  • Nosam is dedicated to the improvement of the breeds we work with. The intent of this contract is to assure Puppy Buyers that the puppies produced from this kennel are not from indiscriminate breeding, but carefullly thought out to improve the outstanding hunting qualities and health of the German Shorthair, and Vizsla breeds.

    If you feel that compliance with our policies and contract is going to be a problem, please find another breeder. Our policies and contracts are created to not only protect the buyer, but most importantly the puppy or dog being placed.

     

    The following agreement is between Nosam Kennels, and:

    Breeders Rights:

    Nosams reserves the right to refuse puppy sales to anyone at any time for any reason or refund the deposit at any point we no longer wish to place a puppy in a home.

    Nosam Kennels, has the option of first pick(s) of the litter at any time of male or female.

    Nosam will place those earning AKC, NAVHDA titles, or those who plan to hunt as priority on our waiting lists as those homes are working to improve the value of our breeding program. 

     

    Breeder Obligations: 

    Puppy will have had had at minimum, 1st parvo vaccination, dewormer, dewclaws removed, and tails docked. Puppies will be provided with a Microchip, AKC limited registration and a health record. 

    Puppies will have been dewormed at 2,4,6 & 8 weeks of age and checked by a licensed Vet prior to leaving. 

    This puppy is guaranteed to be in good health, to the best of the seller’s knowledge. The buyer has 3-days, from the date of ownership in which to have the puppy checked by a licensed veterinarian. Failure to do so will void the whole health gurantee. If your veterinarian states that your puppy has any problem that makes it a poor health risk (this does not include the presence of external parasites such as fleas, ticks, lice, mites, mange, etc. or internal parasites such as roundworms, whipworms, hookworms, tapeworms, giardia, coccidia, poisoning, reproductive problems, accidents, vaccine or medicine-related reactions, umbilical hernias, undescended testicles, UTI's, lack of veterinary care, veterinary error, lack of training, or behavioral problems.), you may, within 3 days of purchase, return the puppy (along with the AKC registration papers and all materials) for a full refund. A written, signed, and dated statement from your veterinarian is required detailing the description of symptoms supporting his/her opinion and an explanation as to why this puppy would be a poor health risk. This exam and all associated costs are the buyer’s responsibility. Please note that this is 3 days from when the pup leaves our premises

    Nosam will not be responsible for ANY vet expense or diagnostic testing for any reason. We reserve the right to have a second option obtained from another veterinarian of our choosing. If a puppy should die before the extent of this guarantee a necropsy must be performed within 24 hours of the puppy’s’ passing to determine the cause. Findings must be forwarded to Nosam from the vet directly.

     

    Buyer Obligations:

    Buyer agrees to have the puppy seen by a vet within 3-days of purchase. If a licensed vet finds any issues that makes the puppy a poor health risk. The breeder must be notified immediately (within 24 hours) by the buyer with the conclusion of the veterinarian findings. A certified letter is to be sent to the breeder by the veterinarian within 24 hours of the diagnosis. The unhealthy puppy must be returned within 3 business days for a replacement. If you refuse to provide proof of or cannot provide proof from a veterinarian, or do not return the unhealthy puppy the guarantee will be void.

    It is understood that you will purchase SAFEGUARD dewormer in advance so that you may continue the deworming process once you bring your puppy home to ensure a healthy transition. It is understood that you must deworm your puppy within one week of their arrival home with SAFEGUARD for five-consecutive days. Puppies will need to be dewormed every 10-days until the puppy reaches 16-weeks of age to continue our deworming schedule.

    You agree to provide a safe and loving home for your puppy, provide fresh water and quality food appropriate veterinary care including, but not limited to, vaccines and heartworm preventative, a home with a yard, shelter and adequate room for daily exercise, companionship, and an active lifestyle. No chains, no kennels.

