are rented to be occupied. If tenant is unable to occupy the Unit for any reason, including but not limited to: abandonment with no contact with Hillside Palms RV Park for 30 days, extended hospitalization, or extended health care, arrangements to maintain the Unit and pay the rent must be arranged. In the case of death, anyone who takes over the Unit will be subject to “ITEM I” of this Agreement. They will need to submit the application as if they were buying the UNIT to stay or live at Hillside Palms RV Park, or they will need to sell it according to the Rules listed here in “ITEM I” as well. An emergency contact or next of kin assigned to take responsibility in these scenarios needs to be provided in this application in the appropriate field. If incarcerated longer than 30 days, the tenant will need to arrange to move the home out of the Park and have rent and utilities paid in full. If convicted of a felony, this will be grounds for immediate eviction. B. GENERAL 1. RENTAL FEE IS PAYABLE ON THE FIFTH DAY OF EACH MONTH. As you enter the RV Park, the large white Self-Pay Station Box at the top of the hill on 600 East is where you can drop your payments. This box and the Park are under 24-hour video surveillance and security. Those who need to mail their payment can send it to: Hillside Palms RV, 175 N. 600 E. #51 St. George, Utah 84770. It will be considered late if received after the 10th of the month. A $50.00 late fee will be due and payable with the next month’s rent payment unless other arrangements are made with the owners. After a rent payment is 30 days past due, the account will be turned over for collections and subsequent legal action. Three (3) consecutive late payments constitute a breach of your Agreement, and you will be considered tenancy at will, which is grounds for a five-day (5) eviction. If you will be late paying your bill, please let us know and arrange to make a late payment. A charge of $50.00 will be applied to all returned checks. As of 2023, rent for each space ranges from $550-750/month, depending on the individual space, plus metered electricity. Rent will increase with economic conditions and inflation at the managers’ discretion. Tenants will be given a 30-day notice on all rent increases and a 30-day notice on additional fees. 2. PROPERTY DAMAGE OR LOSS: The owners of Hillside Palms will NOT be held responsible for personal or property loss or damage to property or vehicles of any tenant or their guests by any other tenant, guest, worker, host, maintenance crew or by fire, electrical, theft, or acts of God or nature, including water, sewer, flood, uneven ground, falling rocks or land/rock movement or for personal or property damages or injuries to the tenant or tenant’s family and/or guests at any time or any place within the legal boundaries of Hillside Palms RV Park. By signing this Agreement, the tenant releases Hillside Palms and its owners, partners, hosts, and all management, workers, or subcontractors of any liability for loss, damage, or injury. By staying with us, you assume all liability and are responsible for driving, parking, checking in and out, and staying, visiting, or living while on Hillside Palms Palms RV Park property. 3. SELF-CONDUCT: Occupants are responsible for their actions and conduct and for the actions and conduct of their family members and guests. Residences are liable for all costs incurred by the tenant’s, family members, or guests due to misconduct or damage. No firepits or open flame grills are allowed. No semi-permanent or permanent installations of swimming pools, no jacuzzi/spas, and no standard trampolines or playground equipment can be installed. 4. NOISE/TRAFFIC: Excessive noise from music, television, sports activities, ATVs, motorcycles other equipment during all hours or other disturbing factors between 9:00 p.m. and 8:00 a.m., and at any other time it becomes excessive or is disturbing to neighbors is strictly prohibited. Other nuisances, including excessive visitors, will not be permitted at any time. Unlawful nuisance activity will not be permitted. An excessive or disproportionate number of foot traffic or vehicles and the storage of unsightly and/or damaged or broken down vehicles will not be allowed. According to Utah Code, violations of the noise/traffic rules will be grounds for eviction. 5. USE OR DISTRIBUTION OF ANY UNLAWFUL DRUGS AND/OR SUBSTANCES OR THE CONSUMPTION OF ALCOHOL BY ANYONE UNDER THE AGE OF 21 ON THE PROPERTY OF HILLSIDE PALMS RV PARK IS STRICTLY PROHIBITED. It will be reported directly to the appropriate law enforcement agencies. Any activities stemming from the USE, POSSESSION, OR DISTRIBUTION OF THESE SUBSTANCES, CONSTITUTES IMMEDIATE EVICTION. Additionally, any unlawful behavior such as stalking, harassment or threats, domestic disputes, or abusive language or behavior to any other tenant, host, maintenance worker, owner, or manager will also be reported to law enforcement and will be grounds for immediate eviction. 