Volunteer Waiver
MEDIA AND PHOTOGRAPHY RELEASE
I, the undersigned, do hereby consent and agree that the Lancaster SPCA (henceforth known as the LSPCA) and Lancaster County Animal Shelter (henceforth known as the LCAS) its representatives, and its employees have the right to take photographs, videotapes, or digital recordings of me and my property. I authorize the LSPCA and LCAS, its assigns, and transferees to copyright, use, and publish the same in print and/or electronically. I agree that the LSPCA and LCAS may use such photographs of me with or without my name and for any lawful purposes, including but not limited to such purposes as publicity, illustration, advertising, and web content.
SOCIAL MEDIA POLICY
We permit volunteers to take and/or publish both photographs and videos of LSPCA and LCAS events and animal residents open to the public. Permission from the LCAS Manager must be obtained for photographs and/or videos of areas and animal residents at the shelter. Please note that the LCAS may have a population of Protective Custody animals involved in ongoing court cases that are strictly prohibited from being photographed, video recorded, and shared via any form of media by both staff and volunteers.
Basic Guidelines
-Volunteers participating in any social media forum must make it clear that the views they express are theirs alone and do not necessarily reflect the views of the LSCPA or LCAS.
-Volunteers may promote LSPCA and LCAS activities, provided it is compliant with any policies that may apply and may include the LSPCA’s and LCAS’s current logos, replicated only from the LSPCA’s and LCAS’s official websites or postings.
-Volunteers may forward or share information made public through the LSPCA’s and LCAS’s official websites, main Facebook pages, or Volunteer Facebook Pages and post information about animals ready for adoption.
Users of Internet Posting Must
-Speak respectfully about the LSPCA and LCAS as well as former, current, and potential volunteers, employees, board members, adopters, partners, and competitors.
-Honor the privacy of current employees and volunteers by seeking their permission before writing about or posting photographs and/or video recordings that may be considered a breach of privacy or confidentiality.
-Respect copyright, privacy, fair use, financial disclosure, and other applicable laws
Users of Internet Postings May Not
-Disclose any information that is confidential to the LCAS, LSPCA or any partners
-Violate applicable policies of the LSPCA and LCAS, including those set forth in any and all volunteer manuals
-Defame, harass, name call, or engage in any behavior that reflects negatively on the LSCPA or LCAS
-Speak on behalf of the LSPCA or LCAS or represent yourself as a spokesperson for these organizations, unless given permission by the Shelter Manager, LSPCA Board of Directors, or with other staff as necessary
Volunteers can be disciplined by the LSPCA or LCAS for commentary, content, or images that are defamatory, pornographic, proprietary, harassing, libelous, or that can create a hostile work environment.
TERMS AND CONDITIONS
1. My services to the LSPCA and LCAS are provided strictly in a volunteer capacity and without any express or implied promise of salary, compensation, reimbursement, favors, or other payment.
2. My services are furnished without any employment-type benefits, including but not limited to employment insurance programs, worker's compensation accrual in any form, vacations, or sick time.
3. I will familiarize myself and comply with the LSPCA’s and LCAS’s policies and procedures applicable to volunteers. In particular, I fully understand that the LSPCA and LCAS expect high standards of moral and ethical treatment of the animals under its care. I will adhere strictly to these standards in my capacity as a volunteer.
4. I agree not to use the LSPCA’s or LCAS’s email, internet connections, computers, documents, or other items or means of communication for any inappropriate purpose such as (a) profanity or vulgarity, including acronyms; (b) sexual or provocative content; (c) illegal activities, including drugs; (d) trademark, copyright, or patent violations; (e) hate such as racial gender, sexual orientation, nationality, or religious slurs; (f) disruptive or offensive content, including controversial political or religious topics; (g) slander and libel.
5. I understand that LSPCA and LCAS, without notice or hearing, may terminate my service as a volunteer at any time, with or without reason.
RELEASE
1. I understand the risk of harm presented by the handling of animals and other volunteer activities on behalf of the LSPCA and LCAS. I further understand that volunteer activities may place me in situations that could result in injury to me or my personal property due to the unpredictable nature of animal behavior and interaction of animals that come into the LSPCA’s and LCAS ‘s care, custody, and control. I assume the risk of such activities.
2. On behalf of myself and my heirs, personal representatives, and assigns, I hereby release, discharge, indemnify, and hold harmless the LSPCA and LCAS and its directors, officers, employees, and agents from any and all claims, causes of action, and demands of any nature, whether known or unknown, arising out of or in connection with my volunteer activities on behalf of the LSPCA and LCAS.
I represent that I am at least 18 years of age, have read and understand the above policies, and am competent to execute this agreement.
