THIS RELEASE AND WAIVER OF LIABILITY (THIS "WAIVER") IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS. PLEASE CAREFULLY READ THIS WAIVER OR HAVE IT READ TO YOU.  BY SIGNING, YOU ACKNOWLEDGE THAT YOU FULLY UNDERSTAND THIS WAIVER, HAD A SUFFICIENT AMOUNT OF TIME TO CONSIDER THE TERMS OF THIS WAIVER AND ASK QUESTIONS, AND ARE FREELY AND VOLUNTARILY ENTERING INTO THIS WAIVER.

This Waiver is executed by the undersigned Learner in favor of Tacoma Area Literacy Council, a Washington nonprofit corporation, its present and future directors, officers, employees, volunteers, and agents (collectively, "TALC").  Learner hereby freely, voluntarily, and without duress executes this Waiver under the following terms:

1. Assumption of Risk: Learner acknowledges that he/she is a voluntary and willing participant in TALC's literacy program, and fully understands that there may be risks inherent in or associated with Learner's participation in such program. Learner hereby assumes any and all risk of physical or emotional injury, death, and damage to his or her personal property that may occur in connection with TALC's program.

2. Release of Liability:  In consideration of Learner's participation in the activities organized and provided by TALC, Learner hereby relases and forever discharges TALC from any and all liability and agrees to indemnify and hold TALC harmless, for any physical or emotional injury, death, or damage to personal property which may result from or be associated with Learner's participation in TALC's programs, whether caused by negligence of TALC or any TALC tutor.

3. Medical Treatment:  Learner hereby releases and forever discharges TALC from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with Learner's participation in TALC's literacy program.

4. Photo & Video Release: Learner understands that TALC, TALC tutors, and others occasionally take photographs and make video or audio recordings during TALC programming for educational and promotional purposes. TALC will never sell such photographs or video or audio recordings of Learner to any unaffiliated third parties for their marketing purposes. By selecting 'Yes', Learner consents and authorizes TALC to use, reuse and/or publish photographs and/or video or audio recordings taken while Learner participates in TALC's programs. Learner acknowledges and agrees that these photographs and/or videos can be used without limitation, reservation, or compensation. Learner may select 'No' to decline this photograph and video release.

5.  Rules & Policies:  Learner agrees to abide by any program and/or safety rules, policies, procedures, and guidelines set forth by TALC, including but not limited to those set forth on TALC's Learner/Tutor Agreement, a copy of which is available at https://tacomaliteracy.org/ and is incorporated herein by reference.

6. Miscellaneous:  Learner expressly agrees that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Washington, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of Washington.  Learner agrees that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Waiver which shall continue to be enforceable.

7. Acknowledgement of Understanding:  Learner acknowledges and agrees that they have read this Waiver, fully understand its terms and agree that they are freely and voluntarily signing this Waiver.  Learner further understands and agrees that Learner: (a) is consenting to participate in TALC's literacy program; (b) understands that all risks in any way relating to the Learner's participation in TALC's literacy program are expressly assumed; (c) is giving up rights, including the right to compensation for injury resulting from the Learner's participation in TALC's literacy program; and (d) is providing a complete and unconditional advance waiver and release of all liability to the greatest extent allowed by law.
