Payable in cash, certified funds or money order, bank wire, or accepted and agreed upon electronic transfer as follows: with a deposit equal to 50% of total hunt cost within 15 days of drawing a permit, or, in the case of a landowner tag or tag already drawn, within 15 days of signing this agreement. The final 50% of the hunt cost is due 30 days prior to the start of the hunt.
Client understands that in the event payment is not made as provided herein, Outfitter shall have the right at his sole discretion to cancel Client’s hunt and terminate this Agreement and retain all funds previously paid as liquidated damages and as his sole and exclusive remedy. Client understands that when Outfitter enters into this Agreement with Client, space is reserved for Client, and reservations from other clients are not accepted.
Killing an animal is not a guarantee and no refunds will be given in the event Client doesn’t fill his tag.
All payments are due regardless of the trophy size of the bucks found during scouting. We provide a service, not a guarantee, and have no control over the trophy size of the animals in an area in a given year.
Guests are allowed upon approval at $250 per guest unless "meals and lodging" is deselected. This must be discussed with the Outfitter before bringing guests.
REFUND POLICY:
The following Refund Policy is made a part of the Pronghorn Guide Service, LLC Agreement:
Within 15 days of drawing your tag, or, in the case of a landowner tag or tag already drawn, a 50% deposit is required. The deposit can be cash, personal check, certified check, money order, or bank wire. The Outfitter is not responsible for cash being sent via mail.
In the case of a draw tag not already drawn, no deposits will be accepted until that tag is drawn.
Within 30 days of the Client's starting hunt date, all remaining fees shall be paid in full to the Outfitter. Any money paid as a deposit shall be applied to the total hunt price. If the total hunt cost is not paid in full by 30 days before the hunting start date, then the hunt may be subject to cancellation.
If the Outfitter cannot perform any portion of his obligations for any reasons beyond the Outfitter’s control, including but not limited to weather, fire, acts of nature, or governmental action, the Client shall not be given a refund of any portion of his fee previously paid.
If your tag is forfeited voluntarily to the state, another person, or organization, your entire deposit will be forfeited.
Full refunds for all deposits and fees shall only be returned by the Outfitter to the Client in the following situations:
In the case of the death of the licensee. Any person who has the authority to represent the decedent as provided by court order shall submit a written request for a refund supported by a copy of the respective death certificate;
In the case of the death of the licensee’s spouse, parents, grandparents, lineal descendants and their spouses, step-parent, step-sibling, step-children, father-in-law, mother-in-law, brother-in-law, sister-in-law, step-son-in-law, or step-daughter-in-law, the licensee shall submit a written request for a refund supported by the respective death certificate; and where the date of the incident has occurred within four weeks prior to Client’s hunt start date.
In the case of incapacitating illness or injury of the licensee supported by a physician’s sworn statement, and where the date of the incident has occurred within four weeks prior to the Client’s hunt start date.
Military personnel who receive Permanent Change of Station (PCS) orders or are assigned away from their home duty station on Temporary Duty Orders (TDY), all of this being supported by a copy of an official military order from the Armed Forces of the United States;
Individuals who cannot participate in the regular season due to a court subpoena, jury duty, Grand Jury investigation, or attorneys required to attend criminal cases. A certified copy of the court document shall accompany the written request for the license refund;
When the state Game & Fish closes 100% of the hunting area;
An error on the part of the state Game & Fish where the Client has received a license not requested.
WAIVER AND RELEASE AGREEMENT:
The following Waiver and Release of Liability is made a part of the Pronghorn Guide Service, LLC Agreement:
This Is A Waiver And Release Of Liability. The Client Hereby Knowingly And Intentionally Waive And Release, Indemnify And Hold Harmless Pronghorn Guide Service Llc, Their Directors, Officers, Agents, Employees, Contractors, And Volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorney’s fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, negligence of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in these activities or the use of these services, animals or equipment, whether such damage, loss, injury, paralysis, or death results from negligence of hunting or some other cause. I, for myself, my heirs, my successors, executors, and subrogates, further agree not to sue Pronghorn Guide Service LLC as a result of injury, paralysis, or death suffered in connection with my use and participation in the activities of hunting.
If the Client Is Under Eighteen (18) Years Of Age, The Signature Of His Parent Or Guardian Is Required.
I Have Carefully Read, Clearly Understand, And Voluntarily Sign This Contract And All Included Agreements.
