Breeders Rights:
Nosam Kennels reserves the right to refuse puppy sales to anyone at any time for any reason or refund the deposit at any point we no longer wish to place a puppy in a home.
Nosam Kennels, has the option of first pick(s) of the litter at any time of male or female.
Nosam Kennels, reserves the right to change the sire and dam on any planned breeding without notice.
We strive to place our puppies in serious hunting and working home therefore, we will place those earning AKC, NAVHDA titles, or those who plan to hunt as priority on our waiting lists as those homes are working to improve the value of our breeding program.
Deposits:
If there is not a puppy in the available litter you joined for initially your position will move into the next available slot on the list. If possible, the puppy Buyer will also be given the opportunity to move to the end of the deposit list on available puppies of the opposite sex.
Due to the inconvenience created for the breeder and other client or potential client families, you will lose your deposit if any of the following apply:
1. Changing your mind about the purchase after an amount of time spent occupying a spot on a list. Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy to some other Buyer and retention of the Deposit is meant to compensate Seller for his possible loss.
2. If you fail to confirm your intent of purchase after pups are born or you are non-responsive throughout the developing stages thereafter.
3. Failure to collect puppy on the scheduled availability dates for that given litter.
4. Failure to use your deposit within 24-months will result in forfeiture of the deposit.
If you choose to push your deposit back, you will no longer be locked into the original price format. If the price increases you will have to pay whatever the price is at the time you choose to get a puppy.
Breeder Obligations:
1.Notify buyer within a week after the of birth of the litter.
2.Register the litter with Limited AKC or NAVHDA registration
3.Dock the puppy’s tail and remove the puppy’s dew claws.
4.Administer first set of vaccinations and worming for the puppy.
5.Puppies are dewormed at 2,4,6 weeks of age and again right before leaving.
6.Provide the puppy with a microchip Provide a health record for the puppy
Buyer Obligations:
1.Your puppy MUST See a vet within 3-days. If your puppy does not see the vet within 3-days of purchase then the whole guarantee will be voided.
2.It is understood that you will purchase SAFEGUARD dewormer in advance so that you may continue the deworming process once you bring your puppy home to ensure a healthy transition. It is understood that you must deworm your puppy within one week of their arrival home with SAFEGUARD for five-consecutive days. Puppies will need to be dewormed every 10-days until the puppy reaches 16-weeks of age to continue our deworming schedule.
3.Keep the puppy in the house as part of the family and provide the puppy with a hunting home or equivalent purpose that is suitable for their energy levels and stimulation needs. You agree to provide a safe and loving home for your puppy, provide fresh water and quality food appropriate veterinary care including, but not limited to, vaccines and heartworm preventative, a home with a yard, shelter and adequate room for daily exercise, companionship, and an active lifestyle. No chains, no kennels.
4.Buyer understands that overvaccination is not recommended for these breeds. The following vaccine protocol is offered where minimal vaccinations are advisable or desirable.
5. No spay or neuter until the puppy has reached 16 months of age.
6. Bring or mail a check and give to Nosam made out to American Kennel Club Or NAVHDA to complete the registration and microchip activation. It is a requirement that ALL puppies registrations are complete.
7. Provide breeder with name choices by 8-weeks of age. If a name is not provided or not appropriate the breeder will name the puppy. All puppies names must start with Nosam's
8. Puppies enrolled in training must be paid for in full by 8-weeks of age + payment due to the trainer for training.
9. We do not furnish dogs for breeding and all puppies are sold on AKC Limited registration with spay/neuter contract. All puppies that do not earn an AKC JH or NAVHDA NA, or AKC CH title by 18 months of age are REQUIRED to be spayed and neutered no later than 18-months of age. Proof of spay/neuter by 18-months of age or proof of an AKC JH, or CH or NA title is required to be sent to Nosam Kennels and failure to do so will result in a $5,000 fine.
Dogs that earn an NAVHDA NA or AKC JH title by 18-months and have been health tested (All tests recommended for the breed required) may be eligable for breeding.
If the Puppy Buyer wishes to breed their puppy Nosam Kennels will manage all breeding's for the buyer. The decision will be made together whether to breed the dog and Nosam will determine the outcome of pairings. The dog will be leased under contract for breeding to Nosam from the buyer. Nosam will manage stud services or whelp, raise and place the litter. For these services the puppy owner will receive compensation equal to the price of one puppy or 2nd pick of the litter. 1st pick if Nosam decides to not keep anything from the breeding. Otherwise we do not release breeding rights on our puppies and all puppies are sold on limited registration.
