Participant Consent and Parental Release:
As a PARENT/LEGAL GUARDIAN of a participant in the Wiregrass Talent Quest, Jr (WTQJr), I hereby agree as follows:
I hereby grant to Cultural Arts Center (Hereafter known as CAC), without charge or compensation, the right to film, tape, record ,photograph, exhibit, display, edit, distribute or otherwise use my child’s appearance, names, likeness, voice, singing voice, conversations, sounds, signature, biographical data, and any information or materials provided by me to the CAC with the understanding that it can be used as part of the event’s promotional material, voting material, marketing material, etc., and that as such, the CAC is the sole owner of and may freely assign my images and information as they deem necessary to promote and complete this event.
In the event that my child performs any ORIGINAL MUSIC in connection with the event to include musical arrangements, titles, lyrics, and all other elements of the term “music” or “recordings”, I represent that we OWN, control and have obtained the rights, clearances, and releases necessary for CAC to allow us to perform this music and that the CAC has no intent in owning or exploiting my child’s original music and any recordings that go with this event.
I agree that my child will be performing their own act which they created or selected for the CAC. And that since this is their own act, as parents we are responsible for determining that they are capable of performing the act and that it does not include fire or animals in the act. However, I understand that the CAC may, in its sole discretion, refuse to allow my child to participate in the WTQJr event if they reasonably believe that my child is not capable of performing the act or in some way could create harm or injury to themselves or the CAC during the performance of the act.
As parents/legal guardians of said child, we agree to follow all of the CAC’s rules, directions, and instructions in all matters related to WTQJr and which may be subject to change from year to year as needed. We agree to accept any and all decisions of the CAC on all matters, including but not limited to discretionary matters (including but not limited to interviews during the event, contestant selection, and approval for performance, judges voting, People’s Choice Award voting, etc.) as final and not subject to challenge, and acknowledge that the interests of the WTQJr shall override those of any participants. We again understand that at any time in this process, CAC reserves the right, exercisable at any time in its sole discretion, to disqualify my child from the event should we at any stage: supply untruthful, inaccurate, or misleading personal information, fail to abide by the rules of conduct, dress, and behavior for the event, or make disparaging remarks related to any contestant in the event publicly or on social media, etc.
As Parent/Legal Guardian of this child, I hereby release, discharge, and hold harmless the CAC Board of Directors, Staff, and any Corporate or individual supporters of this event, and all others connected with the WTQJr event, their related parent companies, subsidiaries, and/or affiliated companies, and the officers, directors, employees, agents, and representatives of each of the foregoing companies (collectively referred to as the “Release Parties” here on out) from any and all liabilities and claims arising out of or in any way resulting from my child’s participation in this event in any aspect of phase thereof.
In addition, I agree to indemnify CAC and the Released Parties and to hold each of them harmless from any and all liability, claim, action, damage, expense, and loss of any kind (including, without limitation, attorney’s fees) caused by or arising out of CAC’s use of the music, photos, recordings, and arising out of breach or alleged breach of any provision hereof or any statement, action, or failure to act by me or my child during or in connection with my child’s participation in the WTQJr. I understand that if I or others reveal or relate information of a personal, private, surprising, defamatory, disparaging, embarrassing or unfavorable nature OR if my child’s actions may be embarrassing or of an otherwise unfavorable nature that may be fact or fictional, OR if my appearance, depiction, and portrayal in connection with the event may be disparaging, defamatory, embarrassing or of an otherwise unfavorable nature, that all this may expose my child to public ridicule, humiliation, or condemnation and may portray my child in a false light, then I am agreeing that these are potential harms to myself and my child. And without limiting in any way the foregoing possible events, I will not have the right to seek injunctive or other equitable relief against the CAC or any of the Released Parties.
I affirm that neither I nor anyone acting for me gave or agreed to give anything of value to any member of the Released Parties, Staff, or anyone associated in any manner with CAC for participation and consideration in this event. I understand that CAC’s policies prohibit such payments.
I affirm that I am the parent/legal guardian of this child, that I am at least 19 years of age or older, and that I have the full and complete right and authority to enter into this Agreement on behalf of my child.
I affirm that I am not a candidate for public office, and that my child’s appearance in this event shall not be deemed to be a performance by law and is not employment under any collective bargaining agreement or performing arts guild and does not entitle my child to wages, salary, residuals, corporate benefits or other compensation under any such collective bargaining agreement. I agree that I cannot issue any publicity statements or interviews with respect to WTQJr, or my child’s appearance in the event without written permission and consent of the Director of the CAC.
LASTLY, I understand that this event is a fundraiser for the Cultural Arts Center and is in no way connected to or can provide connections to any performance on a larger stage, any agent of any talent company, recording company, or performance guild. My child is participating as part of a fundraising event to share their talents, be judged upon those talents in accordance with guidelines given to judges for the event, with hopes of receiving recognition and awards. I understand that this is a show for the public to see.
This shall be a complete and binding agreement with the CAC, myself, and my child and it supersedes all prior understandings and agreements both oral and written. This agreement cannot be terminated, rescinded, or amended except by failure to comply with the terms and conditions of the release.
Note: IF YOU ARE PART OF A GROUP OF PERFORMERS, EACH PARENT OF A CHILD IN THE GORUP WILL NEED TO SIGN THIS DOCUMENT. PLEASE MAKE COPIES OF THIS DOCUMENT AND SIGNATURE SHEET TO ACCOMMODATE THE NUMBERS IN YOUR GROUP AND ATTACH ALL SIGNATURE SHEETS WITH YOUR APPLICATION AND LEGAL DOCUMENT.
