Nova Dealers Services Agreement
Summary:
- A 25% deposit is required to secure the Event date.
- The remaining 75% payment must be paid anytime prior to the Event finish time.
- If booking is cancelled 10 days prior to the Event, the 25% deposit will be used as credit.
- If booking is cancelled within 10 days of the Event, the 25% deposit will be forfeited.

CLIENT
and
NOVA DEALERS
(“Parties”)
Background
The Client will be holding an event on the event date specified on the Invoice (the Event).
Nova Dealers has agreed to provide services listed in the Invoice (the Services) for the Event.
Nova Dealers will provide the Client with a detailed Proposal (the Proposal).
The Client enters into this Services Agreement and agrees and accepts the terms and conditions on the date the booking was made (Invoice Date) with Nova Dealers.
Nova Dealers Provision of Services
2.1 Nova Dealers is responsible for the Services listed in the Invoice for the Event and in accordance with the terms and conditions specified in this Services Agreement.
2.2 Any services in addition to those described in the Invoice must be agreed to between the parties in writing prior to the Event.
Payment
3.1 The Client must ensure all fees in the Invoice are paid for prior to the Event finish time.
3.2 In order to secure the Event Date, the Client must pay a 25% deposit of the total invoice amount with 3 working day of accepting the Proposal. Should the Client fail to pay the deposit within this timeframe, Nova Dealers reserves the right to book another Client on the Event Date with no notice to the Client.
3.3 The Client is liable for all payment.
3.4 Acceptable forms of payment include Cash, EFT and/or Credit Card.
3.5 Failure to make full payment of the total Invoice amount after 24 hours of the Event finish time will incur a 5% late fee of the total invoice for every 24 hours until full payment is made.
Discounts
4.1 If a discount was provided in the Invoice, Nova Dealers reserves the right to adjust the discount if the Client makes any deductions/changes to the Services.
Damage, Theft, Inability to access equipment
5.1 Nova Dealers may request credit card details or a bond to cover for any damages, theft or inability to access equipment to be picked up at the agreed time.
5.2 By making a booking, the Client authorises for the credit card to be charged or further payments to be made, in the case that any equipment is lost, stolen, damaged or is unable to be picked up.
No Sale or Acknowledgement of Ownership
6.1 This is a Services Agreement only and does not constitute or give rise to any sale of the equipment provided to the Client, any hire purchase agreement or arrangement with the Client or any leasing agreement that contains the option to purchase equipment provided as part of Nova Dealers’ services.
6.2 The Client acknowledges that Nova Dealers is the sole exclusive owner of the equipment and the equipment is provided as part of the Services.
Cancellation
7.1 Cancelled bookings up to the date of the Event will mean the Client will not be entitled to a refund of the deposit (i.e. 25% of the total invoice amount). If the cancelled booking is at least 10 days prior to the Event, the 25% deposit will be used as credit.
7.2 If items are removed from an order or quantities reduced, a cancellation fee will also apply to these items at 50% for items cancelled outside of a 48 hour period before the Event and 100% inside a 48 hour period of the Event. By booking the Event, the Client has given permission for Nova Dealers to retain monies or charge the card for any cancelled bookings.
7.3 If the Client fails to pay the fees set out in the Invoice in full, 24 hours before the Event, Nova Dealers reserves the right not to provide the Services listed in the Invoice and retain the 50% deposit.
Promotion
8.1 Unless otherwise agreed to in writing, the Client authorises Nova Dealers to utilise the Client’s logo and associated trademarks as well as any media, photos or footage from the Event for the purposes of promoting Nova Dealers’ services.
Variation to Services Agreement
9.1 This Services Agreement will only be varied in writing and signed between the Parties.
Applicable Law
10.1 This Services Agreement and the interpretation of its terms shall be governed by and construed in accordance with the laws of the State of New South Wales.
