This agreement is between the 'Client', whose name and address is listed below, and Paola Avazan the Photographer' of OV Photography, CALISTOGA. Ph: 707.480.3195

The Client shall not give their baby a full feeding for two hours before the session and shall keep their baby awake for one or more hours before the session. The baby shall be fed immediately at the beginning of the session or just prior to arrival. The baby must be dressed in loose fitting clothing for ease of changes for portraits. The Client shall bring at least two bottles for feeding or supplies for nursing. If a pacifier or soother is required, the Client shall supply those items. The Client shall maintain control of other people in the home/studio, including siblings. It is the responsibility of the Client to ensure the cooperation of these additional people as not to intrude on the baby's immediate area.

Upon booking the session, the Client shall make a non-refundable retainer of $100.00 to the Photographer to perform the services specified herein. This non-refundable retainer secures the time and date agreed upon by both parties based on expected due date of baby. Full payment is due the day of the session.

3. RE-SCHEDULING/LATE ARRIVALS

If Client requests to amend the session date, the retainer will be applied to a mutually agreed upon re-schedule date. If the Photographer is unable to perform this agreement on the agreed session date due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session again. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for

If the Client cancels this agreement or fails to show, the retainer shall be forfeited. Client understands and agrees that Photographer may not be able to re-schedule a new session and may have suffered financial losses that are difficult to ascertain. In the event the Photographer cannot perform their duties, the Photographer reserves the right to substitute with another photographer. The substitute photographer is chosen at the discretion of the Photographer and does not constitute a breach of this agreement. The Photographer warrants the substitute photographer to be of comparable quality and professionalism.

The Client(s) hereby agrees that he/she fully understands that there are no full refunds or exchanges on purchases after the session is completed due to the custom nature of newborn portrait photography.

The Photographer retains the right of discretion in selecting the photographic materials released to the client.

The Photographer shall own the copyright of all images created, including but not limited to, negatives, transparencies, proofs and previews. The Photographer shall also have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display on or within the Photographer's website and/or studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client.

The Photographer will make gallery proofs available to the Client through an online gallery proofing website or through an in-person ordering session. These proofs shall be available to the Client within two weeks of the session. If an online proofing gallery is delivered,it shall remain open for 30 days from delivery. If the Client requests to extend the time or reopen the online proofing gallery, a $10 un-archive fee shall apply. The Client shall only use the prints, including digital files, in accordance with the permissions withinthis agreement. The Client's prints are for personal use only and shall not be submitted to contests or reproduced for commercial use. The Client should not authorize any reproductions by parties other than the Photographer. The Photographer will provide the Client witha digital file print release and the Client must act in accordance with that release.

Only images that are watermarked and specially formatted for web viewing by the Photographer can be posted or shared online by the Client. Clients may NOT post the high resolution print files online. Images may not be altered in ANY way by the client (no cropping, black/white conversion, filters, etc The Photographer will post preferred shot(s) from the session on the Facebook fan page once product purchases have been made and encourages the client(s) to tag himself/herself and share with friends and family. The Client may share blog post links and Facebook albums through use of the share functions and dissemination of direct links. Client shall not copy, download, screen shot or capture the photographs in any other fashion.

10. LIABILITY E INDEMNIFICATION

If the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to, camera and processing, or photographic materials are lost or damaged without fault of the Photographer, liability shall be limited. The Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release the photographer from any claims against their person or their business. The Client(s) will waive, disclaim and release OV Photography and it's respective owners, members, employees, agents, volunteers and representatives from any and all actions, claims or demands against (insert your business name here) that they may have now or in the future, whether known or unknown. Parties, including without limitation those related to injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto.

hearby agree to pay the Booking Deposit of $100.00 upon signing this form and understand that the Booking Deposit is non-refundable. I also hearby agree to and understand the conditions of the completed model/minor/ photo release forms. I grant OV Photography by Paola Avazan the unrestricted right to use and publish photographs for editorial, trade, advertising and other purposes.

It is illegal to copy or reproduce these photographs elsewhere without OV Photography's permission and violators of this Federal Law will be subject to it's civil and criminal penalties. All photographers, both on website and Facebook, including all potential proofs and purchased prints are copyrighted; reproduction of any image by any means, including copying, re-printing, screen captures and other means of print reproduction are strictly prohibited and are a violation of copyright law. Additionally, it is ILLEGAL to post any photographers work on the internet, blogs and social networking sites without the express permission of the photographer. The only exception to this is if you have purchased the print release CD. As an artist, (insert your name) wishes to have complete control over the final look of her/his client's images. Scanned images damage her reputation as a photographer by distorting and devaluing the image quality. Thank you for respecting (insert your name) work and livelihood by choosing not to reproduce her/his images. EXCLUSIVE PHOTOGRAPHER: Please only bring the people that will be photographed to the session. Also, please do not bring your own camera, camcorder or recording device to the session. BEFORE THE SESSION: Please have your children dressed and ready to go for their session. This includes hair combing and having their faces clean. Children are more likely to become grouchy if they are fussed with too much before the session. Bring some of their favorite snacks along with you. RETAINER POLICY: A non-refundable retainer of $100 is due at the time of booking your session. This guarantees the time and date allotted for you. Should payment not be received in this time frame, OV Photography reserves the right to offer the date and time to another client. TRAVEL FEE: There is a $50 travel fee for portrait sessions located 30 miles outside of Calistoga. ONLINE GALLERY: The images will be displayed in a password-protected online gallery. The online gallery will be available for 3 weeks. If you wish to order prints then ordering should be completed in that time frame. If you would like to re-publish your gallery there is a $10 dollar

PORTRAIT CARE: Handle your portraits with extreme care. Damage incurred as a result of improper handling, framing or hanging is the responsibility of the client. SALES ARE FINAL: Due to the custom nature of each session, all sales final. Proof books that are purchased are not returnable. To receive refund, OV PHotography must have a 2-week notice from the scheduled session. REPRINTS: All ordered images will be kept on file for one year after your initial order. All images that are not ordered will be kept on file for one week only. You are welcome to place a re-print order from the images you originally purchased. RE-SHOOTS: Re-shoots are at the discretion of the photographer and are not given for regretful personal choices such as hair and clothing

UNDER THE WEATHER: If you or your child is feeling ill, please call to reschedule. OV Photography understands that sometimes this happens. If you must cancel, please try to do so at least 48 hours before your session. PAYMENT OPTIONS: OV Photography currently accepts cash, debit and credit cards. USAGE: OV Photography reserves the right to use the negatives and/or reproductions for display, publication, or other purposes. Negatives and originals remain the property of OV Photography.

I hereby authorize OV Photography by Paola Avazan to publish photographs taken of myself and/or the minor child or children listed below, and our names and likenesses, for use in the OV Photography's print, online and video-based marketing materials, as well as other OV Photography publications.

I hereby release and hold harmless OV Photography from any reasonable expectation of privacy or confidentiality for myself and for the minor child and children listed below associated with the images specified above. Further, I attest that I am the parent or legal guardian of the child or children listed below and that I have full authority to consent and authorize OV Photography to use

I further acknowledge that participation is voluntary and that neither I, the minor child, or minor children will receive financial compensation of any type associated with the taking or publication of these photographs or participation in OV Photography marketing materials or other OV Photography publications. I acknowledge and agree that publication of said photos confers no rights of ownership or royalties whatsoever.

I hereby release OV Photography, its contractors, its employees and any third parties involved in the creation or publication of (insert your company name) publications, from liability for any claims by me or any third party in connection with my participation or the participation of the minor children listed below.