6. TELEVISION: For tenants staying longer than three months, Cable TV is available. Each lot/space is cable-ready, and a digital cable box is required to receive channels for each TV. TDS is the cable TV provider. Tenants are responsible for signing up and paying for this service, including installing the box and activating the box by calling TDS – tenants are also responsible for all cables or wires required to connect to the RV, TVs, and other equipment. (All tenants who have a box issued prior to 2023, must return cable boxes to Hillside Palms RV Park Management or Host – Other boxes issued directly from TDS must be returned to TDS. 18-inch Satellite dishes are also permitted. 7. INTERNET: A free Wi-Fi connection is currently broadcast on the upper level for short-term guests. There is no tech support provided for this connection. Hillside Palms does not make any warranties or guarantees regarding this service, speed, or connection. It is not to be used for streaming on any platform. Additionally, if, for any reason, this connection does not work for tenants, no refunds or credits will be given. Dedicated High-Speed Internet is available to long-term tenants from several providers: TDS, Centurylink, or Infowest. Tenants are responsible for contacting a provider directly, signing up, and paying for their connections once they are moved into your space. 8. POWER: Your electricity is billed monthly with the rent. Tenants are responsible for all connections and cables to the trailer and the power supply. Hillside Palms RV Park is not responsible for power failures, power surges, lightning, or short circuits that may occur. We recommend using an RV-Rated outdoor power-surge protector for your RV, Tiny Home or Mobile Home. 9. YARD/LOT CARE: Each tenant is responsible for maintaining, cleaning, and clearing any debris on their lot spaces, including front, behind, or on each side of their trailer. Also, please remove all garbage and unsightly storage of old or broken-down appliances, boxes packed with things, or other items around or under the trailers. Keeping the yard/lot neat and well-kept and keeping the trailer clean and in good repair, including paint, awnings, skirting, siding, and any exterior elements, are required and are entirely the tenant’s reasonability. Periodic inspections by the management will evaluate each Unit and your lot space. Any tenant with problem issues on their unit/lot will receive a notice detailing the problem that needs to be fixed. You will be given a reasonable amount of time to do so. If your lot is not cleaned or you have not remedied the problem by the deadline date on the notice, an extra charge of $100 will be added to your upcoming statement and an additional $100 each month after that until the problem has been cleaned up or remedied to the satisfaction of the Inspectors, Manager and/or Owners. If you live in the larger lots (Most Lower Lots and #47, #48 on the Top) with individual yards, you are responsible for your yard care, trimming, and clearing old growth. Please let us know if you would like the Park to provide your yard with basic monthly yard care; we will arrange the service for an additional $50/month. 10. SEWER & WATER: Sewer is included with the rental fee. However, if a tenant’s sewer line becomes blocked, the tenant must notify Hillside Palms, who will contact Tony at Roto-Rooter, the only approved repair service. No after-hours service calls are provided, and any additional charges for the service may be charged to the tenant’s monthly bill if these procedures are not followed. With this in mind, DO NOT flush feminine products, wipes, or paper towels down the toilet. DO NOT use any toilet paper that is not rated for RV use; only septic-friendly toilet paper, and DO NOT use unapproved chemicals in sewer lines. Water is included with your rent. However, Hillside Palms reserves the right to charge fines for RV or hose water leaks, wasteful use of water, and/or a per-person water fee, depending on usage and local water restrictions and fees. It is the tenant’s sole responsibility to use an RV Rated Water Pressure Regulator on their water connections. Hillside Palms is not responsible for any water-related damage. Also, it is your reasonability to protect the sewer connection from rocks as you connect and disconnect. Please ensure your connection is leak-free and air-tight to avoid the unpleasant smells and that rocks will not fall into your sewer connection. 