     

    Buyer understands that overvaccination is not reccomended for these breeds. The following vaccine protocol is offered where minimal vaccinations are advisable or desirable. lNosam only reccomends the use of Distemper + Parvovirus adminsitered at 8, 10, 12, 16 weeks of age. 1x a year thereafter. 5-ways, lepto and lyme are not reccomended for this breed due to vaccine realted reactions. Rabies – give 3-4 weeks apart from other vaccines. Failure to follow this will void the health gurantee. 

     If at any time you feel your pup no longer fits in with your family and lifestyle, please return the puppy back to the breeder where we will provide proper placement. Under no circumstances should a puppy be sold, transferred, or surrendered to an animal control facility, shelter, rescue or a cash refund given for the return. Failure to return the puppy to the seller will result in prosecution a $5,000 fine + any fee's or money spent to get the dog back or placed in an appropriate home.

     

    Buyer understands that puppies must be picked up on the agreed upon date for that litter. Puppies leave at 8-weeks of age. There will be no other dates set to pick up puppies.  Failure to pick up your pup or arrange transport by 8-weeks of age will result in forfiture of the puppy and any monies paid. Seller has the right to sell the pup to another buyer if the person named in this contract fails to collect the puppy. 

    Buyer understands that puppies picked up in person must be paid for in CASH only. We do not accept electronic payments or checks for puppies that are picked up in person.If you fail to bring cash at pick up you will be charged a $250 service fee if we have to invoice you for electronic payments at pick up.

     If puppies must be delivered payment is due by the time puppies turn Six (6) weeks of age. Failure to pay for your puppy by 6-weeks if you are having your puppy delivered will result in foriture of your puppy and the deposit. There will be a 3.5% fee added to payments collected eletroncially. 

     

    Gurantees:

    General Health: 3 days Your new puppy is warranted to be in good health and to be virus-free for up to 3 days. To keep your health guarantee your puppy MUST See a vet within 3-days. If your puppy does not see the vet within 3-days of purchase then the whole guarantee will be voided.

     

    Hip Gurantee: 24-months

    Hip dysplasia (CHD) and other joint problems can often be attributed to environmental conditions as well as heredity. Studies have shown that CHD is 50% genetic as well as 50% environmental. Therefore, we cannot guarantee this dogs hips against any form of dysplasia that is attributable to nongenetic causes, nor do we guarantee a dog will obtain any particular Orthopedic Foundation for Animals (OFA or Pennhip) Rating.

    Note: if only one hip is rated with mild dysplasia or worse but the other side is rated with a fair or better than this is not covered by our guarantee. True hereditary dysplasia is bilateral and affects both sides. Unilateral dysplasia is where there was trauma involved that caused one side to not grow or heal properly. Puppies are warranted against crippling hip dysplasia that is apparent by 24 months of age.

    If a NK puppy is suspected of being severely dysplastic within 24 months, due to genetic cause, and is not functionally able to run or walk without extreme pain (Many times, even with diagnosed dysplasia, the puppy can still live a happy, full, and pain-free life), this is the procedure to follow for the terms of the warranty to remain in effect: We will apply the full purchase price of your puppy toward the price of a replacement puppy chosen by Nosam Kennels within 24 months. If you do not want a replacement puppy and would rather have cash payment then the orginal dog must be returned. We do not offer cash refunds if you choose to keep the dog. 

     A statement must be received from your veterinarian noting that he/she has no knowledge of any injuries to this dog which may have contributed to the dysplasia. 

    It is understood that hip problems can be caused by poor nutrition, early spay/neuter or injury and that the puppy is warranted to the extent of genetic hip  problems only. In order to maintain the limited guarantee outlined herein, the buyer must

    1. have all updated immunizations documented and administered by a licensed veterinarian.

    2. Have the dog on a proper moderate exercise routine

    3. Provide the dog with a proper diet; Nuvet vitamins given, and the dog must not be over or underweight.

    4. The dog must not have been bred or sired a litter before 24 months of age.

    5. The dog must not have been Spayed or Neutered before 18-24 months of age. (if a puppy is spayed/neutered before this recommendation the warranty is null and void)

    6. A copy of the Pennhip rating must be sent to the Breeder by 24 months of age with recorded microchip reflecting the breeders records.

