FOR SALE OF USED PROPERTY TO MEMBERS OF GENERAL PUBLIC
CONDITION OF SALE:
No person residing in the City of Everman, Texas, shall display for purposes of
sale, offer to sell or sell, used personal property to members of the general
public, except under the following conditions:
- All such used personal property so offered for sale shall be displayed to
possible purchases only on premises belonging to, or under the control of, the
person offering such personal property for sale.
- No new personal property may be displayed, offered for sale, or sold.
- No new personal property owned by others and cosigned to the person
offering such property for sale may be displayed, offered for sale, or sold.
- Signs advertising such used property for sale shall be permitted to displayed at any location if the property owner of that location has granted permission to place the sale sign, or on City Right of Way’s during the garage sale, but must be removed within twenty-four (24) hours from the close of the sale or 12:00 midnight whichever occurs first. (Ordinance 298, Section 1, 8–16–83).
- No signs may be placed on utility poles and failure to comply may result in a fine per (Ordinance 433, Section 22.19, and K-3).
- No such used property shall be displayed, offered for sale, or sold for any continuous period longer than seventy two (72) hours.
- No person shall display, offer to sell or sell used personal property in the City without first procuring a permit from the City for each such sale, at a cost of twenty five dollars ($25.00), and obtain said permit during normal business hours no later than the day before the beginning of the display, offering to sell or selling of such used property (Ordinance 423, Section 1, 12-4-90).
- No such used personal property shall be displayed, offered for sale, or sold by the residents of any one house more than four (4) times in one year.
- The City Manager shall have the authority, upon the request of the permit holder, to reschedule a garage sale date if there are unusual circumstances such as a death in the family, illness, or inclement weather (Ordinance 423, Section 2, 12-4-90).
NO REFUND POLICY:
In the event that even one (1) item is sold during your scheduled days, and under
the unusual circumstances as stated above no refund will be issued.
AMENDMENT
Section 1 (6) – the permit fee shall be twenty-five dollars ($25.00), fifteen
($15.00) of which shall be refunded when the signs are returned as required by
Section 11 – 193(5).
EXCEPTION’S
There is excepted items from the personal property covered by this article,
individual items of personal property, and the normal accessories to such
individual items such as, for example, but not restricted to:
- A boat, motor and trailer.
- Pick-up truck and camper.
- Set of golf clubs, bags, and gold balls, etc.
However, only one (1) such item shall be publicly displayed for sale at any
one time or group of items as in example (1), (2), or (3) (Ordinance 298,
Section, 2 8-16-83).
PLEASE NOTE:
It is your responsibility to remove and return garage sale signs after your garage/yard sale. Within 24 hours after your sale, if not done so, the fifteen dollars ($15.00) will not be refunded, and the Everman Police Department may issue a citation for that offense.
