  • 1.Fees
    (A) In consideration of $1210 (Main Aisle Stall) or $1135 (Pony Aisle Stall) per horse (at indoor) or $990 (Wheeler) per month paid by or in advance on the first (1st) day of each month. Stable agrees to board said horse beginning * . All boarders (winter only and year round) pay a $500 deposit to reserve their winter indoor stall. This will be applied to the last month's board at the indoor.

  • (B)  All boarders and any lessee's of year round boarders are required to take a weekly lesson.  Board includes one weekly group lesson.  Missed lessons may be rescheduled up to 60 days after the missed lesson.  It is the responsibility of the boarders to schedule makeup lessons with the stable.  

  • Board at the indoor facility is based on a commitment for the entire period of time Apple Tree Farm is renting the facility. You will be responsible for the boarding fee from * to .

    Boarding at Apple Tree Farm located at 49-2 Wheeler road is done on a month to month basis. Boarders must give 30 days notice from the beginning of the month in order to terminate boarding at the Wheeler Road Location.

    If owner chooses to send their horse to ATF South they are only responsible for the board at the indoor facility until the horse heads south. If owner chooses to go to ATF South for short periods of time, they will pay rough board at the indoor facility location to hold their stalls (unless their stall can be filled) and training board at ATF South.

  • Boarding fees are as follows: 

    Winter Boarding ONLY- No lessons- $950/month

    Board on Wheeler Road:  $990 with a $30 discount if paid by the 1st of the month. 

    Board at the Winston Road indoor facility:  $1210 (main aisle) $1135 (pony aisle) with a $30 discount if paid by the 1st of the month.  

    Horses traveling to South Carolina will be charged rough NH board (which is not a regular option)  and Training board in South Carolina for the duration of their stay.  Rough board is $400/month

    Training Board:  $1550

    Training Rides: $45

    Exercise Rides: $40

    Medical Fees:

    Syringed Meds Per Month- $35 for 1 or $45 for 2 per day

    Wrapping: $30/month

  • 2.  Right of Lien: 

    Stable has the right of lien as set forth in the law of this State of New Hampshire for the amount due board and late fees and additional agreed upon services; and shall have the right, without due process of law, to retain said horse until the indebtedness is satisfactorily paid in full.

  • 5.  Barn Rules: 

    Rules set forth by Stable are for everyone's safety and enjoyment.  Rules will be posted and must be followed. 

  • 6.  Exercise/Training

    Owners and/or lessee will be expressly responsible for all grooming, care, exercise, or training.  The Owner and/or lessee are the only riders allowed to exercise/train said horse on Apple Tree Farm grounds.  Additional training/exercise may be arranged through Apple Tree Farm staff.  Training rides will be billed at $45/ride and Exercise rides will be billed at $40/ride.

  • 7.  Shoeing/Deworming/Dental/Vet:

    Stable agrees to implement a shoeing/deworming/vaccination/dental program, consistent with recognized standards.  Owner is obligated to pay the expense of such services, including a reasonable stable charge.  Such bill shall be paid within fifteen (15) days from the date it is submitted to Owner by the vendor or within five (5) days from the date it is submitted by Stable.  Owner will be billed $15 when ATF staff has to hold horses for blacksmith or vet.  Worming charges will be added to the monthly bill as needed.   

  • 9.  Ownership

    Owner warrents that he/she owns the horse and there are no liens or encumbrances on the horse.

  • 10. Vaccinations and medical vendors  

    Owner will provide, prior to delivery, proof of negative Coggins test to Stable.  Further owner warrants that the horse has no known medical conditions, allergies, or contagious diseases at the time the horse enters the property.  The stable requires routine spring and fall vaccinations.  Stable will arrange for Stable vet to give vaccinations each spring and fall and will make arrangements for billing to Owner.  Boarders will be billed by Stable $15 for assisting vet.  Stable will also arrange for dentist 2x/year and for the stable farrier to do boarders horse's feet as needed.  Outside vets, dentists, and farriers are not allowed except for winter only boarders.  Stable also has routine saddle fitter, chiropractor, etc offered.  Outside vendors must be cleared through Stable owner. 

  • 11. Property Damage

    Owner agrees to pay for damage to stalls, or other property caused by Owner or Owner's horse(s), over and beyond normal wear and tear. 

  • 12.  Risk of Loss

    While the horse is boarded at Stable, Stable shall not be liable for any injury, sickness, death or theft suffered by the horse.  Owner fully understands that all risks are assumed by Owner.  Owner agrees to hold Stable harmless from any loss or injury to said horse(s).  All costs, no matter how catastrophic, connected with boarding or for any other reason for which the horse is on the premises of Stable, are to be borne by Owner. 

  • 13.  Hold Harmless/Defend/Indemnify

    Owner agrees to hold harmless, defend, and indemnify Stable and/or any of Stable's agents, contractors, employees for any claim or action resulting from any accident, injury, death, or property damage to any person, or property arising from any equine-related activity to the absolute fullest extent permitted under the laws of the State of New Hampshire and under the laws of the State of South Carolina.  

  • 14.  Termination/Removal of Horse

    At the Wheeler Road location either party may terminate this Agreement given thirty (30) days written notice to the other from the beginning of the month.  Owner understands that at the indoor facility the owner is responsible for board payment until the move back to the Wheeler road location.  In the event of "good cause", Stable may terminate this Agreement with 48 hours notice.  "Good cause" includes but is not limited to any breach of this Agreement, or failure to abide by Stable rules. 

  • If the horse is being taken off the property, Stable requests owner inform staff

     

    15.  Attorney's Fees/Costs: 

    In the event of a default, or in the event Stable must retain an attourney to enforce the terms of this Agreement, Stable shall have the right to recover attorney's fees and costs from Owner.

  • 16.  Successors/Assigns

    Owner cannot assign this agreement unless Stable agrees in writing.  The terms, conditions and covenants of this agreement shall be binding upon and inure to the benefit of each of the parties herto, their heirs, personal representatives, successors and assigns.  

  • 17.  Severabiltiy

    The unenforceability, invalidity, or illegality of any provision of this Agreement shall not render the other provisions unenforceable, invalid, or illegal. 

  • 18.  Governing Laws

    Any dispute concerning this agreement shall be resolved in accordance with the laws of the State of New Hampshire. 

  • 19.  Notices

    Whenever under this Agreement a provision is made for any demand, notice or declaration of any time, it shall be in writing and served either personally or send by U.S. mail, postage prepaid, address at the addresses as set forth below:

  • 20.  Incorporated of Prior/Concurrent Agreements

    This Agreement contains all Agreements of the parties with respect to any matter mentioned herin.  Neither prior nor concurrent Agreement or understanding pertaining to any such matter shall be effective.  This Agreement may be modified only in writing, and assigned by the parties in interest at the time of such modification.