10. If a puppy shall get sick within the 3-day guarantee the puppy must be returned and all vet findings reported to breeder directly from the vet to Nosam Kennels within 24-hours. Failure to do so results in a void of the health guarantee but the rest of the contract remains intact.
Nosam reccomends the following:
Distemper + Parvovirus administered at 8, 10, 12, 16 weeks of age. 1x a year thereafter. 5-ways, lepto and lyme are not recommended for this breed due to vaccine related reactions.
Rabies-give 3-4 weeks apart from other vaccines.
Picking up your puppy:
Buyer understands that puppies must be picked up on the agreed upon date for that litter. Puppies leave by 8-weeks of age. There will be no other dates set to pick up puppies. Failure to pick up your pup or arrange transport by 8-weeks of age will result in forfeiture of the puppy and any monies paid. Seller has the right to sell the pup to another buyer if the person named in this contract fails to collect the puppy.
If an arrangement is made for a later pick up date there will be a $50 fee per day to board your puppy. This fee will be required to be paid before the puppy is picked up.
Buyer understands that puppies picked up in person must be paid for in CASH only. We do not accept electronic payments or checks for puppies that are picked up in person. If you fail to bring cash at pick up you will be charged a $250 service fee if we have to invoice you for electronic payments at pick up.
If puppies must be delivered payment is due by the time puppies turn Six (6) weeks of age. Failure to pay for your puppy by 6-weeks if you are having your puppy delivered will result in fioriture of your puppy and the deposit. There will be a 3% paypal fee & a 6% KY sales tax added to payments collected electronically.
Nosam Kennels is not responsible for any accidents that may occur on our property.
Training:Puppies being left with our trainer for extended training will leave to stay in home with the trainer at 8-weeks of age. Puppy balances must be paid for in full to Nosam before they can start training. Training payments will be due to our trainer. Half due when its booked and the remaining due upon the trainer taking the puppy. The trainer will also have a training contract that will need submitted prior.
Health Guarantee:
To the best of the breeder’s knowledge the puppy is sound in body, healthly, and free from disease or disability as far as has been discerned. The puppy has been given their first set of vaccinations, has been dewormed and has had a health check by a licensed veterinarian.
Puppy Buyer can return the puppy at Puppy Buyer’s expense for a full refund up to the cost of the puppy, if it develops an illness within three days of pick up. If during examination by Puppy Buyer’s veterinarian a genetic issue or illness is found and documented in writing by the examining veterinarian, the puppy may also be returned at Puppy Buyer’s expense for a full refund up to the cost of the puppy.
Any condition that is minor, correctable, or a breed related minor condition is not covered. Conditions which could go away, or are considered to be a condition which a puppy will likely grow out of is not covered. The conditions not covered include but are not limited to: the presence of external parasites such as fleas, ticks, lice, mites, mange, etc. or internal parasites such as roundworms, whipworms, hookworms, tapeworms, giardia, coccidia, poisoning, reproductive problems, accidents, vaccine or medicine-related reactions, umbilical hernias, undescended testicles, viruses, UTI's, lack of veterinary care, veterinary error, lack of training, or behavioral problems.), you may, within 3 days of purchase, return the puppy (along with the AKC registration papers and all materials) for a full refund.
A written, signed, and dated statement from your veterinarian is required detailing the description of symptoms supporting his/her opinion and an explanation as to why this puppy would be a poor health risk. This exam and all associated costs are the buyer’s responsibility. Please note that this is 3 days from when the pup leaves our premises. Should a puppy be returned for a refund it must be returned within 24-hours of notifying Nosam Kennels of the puppy's illness. Failure to send vet reports or return the puppy within 24-hours voids this health guarantee.
Nosam Kennels will not be responsible for any vet expense or diagnostic testing for any reason. We reserve the right to have a second option obtained from another veterinarian of our choosing. If a puppy should die before the extent of this guarantee a necropsy must be performed within 24 hours of the puppy’s’ passing to determine the cause. Findings must be forwarded to Nosam Kennels from the vet directly.
Seller is not responsible for any conditions brought on by the stress of shipping or new home relocation or adaptation of puppy into new family environment. These conditions are, but not limited to: diarrhea, hypoglycemia, Coccidiosis, Giardia, Car Sickness, vomiting or refusal to eat. Buyer will be prepared and educated on the stresses of introducing a new puppy to your family and be prepared with calorie rich nutritional supplements to prevent a drop in blood sugar (Hypoglycemia) which is life threatening to your new puppy. A preventative meeting with your vet is recommended so that you have the supplies necessary should they be needed.
