A.  Newborn Session Agreement

• Either a traditional or lifestyle newborn session in the client’s home.
• Session fees include time & talent of photographer, travel to/from location of the shoot, professional editing and processing of 30-50 (or more) photographs that are shared in an online, password protected gallery.  
• These images are available for viewing in a private, password-protected proofing gallery for up to one (1) week.   
• Prints/digital files/USB Flash Drives are not included in this session fee but can be purchased separately.  See package offerings below.    
• Prices are subject to change, but a paid session fee & signed contract guarantee your pricing.
• This contract between Lilac Blossom Photography and client shall not become effective until it is signed and the newborn session has been paid. At the time the contract takes effect, Lilac Blossom Photography shall reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. For this reason, in the event that the client cancels the contract for any reason, all monies paid shall be retained by Lilac Blossom Photography in order to offset its loss of business.
• The non-refundable newborn session fee is $300. 

B. Package Options

Lilac Blossom Photography offers two types of newborn sessions: Traditional and Lifestyle.  Please read through carefully, as you'll need to select one or the other for your session. 

 

1. TRADITIONAL NEWBORN DIGITAL PACKAGES:

Traditional newborn sessions take place in the first 7-10 days after birth. Sessions generally last 3-4 hours in duration and are done in the comfort of your home. Sessions will include 2-3 blankets, one prop and a variety of poses will be performed, depending on the tolerance of the baby.  All the props, backdrops, headbands/bows, hats, etc. are included.  

• LILAC PACKAGE PRICING:  Custom designed USB Flash Drive with 25 professionally edited, high resolution digital files of your choice (chosen by the client)…$1400 +tax and 10% off print products
• BLOSSOM PACKAGE PRICING:  Custom designed USB Flash Drive with ALL photos in the gallery of professionally edited, high resolution files (30-50 images)…$1800 +tax and 25% off print products 

 

2. LIFESTYLE NEWBORN DIGITAL PACKAGES:

Lifestyle newborn sessions take place in the first 1-4 weeks after birth. Sessions generally last 1-2 hours in duration and are done in the comfort of your home. These sessions document your life as a new, growing family and are perfect for families with young children.  There are no traditional poses or props used, but light posing on furniture is included.

• LIFESTYLE NEWBORN SESSION PRICING: Custom designed USB Flash Drive with 35 professionally edited, high resolution digital files of your choice (chosen by the client)…$1000 +tax 
• LIFESTYLE NEWBORN SESSION UPGRADE: Custom designed USB Flash Drive with ALL photos in the gallery of professionally edited, high resolution files (30-50 images)…$1400 +tax and 25% off print products 

(*Note: The $300 session fee is not in addition to the above packages, but deducted and the remaining balance is due at the time of the session.) 

A LA CARTE   May be purchased in addition to the above packages.  A minimum of $500 must be met if ordering without the above packages. NYS Sales tax added to each item purchased. 

• A la Carte digital files are available at the cost of $30 per file.
• A la Carte prints, canvases and books:

4x6": $25 +tax

5x7": $40 +tax

8x10": $60 +tax

11x14”: $75 +tax

16x20”: $90 +tax

16x20” Canvas: $250 +tax

24x30” Canvas: $400 +tax

Frame the Canvas: $100 additional charge +tax

3x3” Accordion Mini Book: $120 +tax

8x8” Hardcover or leather flush mount book: $550 +tax

C. Payment

The remaining balance for your session (minus the session fee deposit collected today) is due at the time of the session.  Should you decide to upgrade or add on print packages, those payments are due prior to receiving said upgrades.  Payments methods accepted are cash or check (payable to Lilac Blossom Photography.) NYS sales tax will be added to any product orders (including but not limited to: USB flash drives, prints, wall mounts, and books.)

D. Archive

After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.

E. Other 

All images are copyrighted by the photographer, Danielle Larson, of Lilac Blossom Photography. A print release will be given for all digital files so you may print them as you wish.

Minor retouching is complimentary as part of the editing process. Extensive retouching (such as head swapping, removal of tattoos, slimming or other major retouching) is available for $35 per image. 

There are no travel fees associated with residential newborn sessions in Suffolk and Nassau Counties, and parts of Queens (beyond 30 miles of the 11725 zip code), a $150 travel fee will be added to the final cost of the session to compensate for mileage, and extended travel times. Additionally, if tolls or paid parking is required, the client will pay be responsible for paying those expenses as well. 

Print orders will be ready approximately 2-3 weeks after the order is paid and will be mailed to you.

In the interest of fairness to all of my clients, I am unable to offer special deals or discounts except for those that may run occasionally as promotions.  For this reason, please understand that session fees, print prices and policies are non-negotiable.

F. Model Release

I hereby give to Danielle Larson of Lilac Blossom Photography the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others:

a) To copyright the same in the photographer’s name or any other name that she may select;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

 

G. Liability

Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

COVID-19 photography liability release: 
Client(s) knowingly and willingly consent to a photography sessions and understand the COVID-19 virus has a long incubation period during which carriers of the virus may not show any signs or symptoms and still be highly contagious. As of February 2021, the photographer is fully vaccinated and will take all precautions suggested by the CDC including wearing a mask and washing hands thoroughly but it is impossible to determine if the photographer isn't currently infected by the virus.  The client(s) release Lilac Blossom Photography from any and all liability should a COVID-19 positive diagnosis follow our session. 

 

H. Copyright & Penalty

Lilac Blossom Photography retains all copyrights to all images created during client’s session. A print release will be provided with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Lilac Blossom Photography during client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If client steals images via any method listed above, or any other method, client will be invoiced for the cost of EACH digital image client has stolen, at photographer’s current price per digital file.

Note from photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/facebook/Instagram page instead of right-clicking, saving, and sharing the image via your own page. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do not steal them.

 

I. Cancellations, Returns and Refunds

If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. 

Due to the custom nature of newborn photography, there is no guarantee on the number of poses or types of poses to be provided.  During the session, all attempts will be made to soothe and comfort the baby to assist in providing a variety of poses and backdrops.  If your baby (or other members of the family) are uncooperative, and all reasonable attempts have been made to soothe the baby, it is not the fault of the photographer. Alternate posing will be performed and therefore no refunds will be issued. 

Lilac Blososm Photography has a strict NO REFUNDS POLICY. Once a transaction has been completed (i.e., the client selected and paid for the photos and then Lilac Blossom Photography sent the client the correct photographs) it is then considered non-refundable. A wide selection of images that are in line with Lilac Blossom Photography’s portfolio standards will be included in the online gallery. Refunds will NOT be given due to “not liking a photo or gallery”, selecting an incorrect photo from the gallery, or any other reason. If a mistaken photo is sent to the buyer, as documented on the favorited settings in the gallery, Lilac Blossom Photography will send the correct photo to the buyer free of charge.
