    Terms & Conditions.

    1. The Directory is a free online listing with the intention to “help support school community businesses” by having an easy touse, online directory available for families to use to find suitable businesses if and when the need arises.
    2. It is an initiative by the NSW Department of Education - Pennant Hills Public School's Parents and Community (“PHPS P&C”) however no liability, warranties or guarantees will be incurred by the PHPS P&C for inclusion in this Directory.
    3. The information contained in the Directory is provided in good faith to the school community and the PHPS P&C and Schoolreserves its right to refuse, amend and/or withdraw/ remove any listing, at any time, at the sole discretion of the PHPS P&CCommittee and ultimate discretion resting with the current School Principal.
    4. Businesses must submit this completed application and their Business listing entry (the “advertisement”) as a ONE page document only, with all information being true and correct, including its registered trading name and ABN clearly visible.
    5. By listing in the PHPS P&C Directory you also agree to the FlipHTML5 Terms of Service as the platform for the listing. Oncecompiled together, all intellectual property relating to this Directory remains the property of the PHPS P&C and cannot be sold/ rented or traded or used for any other purposes other than an information source for the school community & families.
    6. The directory will be indexed and sorted into “Business Categories” eg Accountants, Builders, Photographers, etc and all businesses featured within the set category will appear in alphabetical listing order - by the registered business/ company/trading name, within that category. “Business categories” are to be determined by the PHPS P&C on a “needs basis” and will be dependent on the types and number of applications received. While every effort will be made to keep your listing in a setcategory, there might be a need for a “miscellaneous” category and/or further information might be sought by the PHPS P&C to help with such categorisation. In addition, the PHPS P&C and the School has the right to refuse any category or businesslisting that it does not feel acceptable for inclusion in a family friendly, school directory or contrary to law.
    7. Appearing in the Directory does not mean any acceptance, endorsement, promotion or being a preferred service provider bythe PHPS P&C and/or the School. The express purpose is to collate information (provided by the Business owner) fairly, to the community.
    8. This is an agreement by the business owner that all information provided is true and correct and further warrants and guarantees that all insurances and necessary licences (where needed eg Builders/ Plumbers etc) are current and in place.
    9. Every business who lists their business in the Directory agrees to indemnify Pennant Hills Public School and the PHPS P&Cagainst any claims for liability or damage for example incurred by any statements and/or actions the member may make ortake that result in liability for the above mentioned entity.
    10. To be eligible to be featured as a business in this Directory, the business must be owned by a parent and/or guardian of astudent currently enrolled at Pennant Hills Public School in the year that the edition is released. Once the student (and family) leaves the school, the PHPS P&C can immediately withdraw such listing. Discretion will be applied to any studentleaving at the end of Term 4 for example a student leaving at the end of Year 6, the listing can remain in the Directory untilthe new school year edition is released (this is subject to change).
    11. All Policies and guidelines are subject to change. All proposed policy and guideline changes will need to be reviewed first by the Executive Committee of the P&C Association at Pennant Hills Public School.
    12. Businesses appearing in the Directory must not use the School and/or PHPS P &C Intellectual Property (e.g. logos, trade marks, names, slogans, copyrighted materials, etc.) to manufacture, distribute, sell, market, or promote any product orservice, or otherwise use these without obtaining the prior written consent of the Pennant Hills P&C Executive Committee orcurrent Principal of Pennant Hills Public School.
    13. If a Business makes any offer or special within the Business Listing to the school community, the Business warrants andguarantees that they are willing to honour that offer or special for the duration of the School Directory listing until at leastthe next edition is released.
    14. Business Owners, Parents and/or their business entities agree not to take any action or make any claim against any memberor the P and C Association at Pennant Hills Public School for any matter contained in the Directory.
    15. Privacy policy – Commercial information is stored in the PHPS P&C directory Google Drive with limited access is granted tothe P&C Executive team and Directory team only. The listing, once published online, is publicly available information but the Application document including student details and other information is kept on a private Google Drive.
    16. All advertisements must be correct, accurate and appropriate for the intended audience.
    17. The Business Owner must take full responsibility for their own content, website and any goods and services you may provide.
    18. Limitation of liability
      1. To the extent permitted by law, under these terms and otherwise in connection with your advertisement, we exclude liability for all indirect, consequential or special losses or damages including loss of profits howsoever arising.
      2. We will not be liable to you or any other person for any loss of whatever kind suffered as a result of an advertisement, or the removal of an advertisement.
      3. If a condition or warranty implied by law is prohibited from being excluded, that condition or warranty applies. To the extent permitted by law, our liability for any breach of an implied term is limited to the resupply of the services.
