1. ADMISSION
A signed copy of these Terms and Conditions, a completed Child Information Record and a copy of your child’s birth certificate or passport need to be handed into the Nursery before your Child’s start date. If we have not received these documents, this will delay your child’s starting date.
2. ABSENCES
If your child is going to be absent, you agree to contact the Nursery so that the teaching staff can be advised. Unfortunately, absences cannot be refunded and 'make-up-sessions' are not offered. If your child has experienced sickness or diarrhea, the UKHSA requires that they remain away from Nursery for 48 hours after the last episode. If your child has symptoms of a respiratory infection, such as COVID-19, or they have a high temperature or do not feel well enough to attend Nursery, you agree to keep them off Nursery until they no longer have a high temperature (if they had one) or until they no longer feel unwell.
In order to maintain the health and safety of all the children, the Nursery reserves the right to refuse entry if a child appears unwell and to contact parents requesting that they collect their child should they become unwell whilst they are at Nursery.
3. SWAPPING SESSIONS
Unfortunately, as we have a statutory duty to maintain our child: teacher ratios, we cannot swap sessions or make-up attendance for any sessions missed.
4. SECURITY AND COLLECTIONS
You agree to arrange drop-off and collection of your child at the scheduled time. It is your responsibility to ensure that the Nursery staff is made aware of who will be collecting your child. No child will be allowed to leave the Nursery with anyone, known or not, without prior notification.
5. CLOSURES
If, due to unforeseen circumstances, such as adverse weather conditions, it is necessary to close the Nursery, parents will be informed via email. In these circumstances, parents will not be compensated for any fees paid during the closure. Closures due to national holidays or inset days will also not be compensated.
6. UNIFORM/CLOTHING
At the beginning of each academic year, or when your child joins us, a uniform (t-shirt and jumper) will be supplied to each child. The cost of this will be added to the relevant term's invoice.
Please ensure that all items of clothing and personal property are clearly labelled. The Nursery does not accept liability for any personal items lost or damaged.
7. FOOD AND DRINK
There is a strict no-nut policy at the Nursery. It is the responsibility of the parents to inform the nursery of any allergies, intolerances or dietary preferences. Each child will be offered a healthy snack during the course of the morning and water is freely available throughout the morning.
8. NAPPIES AND WIPES
Please ensure that any child in nappies comes to Nursery with nappies and wipes, in a small labelled bag.
9. SPARE CLOTHES
All children should bring a spare set of clothes in a small labelled bag every day.
10. COMPLAINTS
If you have any cause for complaint, please speak to a member of Nursery staff who will try to rectify the situation. If your concerns are not resolved then the matter should be put in writing and addressed to Julia Robinson, the Principal, at info@thebarnesvillagenursery.com who will endeavour to resolve any issues.
Should the matter not be resolved to your satisfaction, please contact Ofsted directly.
11. SAFEGUARDING
Children's welfare is our primary priority and we have a duty to protect children under the Children’s Act 2004. Our named Designated Safeguarding Lead is Julia Robinson. If any member of staff has cause to suspect a case of abuse or non-accidental injury we are duty-bound to inform LBRuT Children's Services.
Child protection issues are kept in the strictest confidence and are passed onto the duty social worker at the Children’s Assessment Team.
12. SAFETY
The overwhelming majority of Nursery staff has an up-to-date paediatric First Aid certificate and we check our equipment and environment for suitability and safety on a daily basis. If your child requires any medicine to be given to them whilst at Nursery, you will need to fill in a medication form and return it to the Nursery office.
In the event of an urgent medical incident, we reserve the right to administer first aid and/or call the emergency services. If necessary, a member of staff will escort your child to an Accident and Emergency department where any decisions about your child’s welfare will then be made by the medical staff at the hospital. In this event, you will be informed as soon as possible.
13. DEPOSIT
A deposit of £500 will be required prior to payment of the first term’s fees. This deposit is refundable at the end of the Child's time at The Village when a term’s notice is given and all other account balances are at nil.
14. SESSION CHANGES
Once your child’s sessions are confirmed, any alterations or cancellations will require a term’s notice, given in writing. For example, if your child is not returning in the autumn term, notice is to be given at the beginning of the summer term.
You will remain liable for fees during the notice period. Failure to give the correct notice will, unfortunately, mean that you forfeit your £500 deposit. A request to increase sessions will be considered immediately subject to availability.
15. PAYMENT OF FEES
Nursery fees must be paid before the first day of each term, in full. Or, in the event that your child joins us mid-way through a term, then fees must be paid no later than the published due date on the invoice.
