This agreement is between Max Designs Photography, hereinafter referred to as the "Photographer", and the signers of this portrait Photography agreement, hereinafter referred to as the "Clients", collectively referred to as the "Parties", with the wedding session detailed below. The package list and price list and/or documents attached to this contract are integral parts of this document. The contract terms, agreement, and price list are the only legally binding documents between the Parties.
Agreement Overview
This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to notify the Photographer. If the Parties want to waive one part of this agreement that does not mean that any other part is also waived. All contracts must be signed within 72 hours of receipt and the retainer must be paid to book your date.
Change of Date or Venue
The Photographer must be notified immediately of any changes in schedule or location, at least 48 hours prior to the scheduled date of event. Notification of any changes can be made by contacting the Photographer. If an email is sent, a confirmation of receipt must be sent back by the Photographer in writing or via email. It is the client’s responsibility to confirm all arrangements at least 48 hours prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify the Photographer. In the event that the wedding is rescheduled, and studio does not have the date available, the client acknowledges that the deposit/retainer is non-refundable. It will be considered as liquidated damages to the Photographer(s). If the rescheduled date is available, client may transfer their wedding package to that date. Client acknowledges there may be additional fees for the same package when moving the date from one.
Non-Refundable Retainer Fee
A non-refundable retainer fee is required to book your wedding. This is a non-refundable retainer fee. It shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. No date is reserved until a retainer fee is received. The retainer fee shall be applied towards the total cost of the service to be rendered. The Retainer Fee is 50% of the amount of the package chosen, with the balance of the amount agreed upon due 14 days before the day of the wedding. The balance of the complete package price must be paid before the start of services being rendered. If final payment is not received, the Photographer will not be expected to attend said event.
Travel
Package chosen covers all weddings travel expenses such as parking, tolls, or destination fees.
Cancellation
There shall be no refund of retainer after the signing of the Contract and the reservation of the Photography date. If the event is cancelled and or communication of venue change is not given to Photographer within 45 days of the date, the client shall pay the balance of the contract due to the high probability that the Photographer will not be able to further book that date. Once a balance is paid, it is non-refundable. Any other arrangements shall be discussed between the Clients and the Photographer. All arrangements will be put in writing.
COOPERATION
The bride and groom and the Photographer(s) consent to happily cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. We recommend that the wedding Photographer(s) be provided with a helper (usually the best man/ woman) who will point out key individuals to be captured. The Photographer(s) may also require the assistance of the best man/woman in organizing family groups. The bride and groom also agree to give the Photographer(s) enough warning of key events at the wedding to give the Photographer(s) time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at wedding like having their Photo taken. In such cases the wedding Photographer(s) will use his discretion but cannot be held responsible for a lack of Photos of these people.
HOUSE RULES
Note the Photographer(s) are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash Photography is allowed, and others will insist that the Photographer(s) shoot from a specific location. In such circumstances, the bride and groom agree to accept the technical limitations that may be imposed on the equipment used or subjects are too far for the flash to reach, high ISO settings (film’s sensitivity to light) must be used; creating a pixilated or grainy effect in the Photographs. We advise the bride and groom to make themselves aware of the rules of the venue concerned and if necessary, negotiate with the personnel concerned. Client is also responsible for arranging the location access and any permits/passes related to doing so.
THE SCHEDULE
Our shooting schedule, style of working and experience are designed to achieve a great set of wedding Videos for the bride and groom, accomplished with good humor and enjoyed by all concerned. Both the bride and groom and the Photographer(s) therefore agree that punctuality and cheerful cooperation are essential to producing outstanding Photographic results. In cases where the wedding does not run on time (for example, extreme lateness by the bride arriving to the church) we cannot guarantee to take our normal set of Videos although in such circumstances we will do our absolute best to compensate. If the client decides to add on additional time, payment amount is due in full on the date of time added.
Failure to Perform
The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested Photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or location restrictions. The Photographer is not responsible for lost photos opportunities due to other cameras or flashes, the lateness of the clients or other principles. It is acknowledged that any Video requests submitted to the Photographer will be used for organizational purposes only and in no way is the Photographer required to fulfill these. The Photographer is not responsible if key individuals fail to appear or cooperate during Photography sessions or for missed images due to details not revealed to the Photographer. Clients are responsible for all location fees and permits.
Copyright
English Copyright Law states that the copyright of Photographs remains with the Photographer(s). The Photographer(s) grant the Bride and Groom permission to make copies of the Images under the following conditions. The Image taken by the Photographer(s) are for personal use by the bride and groom and their friends and relatives. Selling, Publication or any Commercial use of the Photographs is not allowed without prior written permission from the Photographer(s).
Exclusive Photographer
Client agrees that Max Designs is the exclusive Photographer(s) at this event and other Photographers, family, friends or amateurs may be asked to stop Photographing/recording if Max Designs finds it intrusive. Max Designs is not responsible for missed shots due to guest’s flashes going off, or from them blocking the events taking place.
Event Food Service
The bride and groom agree to provide a meal for the Photographer(s) where the length of attendance exceeds five hours. During this time, the Photographer(s) will not be taking photos for approximately 30-45 minutes. If meals are not provided for the Photographer(s) they shall take a break and leave for 1 hour and 30 min to allows time to get food and rest.
Garments
The Photographer cannot be held responsible for damage to garments due to environmental events. Client is responsible to arrange personal assistance for garments.
Creative License/Editing
Images are edited at the Photographer’s discretion, and the Client will receive the amount of photos agreed upon per the package paid for along with any additional Videos purchased. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the Photographer’s artistic standards. Editing will typically take 6-8 weeks to complete.
Unforeseeable Circumstances
If the Photographer cannot perform this Agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism, COVID-19 or other causes beyond the control of the parties, then the Photographer shall return any money paid by the Client, except for the retainer and any other expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that Photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer.
Image Printing
Max Designs Photography cannot guarantee images printed from any establishment and cannot be held responsible for print quality if images are printed by any source other than its approved vendors.
Limit of Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release Photographer from any claims against their person or their business. In the unlikely event that the Photographer(s) are injured, become too ill, or has an emergency that prevents them from Photographing the event, Max Designs Photography will contact the CLIENT as soon as possible, to arrange another suitable date and time, and if necessary (if an event), will try to find a replacement Photographer. If this does not suit the CLIENT, the CLIENTS agree that responsibility and liability of Max Designs Photography to the CLIENTS is limited to the return of all payments received for the event. Max Designs Photography takes the upmost care with respect to exposure, storage, and processing the Video/images, but cannot and does not, guarantee that Video/images of the event will not be lost, stolen, or destroyed for reasons within or beyond the Photographer's control. CLIENT agrees that Max Designs Photography or the Photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event.
COMPLETION SCHEDULE
Due to the nature of these sessions/events, completion and product delivery time may vary. Wedding sneak peeks will be available by request through social media within 7 days of the wedding. Full gallery will go live within 6-8 weeks of the wedding date. Videos will be delivered between 8-10 weeks of the wedding date via google drive link.