11. PETS: Dogs or cats only - no other type of animal of any kind is allowed. Only dogs under 20 pounds are permitted to live in the Hillside Palms community. Only one (1) dog per space is allowed unless specific written permission is granted. There is an extra $50/month fee for each dog. Dogs must be walked on a 6 foot leash at all times, and must be under the control of the owner. Hillside, Palms RV Park, will contact animal patrol if any dog is left off leash, or is misbehaving. Cats must be kept mostly indoors and when outside must be tended to. All Cat and Dog BM waste must be thoroughly cleaned up and carried away by its owner in a sealed bag and properly disposed of in the trash dumpster. No cat litter boxes allowed outside. Fines starting at $100 will be placed on your rent bill and will escalate by an additional $100 each time any waste is found anywhere in the park or in your space and not disposed of properly belonging to your dog or cat. This escalating fine increases each time you don’t pick up the BM. $100, $200, $300, etc. After three (3) violations, you can expect an eviction notice. Do not leave bags with waste around or under your Unit. No outdoor kennels or dog runs are allowed. Service dogs are allowed according to the governing laws. Do not leave your dog tied or chained up in your yard. It is the tenant’s responsibility to monitor and keep your dog or cat safe with proper A/C, food and water and be aware that if the power goes out and your pet is in your Unit without Air Conditioning in the St. George heat, it may be fatal. If a dog shows threatening aggression toward anyone or bites anyone, it will be reported to the Animal Patrol and will be grounds for immediate eviction. 12. CHILDREN: It will be the sole responsibility of the tenant to ensure that any and all children living or visiting the tenant will be supervised at all times to ensure that they stay safe, do not climb the surrounding hills, throw or climb rocks, don’t play in the streets of the Park, no riding skateboards skates, scooters or damage or disrupt tenants or property of any other tenants or Hillside Palms RV Park. 13. SPEED LIMIT: The speed limit is 5 miles per hour (Posted and enforced). We ask all tenants to cooperate with its enforcement. Cameras are active in the Park. Violation notices will be issued, $100 fines will be levied on your rent bill, police will be notified, and tenant eviction will be imposed after three (3) violations. Speeding constitutes reckless driving and endangers persons and property. 14. PARKING: ONLY TWO Daily use vehicles per space allowed. No extra stored, for sale, broken down, or extra work vehicles permitted. Tenants or guests will not be allowed to park their vehicles on the grass, in their front yard areas, on sidewalks, or let their vehicles extend from the driveway onto the sidewalk. Do not park in front of your neighbor’s home without their permission. Any vehicles of more than two (2) are subject to be towed to impound at the owner’s expense. Hillside Palms RV Park Maintenance crews are exempt and are allowed extra parking for their work trucks/trailers. PARKING OF SEMI-TRAILERS OR OTHER EXCESSIVELY LARGE OR COMMERCIAL VEHICLES IS PROHIBITED. DO NOT PARK IN DESIGNATED FIRELANES. 15. INOPERABLE OR ABANDONED PROPERTY: Unsightly or inoperable motor vehicles or vehicles that are not used and moved regularly (daily use) are prohibited and may be towed at the owner’s expense. Vehicles, trailers, and all property abandoned for 30 days will be considered legally abandoned property and subject to park management’s legal action according to state laws. 16. VEHICLE WASHING OR REPAIRS: Major repairs or spray painting, changing vehicles' oil at the tenant’s space or anywhere in Hillside Palms is prohibited. Any inoperable vehicle or a vehicle in disrepair is not allowed to be parked or stored in the RV Park and will be towed at the owner’s expense after one warning. No Major repairs can be completed while in the Park, including engine overhauling, transmissions, etc. Minor repairs such as points, plugs, or tire changing are allowed. But must be completed quickly as not to last more than a few hours. Any oil, gasoline, or other potentially dangerous chemicals must be cleaned up immediately. You are also not allowed to wash your vehicles in the Park. Please wash your vehicles at a car wash. 17. INSURANCE: All vehicles, RVs, Tiny Homes, or Mobile Home units must comply with state laws and codes. No unregistered or uninsured vehicle or Unit shall be allowed to stay within the Park. 18. GUESTS (MORE THAN 2 PEOPLE