2. The collection or testing process is obstructed. 3. The test is altered, adulterated or a substitute sample is
discovered. 4. EMPLOYEE fails to attend a scheduled test.
5. EMPLOYEE refuses to complete required testing forms
6. EMPLOYEE fails to provide an adequate specimen for testing.
d. Failing a drug or alcohol test will result in immediate termination
7. Incident reporting a. In the event of an injury or safety incident, EMPLOYEE will report
immediately to the worksite supervisor and may be required to fill out an
incident reporting form. EMPLOYEE agrees to follow these steps:
i.Seek first aid immediately ii. iii. iv.Submit to a drug and alcohol test within the first 4 hours of the work
Report the injury to the supervisor or foreman
Report the incident to Trades Construction Staffing.
Fill out the required information on the on site Incident Report
Follow up with the onsite nurse, if available, for any additional
Seek outside medical treatment if needed.
Comply with all the policies and procedures of the work site and of
Trades Construction Staffing's client. Hold Trades Construction Staffing harmless in the event of a work
related accident or injury while under the influence of drugs, alcohol or due to negligence.
8. Penalty a. Failure to adhere to this agreement may result in termination, additional
fines and monetary penalties, or litigation.
In the case of litigation, court costs and attorney's fees will be the
responsibility of EMPLOYEE, if EMPLOYEE is found to be in direct
violation of this agreement and the terms wherein.
a. This agreement will be governed by and construed in accordance with the
laws of the state of Ohio, without reference to any conflicts of law
principles thereof. 10. Employee Handbook a. EMPLOYEE acknowledges that he/she has received and has had an opportunity to read a copy of the Trades Construction Staffing Employee Handbook, which can be found at:
