KYHPR Pet Adoption Contract and Waiver

Acknowledgment of Return Policy

I acknowledge that if I adopt a pet from this rescue and, at any point in the future, need to surrender the animal, I am required to return the pet to the rescue in Kentucky at my own expense. I understand that, by law, all pets adopted through this rescue must be returned to the rescue if I am no longer able to care for them or choose to find them a new home.  I further acknowledge that I am solely responsible for all costs associated with transporting the pet back to Kentucky, including but not limited to travel, lodging, and any necessary arrangements for the animal's safe return.

The adoption fee is $150.00-$500.00 & is NON-REFUNDABLE with the only exception as described in the terms outlined below.

Spay/Neuter/Microchip Agreement:

As part of the conditions of adopting the aforementioned pet, should it not yet have undergone sterilization via spaying or neutering, the adoptive owner pledges to ensure this procedure is carried out within the pet's first year of life if adopted as a puppy or within six months post-adoption if adopted as an adult. All sterilization surgeries can be facilitated at no additional cost to the adopter through any veterinarian clinics sanctioned by KY Hopeful Paws Rescue (KYHPR). KYHPR offers financial assistance for these procedures at standard rescue prices, not exceeding $120, if they are required post-adoption. The adopter is liable for any residual balance at their chosen veterinarian clinic after KYHPR has reached its financial cap. Beyond this, KYHPR holds no financial responsibility for the adopted pet.

 

Further, the adoptive owner, as stipulated in this contract, agrees to arrange a health examination for the adopted dog/cat at a veterinarian of their choosing within 15 days of adoption. If the pet is determined to be in poor health at this time, we request that the pet be returned to KYHPR for either treatment from our staff veterinarian or for an exchange. This provision is not applicable to pets in fair health that necessitate additional treatments, antibiotics, or parasite control. These are the adopter's responsibility. The adopter has a 15-day window to inform KYHPR of the pet's ill health, with conditions ranging from necessary surgeries, chemotherapy, long-term medications, to euthanasia. KYHPR, at its discretion, will either opt to A) provide medical care, or B) refund the adoption fee in return for the pet. If the pet has not been introduced to your selected vet within 15 days post-adoption, the above terms will be rendered null unless a prior arrangement has been approved by both the adopter and KYHPR.

 

Any other procedures, treatments, examinations, or vaccinations not explicitly detailed in this contract are the financial responsibility of the adoptive owner.

 

NOTE:  if the pet has not been sterilized and microchipped by the designated date, KYHPR reserves the right to recover the pet and terminate this Dog Adoption Contract without a refund of the adoption fee.

 

 

NOTE TO VETERINARIAN: Only the treatments, procedures, and/or vaccinations specified in writing below will be charged to KY Hopeful Paws Rescue (KYHPR). This is conditional on prior agreement and approval from KYHPR, and requires that an authorized representative of KYHPR schedules and organizes the appointment in advance on behalf of the adopter.

KY Hopeful Paws Rescue Pet Adoption Contract

 

As the adoptive owner, I hereby consent to the following terms and conditions, kindly review these terms carefully:

 

I acknowledge the necessity to promptly have the pet, identified and detailed on page (1) of this contract, examined by a licensed veterinarian within three days following the adoption. The purpose is to perform a routine physical examination, the results of which must be shared with KYHPR within 15 days. The costs associated with this examination will be solely borne by me, the adoptive owner, and will not be invoiced to or compensated by KYHPR.

 

I commit to ensure the pet's health by scheduling regular veterinary check-ups for vaccinations, including those for rabies as mandated by local laws, and for heartworm and flea/tick prevention. I also consent to provide KYHPR with vaccine and preventative documentation upon request and allow them to verify the vaccine history and all medical treatments from my vet.

 

I agree to adhere to the spaying/neutering and microchipping stipulations described in the "Spay/Neuter/Microchip Agreement" section of this contract, should the pet not be already altered. I am also aware that failure to comply within the agreed timeframe permits a representative of KYHPR to rightfully reclaim the pet with no refund of the adoption fee.

 

I undertake to cater for this pet humanely by providing it with sufficient food, water, shelter, and necessary behavioral training. I also commit to not introduce any large, aggressive, or dominant dog to the household that may pose harm to my pet. I pledge to abstain from subjecting the pet to any form of abuse or to use it for biomedical research or experiments.

 

I promise to provide suitable daily exercise for my pet and ensure it remains confined within my property. I agree that this pet will be kept indoors, and that no outside dogs will be accepted.

 

I will ensure my pet always wears a proper identification tag, including my current contact number and its rabies ID.

 

I understand and agree that the pet will be microchipped before placement (if age appropriate) and registered to both KYHPR & me, the owner, when feasible. In case the microchipping isn't completed prior to adoption, it will be executed during the spay/neuter procedure. I accept that if co-registration of the microchip isn't possible, the costs will be covered by me, the adopter.

