Liability Release Waiver & On-Camera Participation:*

Liability Release: With full knowledge of the risks involved, I hereby release, waive, discharge the Organization listed on this form, its board, staff, independent contractors, affiliates, employees, representatives, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related & non-related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm. I am fully and personally responsible for my own safety and actions while and during my participation with Strut Don't Stress Inc. and I recognize that I may be in any case be at physical risk. I will not hold Strut Don't Stress Inc., its affiliates, &/or Melissa "Mocha" McKenzie responsible for any injuries or risks. I certify that I have no physical, emotional or mental injury, illness, disability, condition or limitation, that prevents me from participating in or that could interfere with my safety during any of the exercise activities. I agree to indemnify, defend, and hold harmless this Organization (defined on this form), Strut Don't Stress Inc. &/or Melissa "Mocha" McKenzie, from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related & or non-related to COVID-19, each of their teachers, instructors, staff members, owner(s), partners, contractors, and facilities (collectively referred to on this form as: “Strut Don't Stress Inc.”) from any liability, cause of action, claims or demands now and in the future. I also hereby agree to not hold any of Strut Don't Stress Inc. liable for any injury, damages or losses in connection with my participation in Strut Don’t Stress Inc. Further, I agree to indemnify, and defend Strut Don't Stress Inc. from and against any and all demands, claims, and damages to persons or property, losses and liabilities, including reasonable attorney’s fees, arising out of or caused by my negligence or willful misconduct. I understand and accept that signing up for a class, event, or program through Strut Don’t Stress does NOT make Melissa “Mocha” McKenzie my mentor. On-Camera Participant Release: By signing this form, I acknowledge that I may be photographed, seen and/or recorded on camera and give permission & full rights media ownership to Strut Don’t Stress Inc. and/or Melissa “Mocha” McKenzie, its owners, staff, affiliates, agents, volunteers, assistants, guests, faculty, associates, and/or students to be expressed & released in such unedited or edited photography &/or videography media content at Strut Don’t Stress location(s) not limited to address: 3301 E. Main St. Ventura, CA #2155. I hereby release and discharge this Organization, Strut Don't Stress Inc. & Melissa "Mocha" McKenzie from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy. Strut Don’t Stress Inc. and/or Melissa “Mocha” McKenzie’s classes, workshops, rehearsals, occurrences, performances, & any events are filmed and photographically documented on a regular basis for & not limited to: branding, social media, personal record keeping, and/or editing purposes. There is a possibility that you may be recorded on camera. I fully understand and agree that any media, photos, or videos taken of Melissa “Mocha” McKenzie’s classes, choreography, creative direction, &/or events can NOT be used to promote dance events not affiliated with Strut Don’t Stress Inc. without Melissa “Mocha” McKenzie’s written consent. I hereby give to Melissa "Mocha" McKenzie / Strut Don't Stress Inc. as well as the Organizations affiliates the absolute and irrevocable right and permission with respect to the photograph(s) & video(s) taken of myself and/or my minor child in which you may be included with others: to copyright the same or different in the organizer's/photographer’s name or any other name); to use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs/recordings, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising, social media, internet, print, trade, and anything else. Lost & Found: I fully understand and accept any loss or stolen items/belongings at Strut Don't Stress Inc. are not the Organization's or location's responsibility and will not be replaced, compensated, reimbursed, &/or held accountable in any way by Strut Don't Stress Inc., its affiliates, &/or Melissa "Mocha" McKenzie. Music & Form of Expression: I fully understand and accept that explicit &/or ‘mature’ music lyrics possibly be used in events &/or occurrences held by/at Strut Don't Stress Inc. I grant full permission to use any photo/video/media capturing myself with or without the music involved. I fully understand and accept there might be explicit &/or mature choreography, physical movement, dance, steps, &/or dress code at/by this Organization, Strut Don't Stress &/or its affiliates. I may be a witness to hearing, participating &/or in seeing mature music &/or acts of freedom of expression not limited to an individual's: clothing, appearance, artistry, at this location &/or held by this Organization. I HEREBY WAIVE, RELEASE, AND DISCHARGE the Organization, Strut Don't Stress Inc., Melissa "Mocha" McKenzie and all its affiliates, divisions thereof of any and all liability and responsibility for: injuries, sickness (physical, mental, &/or emotional), pandemics, accidents, natural disasters, etc. during participation in and/or instruction of classes, rehearsals, lessons, performances, events, or any activity I may participate at & not limited to this location. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this waiver, release and registration form from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
By signing below I acknowledge that I have read this entire form including Liability Release & On-Camera Participant; that I am at least eighteen (18) years old and fully competent to give my consent; that I have been sufficiently informed of the risks involved and give my voluntary consent in signing it as my own free act and deed; that I give my voluntary consent in signing this document as my own free act and deed with full intention to be bound by the same.

I understand Melissa "Mocha" McKenzie &/or Strut Don't Stress Inc. &/or affiliates, can refuse the right of service to anyone at anytime for any reason. I understand & accept by signing this form that all sales made to Strut Don't Stress Inc. and / or Melissa "Mocha" McKenzie are final & non-refundable. Class credit requests due to client cancellation(s) are not gaurenteed. Any participants, clients, observers, guests, parties, individuals who refuse to abide by or respect the rules of the establishment can lose permanent access & involvment to this establishment, orginization, &/or location with or without warning.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
