North Star Cycling Club Waiver & Release

1. By signing and agreeing to this Waiver & Release for myself (or for the participant if the participant is under 18) I agree to RELEASE, HOLD HARMLESS, and INDEMNIFY North Star Cycling Club and all its sponsors, their respective officers, agents, members, employees and volunteers, and any and all authorized participants for any injury, loss, or damage suffered as a result of participation in any North Star Cycling Club event, or any activity associated with said events, caused by the NEGLIGENCE of any of the above-named persons or entities. This includes any and all claims for personal injury, death, or property or other damages that may arise out of the use of a North Star Bicycle Club-owned bicycle and for the use of any other bicycle. I understand that this Release is also binding on my heirs and representatives and that any legal action that may arise from any North Star Cycling Club event will be handled in the state of Washington according to Washington state law. 2. I understand the route chosen may be challenging, not necessarily the safest or easiest route, and that weather, road, or traffic conditions may make this ride more difficult. I warrant that I am in proper physical condition to participate in this event, that I am a sufficiently competent cyclist to handle the road conditions, and that my bicycle is in safe operating condition. I understand that I ride with North Star Cycling Club at my own risk. 3. I understand that if I borrow a bicycle that is owned by North Star Cycling Club, that it will be provided to me in proper working condition and must be returned in the same manner. I further understand that it is my responsibility to check the bicycle prior to the start of any North Star Cycling Club event to ensure it is in proper working condition and that I am able to safely operate it. I understand that it is not possible to predict every situation and condition of the terrain the bike will be ridden on; therefore, it is impossible to guarantee the bike I use will react safely in all riding conditions. I understand that I ride with North Star Cycling Club at my own risk. 4. I agree to wear a helmet and to follow the rules of the road and all safe bicycling practices while participating any North Star Cycling Club event. I understand that wearing a helmet that meets the CPSC, SNELL, ASTM or ANSI bicycle safety standards can minimize head injuries which may occur in a cycling crash, and that North Star Cycling Club requires all riders to wear helmets. It is my sole responsibility to ensure that my helmet meets CPSC, SNELL, ASTM or ANSI standards and to wear my helmet while participating in any North Star Cycling Club event. 5. I give permission to North Star Cycling Club to use my image in any future North Star Cycling Club materials, including print or on-line, should I appear in photos taken during any North Star Cycling Club event. 6. North Star Cycling Club reserves the right to remove any rider from any North Star Cycling Club event if said rider is deemed by an authorized North Star Cycling Club agent to be endangering themself or other participants or is riding illegally as defined by Washington state traffic laws. Notwithstanding this clause, North Star Cycling Club is not responsible for cyclists not removed from any event and this clause shall in not exempt participants from any other clause in this agreement. 7. I understand that North Star Cycling Club and all its sponsors, respective officers, directors, volunteers, and agents are not responsible for any lost, stolen, or damaged personal property during any event. 8. I understand that North Star Cycling Club requires all riders to observe and comply with Washington State, city and county public health orders, laws and regulations for preventing the spread of the Coronavirus/COVID-19. I understand that North Star Cycling Club cannot be held liable for any exposure to Coronavirus/COVID-19.I pledge to ride safely and courteously and obey all vehicle traffic laws while riding in any North Star Cycling Club event.

BY SIGNING BELOW, I AGREE I HAVE HAD SUFFICIENT TIME TO READ AND FULLY INFORM MYSELF OF THE ENTIRE CONTENTS OF THIS WAIVER AND RELEASE AND, SHUOLD I CHOOSE TO DO SO, CONSULT WITH LEGAL COUNSEL PRIOR TO SIGNING. ALSO, I AGREE THAT THE OPPORTUNITY TO PARTICIPATE WITH NORTH STAR CYCLING CLUB EVENTS IN RETURN FOR THE EXECUTION OF THIS RELEASE IS A REASONABLE BARGAIN. AGAIN, I HAVE READ AND UNDERSTOOD THE WAIVER AND RELEASE AND AGREE TO BE BOUND BY ITS TERMS.

(Must be completed for participants under the age of 18)A parent or legal guardian must sign for and be responsible for all persons under the age of 18 participating in any event.

I authorize emergency medical treatment for the minor named below and I accept full responsibility for all medical expenses incurred as a result of the minor’s participation in any North Star Cycling Club event. I hereby RELEASE, HOLD HARMLESS, and INDEMNIFY North Star Cycling Club and all its sponsors, their respective officers, agents, members, employees and volunteers, and any and all authorized participants, from any claims made by or on behalf of the minor named below arising out of any injury, loss or damage suffered as a result of the minor’s participation in a North Star Cycling Club event or any activity associated with it.I further state that I am a parent or legal guardian of the minor named below and am authorized and legally competent to sign this waiver and release. I understand that the terms of this document are contractual and not a mere recital, and I have signed this document as my own free act.I AGREE I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS ADDENDUM BY READING IT AND AGREE TO ITS TERMS.
