  • Definitions to Determine Capacity

    The fire code occupany is based on square feet per person and how the space is set up to accomodate people. For a space with tables and chairs (the typical restaurant set up) it is 15 sq. ft. per person. 

    A room is defined as having four walls and at least one exit/entrance.

    A wall is defined as any material type that can reasonably restrict aerosols from passing through may be considered a "wall." For example, a loose, mesh mosquito net is not finely-knit enough to reduce airflow and will not stop any particles or aerosols. A fabric sheet curtain and a tarp or plastic barrier are considered a wall because the material would prevent aerosols from passing through.

    An extra-large venue is defined as greater than 7,200 square feet. The 7,200 sq. ft is for the room where the dining, event or gathering will occur.

  • In Level Green: Protect Our Neighbors, restaurants may operate at 50% of the posted occupancy limit indoors not to exceed 500 people excluding staff, whichever is less, per room.

    Restaurants may also use any existing, licensed outdoor space for in-person dining with the same group limit of 10 and minimum spacing of 6 feet apart.

     

  • In Level Blue: Caution, restaurants may operate at 50% of the posted occupancy limit indoors not to exceed 175 people excluding staff, whichever is less, per room.

    Restaurants may also use any existing, licensed outdoor space for in-person dining with the same group limit of 10 and minimum spacing of 6 feet apart.

    Alcohol sales, including take out alcohol orders MUST conclude by 12 a.m.

  • In Level Yellow: Concern, restaurants may operate at 50% of the posted occupancy limit indoors not to exceed 50 people, excluding staff, whichever is less, per room.

    Restaurants may also use any existing, licensed outdoor space for in-person dining with the same group limit of 10 and minimum spacing of 6 feet apart.


    Extra large establishments may expand to no more than 150 patrons indoors per room, excluding staff, within their usable space calculated using the Distancing Space Calculator.

    Alcohol sales, including take out alcohol orders MUST conclude by 11 p.m.

  • In Level Orange: High Risk, restaurants may operate at 25% of the posted occupancy limit indoors not to exceed 50 people, excluding staff, whichever is less, per room.

    Restaurants may also use any existing, licensed outdoor space for in-person dining with a group limit of 10 and minimum spacing of 6 feet apart.

    Alcohol sales, including take out alcohol orders MUST conclude by 10:00 p.m.

  • In Level Red: Severe Risk, restaurants are closed for in-person indoor dining but may offer curbside, takeout and delivery services.

    Restaurants may also use any existing, licensed outdoor space for in-person outdoor dining with tables limited to members of the same household and minimum spacing of 6 feet apart.

  • In Level Purple: Extreme Risk, restaurants are closed for in-person indoor and outdoor dining but may offer curbside, takeout and delivery services.

  • Capacity Restrictions

    Please address the capacity restrictions for your retail establishment under each State of Colorado COVID-19 Dial Level.
  • How to Determine Capacity 

    Calculating the occupancy numbers for a retail space is based on gross square footage (not including fixtures or furniture) and uses 60 sq. ft. per person. The 60 sq. ft. per person allows for fixtures to fill a portion of the space, still leaving enough room for people. 

    If the fire code occupancy is not known, determine the square footage of the space and then either use 120 sq. ft. (50%) or 240 sq. ft. (25%) per person based on the "normal" 60 sq. ft. per person. 

    Example: 

    Retail space = 1,100 sq. ft. 

    "Normal Capacity" based on 60 sq. ft. per person = 18

    50% capacity = 9 people

    25% capacity = 5 people

  • In Level Green:Protect Our Neighbors, Level Blue and Level Yellow retail may operate at 50% of the posted occupancy limit.

  • In Level Orange: High Risk and Level Red: Severe Risk, retail may operate at 50% of the posted occupancy limit with increased pick up, and delivery. Dedicated senior and at-risk hours are encouraged.

  • In Level Purple: Extreme Risk, non-critical retail is closed for in-person work or services but may operate and provide curbside, pick up or delivery services,may provide services online, and may continue to carry out Minimum Basic Operations. Critical retail is strongly encouraged to take extraordinary measures to provide enhanced curbside, pick up or delivery services and minimize in-person services to the greatest extent possible.

    Critical Businesses include any for profit or non-profit, regardless of its corporate structure, engaged primarily in any of the commercial, manufacturing, or service activities listed in Appendix A of the State of Colorado's Public Health Order. Critical Government Functions include state and local government functions such as public health agencies, police stations, emergency response, hospitals, public utility plant facilities, public transportation and all functions as defined in Section IV. - D of the State of Colorado's Public Health Order.
  • Critical Businesses and Government Functions must comply with the guidance and directives for maintaining a clean and safe work environment issued by
    the Colorado Department of Public Health and Environment (CDPHE) and any applicable local health department. Critical Businesses must comply with Distancing Requirements and all Public Health Order's currently in effect to the greatest extent possible and will be held accountable for doing so.

    Organized recreational youth or adult league sports are not authorized for indoor settings. Virtual services may be provided, or outdoor recreational sports in groups of 10 people or fewer may occur, maintaining 6 feet Distancing Requirements between non-household contacts.

  • In Level Red: Severe Risk, Gyms, recreation centers and indoor pools may operate at 10% capacity, not to exceed 10 people, whichever is less, excluding staff per room indoors. Gyms and recreation centers may operate with 10 or fewer individuals outdoors. Reservations are required for all indoor and outdoor services. 

    Outdoor recreational activities in groups of 10 people or fewer may occur, maintaining 6 feet Distancing Requirements between non-household contacts.

    Organized recreational youth or adult league sports are not authorized for indoor settings. Virtual services may be provided, or outdoor recreational sports in groups of 10 people or fewer may occur, maintaining 6 feet Distancing Requirements between non-household contacts.

  • In Level Purple: Extreme Risk, Gyms, recreation centers and indoor pools are closed for indoor activities, except that fitness centers and nonessential personal services included in residential facilities, such as hotels, apartment or condominium complexes or similar housing arrangements, that are limited to use only by hotel guests or residents of the housing who are following social distancing requirements of at least 6 feet between individuals, and the hotel or property managers are performing frequent environmental cleaning may operate. Gyms and recreation centers may operate with 10 or fewer individuals outdoors.

    Outdoor recreational activities in groups of 10 people or fewer may occur, maintaining 6 feet Distancing Requirements between non-household contacts.