    7. Breeder reserves right to 2nd opinion of their choosing, as mentioned above in our contract. This includes having the X-rays redone by our personal vet or one of our choosing. 

    8. All Medical records must be forwarded from the dogs vet directly-not the owner. 

    9. Proof the dog had to be surgically altered to live a normal life must be provided to the breeder. Copy of vet bill for surgery, photos of the dog after surgery. Video of the dog limping/in visible pain prior to surgery.

    10. Buyer agrees not to attack and or criticize the Seller in private or public emails, messages, phone calls, forums, blogs, social networks and any other type of online media at any time during or subsequent to guarantee period in a way which brings financial harm or bad name to the Seller. In the case of breach of this clause, the guarantee will be void.  

     

    Note: The use of Trifexis, Comfortis, Credelio, Simparica, & lepto & Lyme are strongly advised against and the use of any of these products will completely void the whole Health Guarante

    We cannot warranty any other health issues not found within the 3-day warranty above!

    The dog shall NOT be put to sleep due to genetic health or behavioral issues within this warranty without seller’s written consent.

     

    Nosam is not responislbe for any vet bills or diganostic testing realted to this gurantee and no cash refunds will be offered. Buyer is responsible for any costs related to return of a dog for any reason. 

     

    NON-BREEDING: Buyer understands that we do not sell puppies with breeding rights or funishish puppies to homes for breeding. In order to protect our lines we retain the right to place all puppies on non-breeding contracts.

    Buyer agrees and understands that the dog will be registered on an AKC non-breeding Limited Registration that will not be reversed. Buyer understands the dog will NOT be permitted to produce ANY litter during its lifetime. Any other arrangements may only be made with the Seller’s written consent. Violation of this agreement is subject to a fine of $10,000 forfiture of the dog, plus any monies spent to get the dog back and cost of each pup. Puppies are sold on limited registration and must meet the requirements for this to be released at the breeder's discretion. If a dog sold on limited registation is bred we will not consent to registration with ANY registery including AKC (american kennel club) for the the resulting litter(s). 

     Other Agreements

    When signing the contract all buyers guarantee that their sole purpose in coming to our property is to buy a puppy & that they are NOT working undercover for HSUS, PETA or any other animal rights extremist group, rescue or any groups affiliated with the sole purpose to end animal ownership & violate the rights of dog breeders. Also that they will NOT give information about our property to any humane society or animal rights organization under penalty of prosecution. The Animal Enterprise Terrorism Act (AETA) is a United States federal law (Pub.L. 109–374; 18 U.S.C. § 43) that prohibits any person from engaging in certain conduct "for the purpose of damaging or interfering with the operations of an animal enterprise."The statute covers any act that either "damages or causes the loss of any real or personal property" or "places a person in reasonable fear" of injury.

    This contract contains the entire agreement between Buyer and the seller and no other statements, agreements or attachments, written or verbal, made by either party that is not contained in this written contract shall be valid or binding and is signed by both parties. If any part of this contract is not legal according to local laws, the rest of the contract shall remain unaffected. If any part of this contract is breached by the Buyer the Seller is released from all further obligations.

    Buyer agrees not to attack and or criticize the Seller in private or public emails, phone calls, forums, blogs, social networks and any other type of online media at any time during or subsequent to contract period in a way which brings financial harm or bad name to the Seller. In the case of breach of this clause, the buyer agrees to pay five thousand dollars ($5,000) to the Seller as damages.

    The contract & warranty only applies to the original buyer outlined in this contract. If the puppy or dog is sold or transferred to another home the guarantee will be null & void.

    In the event of any litigation in connection with this health warranty/contract, by signing this contract, the purchaser agrees to be responsible for breeder’s attorney fees. Venue and jurisdiction for litigation arising out of or related to this contract shall be exclusively in breeder’s current county and state.
