LIABILITY WAIVER AND RELEASE FORM

I, the signed below, individually and/or on behalf of my minor child, understand there are varying risks of injury involved in participating in physical training and conditioning activities, including at MVP ACADEMY. Such activities may include, but are not limited to strength training, conditioning, stretching, group exercise classes, use of weights and/or other equipment, general workouts, and/or any related use of MVP Academy’s premises (collectively, “Activities” By participating in any such Activities, there are risks of harm due to, for instance: my or my child’s own negligence; negligence of other people; improper use or failure of equipment; or trips or falls. The types of injuries (“Injuries”) that may occur as a result of my or my child’s participation in such Activities include, but are not limited to: sprains, strains, and abrasions; illness, such as abnormal blood pressure, dizziness, fainting, shortness of breath or abnormal heart rhythm; temporary or permanent bone or joint injury; paralysis; scars; other chronic disabling conditions and even death.

I hereby accept and assume the risk of any and all Injuries that may result from my or my child’s participation in any Activity while at or under the direction of MVP ACADEMY, whether on or off the controlled premises of MVP ACADEMY, as well as the possible consequences of such Injury.

A. WAIVER AND RELEASE

In full consideration of the above-mentioned risks and hazards and in full consideration of the fact that I and/or my child am/is willingly and voluntarily participating in the Activities made available by MVP Academy, I hereby waive, release, remise, and discharge MVP ACADEMY, its successors, assigns, licensees, officers, directors, agents, employees, and volunteers from any and all claims, damages, liabilities, costs and expenses of any kind related to, arising from, or in any way connected with my or my child’s participation in any Activity offered by MVP Academy, either on or off the controlled premises of MVP ACADEMY, including those Injuries attributed to the negligent acts or omissions of third parties. I acknowledge and fully understand that this agreement shall be legally binding upon me, my heirs, estate, assigns, including all minor children, and personal representatives.

B. INDEMNIFICATION

I understand that there is a risk of injury to myself and/or my child and others in the types of activities offered by MVP Academy. I agree to indemnify and hold harmless MVP ACADEMY, its successors, assigns, licensees, officers, directors, agents, employees, and volunteers from and against any and all claims, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) related to, arising from, or in any way connected with my or my child’s participation in Activities at MVP Academy. Such indemnification shall include, but not be limited to, any Injury to myself or my child caused by myself or

C. MVP ACADEMY RULES

I agree to comply with all of the MVP ACADEMY rules and policies, in addition to stated and customary terms, conditions or requirements for participation in activities at MVP Academy (collectively, the “Rules” I agree that if any MVP ACADEMY personnel observes any unusual or significant concern in my or my child’s readiness for participation in the program or my or my child’s failure or unwillingness to comply with the Rules, MVP ACADEMY, at its sole discretion, may remove me or my child from participation at MVP ACADEMY. I hereby release and forever discharge MVP ACADEMY, from any and all claims, actions, damages, or liabilities (including attorney's fees and costs), arising from or related to any acts or failures to act by me or my child or by my or my child’s disregard of or failure to follow the Rules.

D. MEDIA COVERAGE & USE OF NAME, PICTURES, VIDEOS OR LIKENESS

I consent that I or my child may be photographed and/or videotaped while participating in activities at MVP ACADEMY. I understand that such photograph(s) and/or video(s) may appear in print media and/or live or replay telecast media coverage and consent to such use of my or my child’s name, photograph, video or likeness in such media. I further consent to MVP ACADEMY’s use of my or my child’s name, photograph, video or likeness being used for any and all advertising or promotional purposes, free of charge without any reservation or limitation.

E. ACCIDENTAL/MEDICAL AID AND PERSONAL LIABILITY INSURANCE

I have been apprised of the types of Activities conducted at MVP ACADEMY and have made a determination that I and/or my child is/are physically able to perform such Activities and that such Activities are commensurate with my or my child’s skill level.

I hereby certify that I and/or or my child have/has no known medical problems that would increase my or my child’s risk of illness or injury as a result of participation in any activity at MVP ACADEMY. I hereby declare that I and/or my child have health insurance coverage. I authorize MVP ACADEMY to seek medical assistance for me and/or my child in the event of a medical emergency. I accept full financial responsibility of any medical costs or expenses incurred as a result of my and/or my child’s participation in any activity at MVP ACADEMY. I and/or my child’s accident/medical insurance company is as follows:

I understand, acknowledge, and accept that this Release and Waiver of Liability is intended to be as broad and inclusive as permitted by the laws of the State of Hawaii. If any provision of this Release and Waiver of Liability shall be held to be invalid or unenforceable, such provisions hall be ineffective to the extent of such invalidity or unenforceability without invalidating the remaining provisions of this agreement.

This Release and Waiver of Liability shall be interpreted and construed in accordance with the laws of the State of Hawaii, without regard for conflict of law provisions. Any disputes arising out of or related to this agreement or my participation or involvement with MVP ACADEMY shall be brought in Fifth Circuit Court, State of Hawaii.