PER SPACE) If a tenant has a guest or children that will be visiting or living longer than 7 days, approval in writing must be granted. Before permission is granted, the adult guest must fill out a complete tenant application on our website, pass the background check, and receive written approval to stay up to 27 days only. Additionally, a $50/person/month fee will be added to the regular monthly bill for the month the guest stays to cover the cost of extra water use. 19. TRASH AND GARBAGE: Trash receptacles are located on the west end of both the upper and lower areas. Trash should be contained in plastic garbage bags and not dumped loose. DUMPSTER RULES ARE POSTED AND WILL BE ENFORCED. DO NOT USE RECEPTACLES THAT BELONG TO THE MOTELS OR FURNITURE STORE. THEY ARE NOT FOR USE BY HILLSIDE PALMS TENANTS. 20. COMPLAINTS: Upon receipt of a valid written and signed complaint submitted to the park owners or Manager by a tenant, the violating tenant will receive a verbal and/or written warning and an opportunity to explain their position. The second violation will result in a written notification and instructions on how he or she is expected to correct the problem and pay applicable fines. A third violation may result in additional fines and eviction including court proceedings, with the violator becoming solely responsible for all court, attorney fees and treble damages. 21. RIGHT OF ENFORCEMENT: The park owners reserve the right to forbid any party or vehicle entry into the Park, which is or has been in violation of these rules or does not meet the park standards. Additionally, the park owners and/or managers reserve the right to add or change the rules and regulations at their sole discretion and as they see necessary. 22. LITTER AND VANDALISM: It is unlawful to litter. A fine of $100.00 will be imposed for each violation on anyone who is found guilty. This includes unsightly trash on the outside of homes. Vandalism or theft will not be tolerated and will carry a fine of $500.00 for each violation in addition to any repair or replacement cost incurred by Hillside Palms. The litter or vandalism violation could potentially include criminal prosecution, and eviction with treble damages including legal fees. 23. SURVEILLANCE CAMERAS, TEXTING AND EMAILS: I understand and acknowledge that Hillside Palms has Cameras and Video Surveillance equipment. Any Park activity may be recorded or captured via these cameras. I also agree to receive emails and texts as the Park Management deems necessary for communication concerning living, staying or visiting Hillside Palms RV Park. H. VIOLATIONS & EVICTIONS: Receiving three (3) warnings for violating any of the park rules or regulations within a 12-month period will be grounds for eviction. Situations where one (1) warning may result in eviction are: being behind more than one month passed due on rent and electric fees; vandalism; theft; violence; harassment; threats; nuisances, including excessive noise (TV, music, equipment, devices, vehicles, voices, instruments, honking horns); disruptive, disrespectful or criminal activity, including but not limited to possession, use or distribution of illicit drugs; threats of any kind toward any tenant guest or the park staff or any verbal harassment, behavior or activity that makes other park tenants or park staff, managers or owners or maintenance workers, or subcontracted trade workers feel unsafe. These evictions are at the sole discretion of Hillside Palms Ownership and Management. If evicted you will forfeit any paid rents and utilities and will be responsible for all filing fees, attorney fees, and court costs associated with your eviction process. You will still be liable for unpaid rents, utility fees, and any damages incurred in the process of eviction. (You will also be liable for three times those damages allowed to be trebled under Utah Code Ann. § 78B-6-811 which may include trebling damages mentioned above. Rent due and unpaid shall be trebled each day you remain in the premises after this notice expires. Damages under this rule are the reasonable rental value or reasonable value of the use and occupation of the premises for each day you remain after the expiration of this notice.) I. APPROVAL OF PURCHASER AND SUBSEQUENT TENANTS: Tenants may sell their mobile or tiny home, or RV at any time pursuant to the rights and obligations of the tenant and the Park under the Mobile Home Residency Law and other applicable laws and according to the Rules and Regulations of Hillside Palms RV Park pertaining to the Sale of the home. Tenants must, however, 1. immediately notify the park manager in writing of the tenant’s intent to sell their home