 

Should my pet go missing, I commit to promptly inform KYHPR by calling 859-582-8808 or sending an email to kyhpaws@gmail.com.

 

Upon finalizing the adoption, I acknowledge that I am the official owner of the pet. However, I understand that the microchip registration will always remain under both my name and KYHPR's (when possible), to safeguard the pet throughout its lifetime.

 

I will inform KYHPR of any changes to my address or phone number within ten (10) days to allow them to update the adoption record. This is critical for ensuring the pet can be reunited with me if it gets lost.

 

I understand that this pet is being adopted for personal reasons and will be kept solely as a domesticated house pet. It will not be sold, bred, transferred, or surrendered to another person or organization for any reason. I also agree that, should I be unable to care for the pet, I will contact KYHPR for advice on rehoming the pet or to facilitate its return to the rescue.

 

I pledge to enroll the pet in behavioral training if necessary, and to socialize the pet with other individuals and animals to ensure it adapts to all environments. I consent to KYHPR conducting a welfare check on the pet at any time.

 

I acknowledge that if KYHPR, after conducting a welfare check, determines the home environment or pet's well-being is no longer satisfactory or safe, they reserve the right to reclaim the pet with no refund of the adoption fee.

 

By signing this contract, I confirm that no member of the household has been investigated or charged with domestic violence, animal neglect or animal abuse. If such findings emerge later, KYHPR has the right to reclaim the pet with no refund of the adoption fee.

 

I understand that failure to comply with any of these terms allows KYHPR and its associates to rightfully reclaim the pet and terminate the adoption with no refund.

 

I agree that if the adoption fee is paid electronically through PayPal, Venmo, or any other digital payment platform, I am subject to a 4.00% administrative fee on top of the applicable adoption fee (unless payment is sent via "Friends & Family" or any other fee-free method).

 

Should legal action be necessary to enforce the terms of this adoption contract, I agree to cover all of KYHPR's legal fees if they emerge as the prevailing party in the case.

 

I understand that the pet will need an adjustment period to acclimate to its new surroundings. If the pet is not adjusting well to the point of not eating, drinking, or playing, I agree to contact KYHPR immediately and consent to return the pet. It's noteworthy that the return of the pet, whether requested by me or KYHPR, will not result in a refund of the adoption fee for behavioral issues.

 

By signing this agreement, I hereby indemnify and hold harmless KYHPR, its board members, associates, and representatives from any loss, damage, injury, or death caused by the pet adopted from KYHPR from the date on this contract.

 

I agree not to initiate any counterclaims or lawsuits against KYHPR, its board members, associates, or representatives for any reason whatsoever.

 

I understand that all actions to enforce this adoption contract shall occur in Kentucky and will be governed by Kentucky law.

 

By signing below, I, the adopter, certify that I am at least 21 years of age and affirm that I have read, understood, and agreed to all the terms and conditions stipulated in this contract.

 

KYHPR will provide me with an electronic copy of this Pet Adoption Contract and available medical information for the adopted pet.

 

I agree with KYHPR and all its representatives to uphold the privacy of clients and adopters.

Additional Terms:

 

A payment ranging from $150 to $500 is required, payable via cash or through digital platforms such as PayPal or Venmo.

 

Our Legacy Dogs, a collection of particularly desirable dogs and puppies, carry a higher adoption fee, ranging from $400 to $650. The additional fees associated with adopting Legacy Dogs contribute significantly to our Senior-to-Senior program, supporting senior dogs and addressing extensive medical cases within our rescue organization.

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT FOR ADOPTION of KY Hopeful Paws Rescue, Inc. ANIMAL

Acknowledgement of Animal's Condition and Inherent Risks: I hereby acknowledge and agree that I am adopting the canine specified above "as is," and that, while KY Hopeful Paws Rescue, Inc. (KYHPR) has made reasonable efforts to ensure the health of the animal, future health issues that may arise will not be the responsibility of KYHPR. I further acknowledge and understand that the behavior, temperament, and health outcomes of the adopted canine are not guaranteed, and I willingly accept the inherent risks associated with pet adoption, which may include but are not limited to injury, illness, death, damage to property, and other unforeseen risks.

Assumption of Risk: By adopting said canine, I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage of property owned by me, as a result of adopting said canine, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE. For the purposes of this agreement, "negligence" is defined as failure to exercise the care that a reasonably prudent person would exercise in like circumstances.

Emergency Veterinary Treatment: I agree to seek immediate veterinary treatment for the adopted canine if it becomes ill or injured, and I understand that all costs related to the treatment of the canine for any illness or injury will be my responsibility.

Indemnification: I agree to indemnify, defend, and hold harmless KYHPR, its officers, directors, employees, agents, and representatives from and against any and all losses, liabilities, claims, obligations, costs, damages, and/or expenses, including attorney fees and court costs, that occur as a result of my breach of any part of this agreement.

IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by the same.