We reccomend that buyers have pet insurance to cover unexpected medical bills when they pick up their puppy.
No other warranties or guarantees, expressed or implied, are made under
this contract except as stated here.
NON-BREEDING: Buyer understands that we do not sell puppies with breeding rights or furnishes puppies to homes for breeding. In order to protect our lines, we retain the right to place all puppies on non-breeding contracts.
Buyer agrees and understands that the dog will be registered on an AKC non-breeding Limited Registration that will not be reversed. Buyer understands the dog will NOT be permitted to produce ANY litter during its lifetime. Any other arrangements may only be made with the Seller’s written consent. Violation of this agreement is subject to a fine of $10,000 forfeiture of the dog, plus any monies spent to get the dog back and cost of each pup. Puppies are sold on limited registration and must meet the requirements for this to be released at the breeder's discretion. If a dog sold on limited registration is bred we will not consent to registration with ANY register including AKC (American kennel club) for the resulting litter(s).
AKC limited registration lift will only happen if the following requirements are met.
1. Dog must earn at least AKC Junior Hunter, NAVHDA NA, or AKC Champion title.
2. Dog must have at least average or above pennhip scores or OFA fair hips. Vizslas: passing CERF (eyes), Cardiac and Thyroid. GSP: Passing Hips, Elbows, Eyes, Cardiac.
2. Be two years of age prior to being bred and be a good representive of the breed.
4. Buyer must sign a contract agreeing to breeding terms such as but not limited to selling puppies with only AKC limited registration untill the above requirements are met, all resulting puppies must be microchipped and the dog must not be bred to non titled/ non health tested dogs.
Nosam reserves the right to deny lift of limited AKC registration if we do not find it the best intrest in our program.
RETURN OF DOG: If at any time you feel your dog no longer fits in with your family and lifestyle, please return he/she back to Nosam Kennels where we will provide proper placement. Under no circumstances should a puppy be sold, transferred, traded, or surrendered to an animal control facility, shelter, rescue or a cash refund given for the return. Failure to return the puppy to the seller will result in prosecution a $5,000 fine and any legal fee's or money spent to get the dog back or placed in an appropriate home.
Other Agreements:
Breeder hereby released from any and all future liability to Puppy Buyer with regard to the puppy. Puppy Buyer agrees that from the date they take possession of the puppy, Puppy Buyer accepts all liability for the actions of the puppy and holds Nosam Kennels harmless with regard to any and all third parties.
If for any reason the health gurantee is voided the rest of the contract will remain intact.
This contract contains the entire agreement between Buyer and the seller and no other statements, agreements or attachments, written or verbal, made by either party that is not contained in this written contract shall be valid or binding and is signed by both parties. If any part of this contract is not legal according to local laws, the rest of the contract shall remain unaffected. If any part of this contract is breached by the Buyer the Seller is released from all further obligations.
Buyer agrees not to attack and or criticize the Seller in private or public emails, phone calls, forums, blogs, social networks and any other type of online media at any time during or subsequent to contract period in a way which brings financial harm or bad name to the Seller. In the case of breach of this clause, the buyer agrees to pay five thousand dollars ($5,000) to the Seller as damages.
The contract & warranty only applies to the original buyer outlined in this contract. If the puppy or dog is sold or transferred to another home the guarantee will be null & void.
In the event of any litigation in connection with this health warranty/contract, by signing this contract, the purchaser agrees to be responsible for breeder’s attorney fees. Venue and jurisdiction for litigation arising out of or related to this contract shall be exclusively in breeder’s current county and state.
No other warranties or guarantees, expressed or implied, are made under this contract except as stated herein.
When signing the contract all buyers guarantee that their sole purpose in coming to our property is to buy a puppy & that they are NOT working undercover for HSUS, PETA or any other animal rights extremist group, rescue or any groups affiliated with the sole purpose to end animal ownership & violate the rights of dog breeders. Also, that they will NOT give information about our property to any humane society or animal rights organization under penalty of prosecution. The Animal Enterprise Terrorism Act (AETA) is a United States federal law (Pub.L. 109–374; 18 U.S.C. § 43) that prohibits any person from engaging in certain conduct "for the purpose of damaging or interfering with the operations of an animal enterprise. “The statute covers any act that either "damages or causes the loss of any real or personal property" or "places a person in reasonable fear" of injury.