and, additionally, 2. all rents and utilities must be current and paid in full before the home can be sold, moved, or occupied by the new buyer. If the prospective buyer of the home intends for the home to remain in the Park or for the buyer to reside in the Park, the buyer must do the following before occupying the home: 1. Complete a Hillside Palms Long-Term Application Online (This application and agree to all Rules and Regulations and include a Valid Photo ID for every individual who will be living in the Unit that is for Sale.) 2. Provide proof of the legal Name, Model, and Year of the RV. 3. Meet with the Owners/Manager to discuss the details of the Sale. Have RV, or Mobile Home approved to stay in the Park (Hillside Palms RV is upgrading all park spaces to hold RVs – 10 years old or newer – not all Mobile Homes or RVs will be approved to stay in the Park based on age and condition) 4. Wait for acceptance in writing based on the submitted application and background checks. 5. Pay the First and Last Month’s Rent to the Park *If the buyer’s application is not approved, the buyer will not be allowed to move into the home and will have 30 days to find a place outside of Hillside Palms to move it if the Seller proceeds with the Sale. In the meantime, the Buyer will NOT be permitted to live in the home, and the moving expenses of the home will be the responsibility of the Seller. The Seller will also be responsible for the rent of the space until the Unit is moved out of the Park and the space is Vacated. These rules are consistent with state and local laws. They are not meant to deny or restrict but to ensure a clean and safe environment for all persons living or visiting within Hillside Palms. Park Owners reserve the right to amend or change these rules at their own discretion after giving the tenants 30 days written notice. J. RENNOVATION OR REMODELLING OF TRAILERS (MOBILE HOMES/PARK MODELS/TINY HOMES): If any renovation or remodeling is planned for the existing Mobile Homes, Park Models or Tiny Homes, all plans, color schemes including decks, sheds or other structures, stairs awnings, and exterior design and color must be submitted and approved in writing by the Park Management prior to any work being done. Approved colors and finishes must be adhered to. No permanent installations, including sheds, decks, or additions to homes are allowed. All units must have axles and not be installed in any permanent fashion. K. HOLD HARMLESS AGREEMENT By completing and submitting this form, you agree to protect, defend, indemnify Hillside Palms RV Park and its officers, owners, workers and agents free and harmless from and against any and all losses, damages, injuries, settlements, costs, charges, professional fees, or other expenses or liabilities of every kind and character arising out of or relating to any and all claims, liens, demands, obligations, actions, proceedings or causes of action of every kind and character in connection with or arising directly or indirectly out of reserving, visiting, parking or staying at Hillside Palms RV Park, whether it be personal or property damage to vehicles of any guest, tenants or visitors by any other tenant, including but not limited to guests, visitors, workers, landscape crew, subcontracted workers, or repairman, park staff, park owners or their agents; by fire, electrical, theft, or acts of God or nature, including, but not limited to damages by water, sewer, flood, pot-holes, asphalt or concrete cracks, uneven ground or uneven grass, gravel or boulders, land movement, falling rocks, excessive rain or damage from the rain, or other elements in nature including wind or any damages resulting from the wind, insects, squirrels or other critters, landscaping or trees, plants, or any damage resulting from trimming and maintenance of the trees, grass plants or any other areas of the Park. Based on industry-standard recommendations, protecting your valuable RV electronic and electrical components from damage due to common power fluctuations is important, Hillside Palms Recommends using RV Outdoor Rated Surge Protectors for protecting your RV from power surges when you are traveling and hooking up to any electric services including Hillside Palms RV Park. By staying with us or storing your property and vehicles with us and/or simply requesting a reservation, you assume all liability. You are responsible for your driving, parking, storage of any personal property, and connection to hookups, while staying and living on Hillside Palms RV property. *I AGREE TO SUBMIT THIS REQUEST AND I UNDERSTAND THAT RESERVATION REQUESTS ARE NOT GUARANTEED - BASED ON AVAILABILITY AND APPLICATION APPROVAL.