We are happy to accept childcare vouchers for payment of fees (if you have registered for this scheme prior to March 1 2018 Please email the office at info@thebarnesvillagenursery.com and let us know which voucher company you will be using and the name of the parent and reference payments with your child’s name.
We are registered with the government’s tax-free childcare scheme which is the system to be used from October 2018 for new registrations. To set this up you must register on the following website:

NB: The Childcare Voucher scheme will continue for all those registered before September 2018 and there is no requirement to apply for the new scheme.
16. EARLY EDUCATION FUNDING
All 3- and 4-year-olds in England are entitled to 15 hours of free nursery education, which is currently paid at less than £5.50 per hour. In order for The Barnes Village Nursery to participate in this scheme, and still remain sustainable, we must charge for ‘additional services’, which include activities and additions listed with our published Term Fees. Please ask for a copy of these from the Office if one has not been provided to you. An itemised breakdown of how these services are charged can also be obtained from the Office. By signing your agreement to these terms and conditions you indicate your understanding and agreement that your child will participate in and benefit from these additional services and you, therefore, agree to pay for these in line with our published Term Fees list. Should you require that The Barnes Village Nursery adheres to the government's flagship policy of 15 hours of free nursery for each 3- and 4-year old and not wish to avail yourself of the additional services and benefits that the additional fees cover, you also understand that we will have to withdraw from this funding scheme altogether and not offer it to your child or to any other child on our register.
17. UNPAID FEES
All unpaid fees will be recovered through a debt recovery process. We reserve the right to charge an administration fee of £10 per correspondence due to late payment of fees. Your child may be refused attendance until the outstanding balance is paid and, at the discretion of the School Business Leader, the Nursery place may be forfeited and passed to the next child on the waiting list.
18. INSURANCE
All children attending the Nursery are covered by The Barnes Village Nursery’s public liability insurance.
19. DATA PROTECTION AND CONFIDENTIALITY
We are committed to ensuring that any personal data we hold about you and your child is protected in accordance with data protection laws and used in line with your expectations. We record and share information about children and their families in line with the six principles of the General Data Protection Regulations Act (GDPR) (2018). We collect personal data about you and your child to provide care and learning that is tailored to meet your child’s individual needs. One of the uses for this information is the creation of your child’s personal Learning Journal and you agree to this information (as well as your email address) being shared on the secure Learning Journal platform. We also collect information in order to verify your eligibility for funded childcare as applicable. Where applicable we will obtain child protection plans from social care and health care plans from health professionals. We will also ask for information about who has parental responsibility for your child and any court orders pertaining to your child. Personal details that we collect about you include your name, home address, phone numbers, emergency contact details, and family details. This information will be collected from you directly in the Child Information Record. Information about your child (e.g. date of birth, address, medical and development needs, etc.) and contact details will be stored confidentially on the Nursery’s information management system. Contact details that the Nursery has will be used in the case of medical emergencies, late collection incidents and to make contact with you should we have any concerns. They will also be used to distribute information to you pertaining to the Nursery and its activities. All information given is treated in strictest confidence and is kept securely. You have the right to withdraw your consent for us to hold your data at any time and you have the right to lodge a complaint with the Information Commissioner’s Office. We will keep the information we have gathered for up to 6 months after your child has left the Nursery except where we are statutorily obliged to keep information regarding special educational needs or safeguarding issues. Other than for circulation of the ‘class list’ to other parents (this list includes the first and last name of each child, the name of the parent, the contact number and email address) and for the creation and maintenance of your child's Learning Journal, no information about you or your child will be shared without your prior consent, except in child protection cases. 20. EXTERNAL PROFESSIONALS
From time to time, the Local Authority will send external professionals to the Nursery or we may ourselves be undergoing Continued Professional Development of staff and may invite an expert in e.g. Speech and Language into the Nursery to assist us. In such circumstances, your child may be observed by Practitioner Professionals visiting the Nursery under the supervision of a member of staff. No information will be shared or interventions implemented without further express consent by you.
21. OUTINGS
As we have a wonderful location here at the nursery, we have the unique opportunity to take the children for walks by the pond and in the surrounding area. Your consent for your child to participate in these outings will not be sought on a case by case basis, but rather implied by your agreement to these terms and conditions.
22. CONTRACTUAL AGREEMENT
The offer of this place and its acceptance by you gives rise to a legally binding contract based on these terms and conditions. These terms and conditions are governed exclusively by English Law.
We reserve the right to update or amend these terms and conditions at any time.
