Terms and Conditions
This agreement is made and entered into by and between Surf Life Saving New South Wales (referred to as “SLSNSW”) and the person, persons or company as identified above (referred to as “Stallholder”).
1.1 Stallholder applications are assessed on the ability to best fulfil the requirements of SLSNSW.
1.2 SLSNSW reserves the right to refuse or cancel Stallholder applications and is not obliged to disclose reasons for such refusal.
1.3 Applicants must hold Public and Products Liability Insurance ($20million) to cover the duration of the event, including bump in and bump out. A certificate of currency is required to be submitted with the application.
2.1 SLSNSW will require a 50% non-refundable deposit from approved Stallholders within 10 days of successful notification. The remaining 50% balance will be due at the conclusion of the championships.
2.2 SLSNSW reserves the right to offer the opportunity to other Stallholders, should payment not be received.
2.3 Payment will not guarantee the Stallholder to be the exclusive supplier of its product.
2.4 If the Stallholder fails to attend the event, the amount paid will be forfeited to SLSNSW.
2.5 Payment is subject to change at the discretion of SLSNSW.
3. Set Up & Signage
3.1 All display equipment and material must be located within the confines of the Stallholder’s marquee.
3.2 It is the Stallholder’s responsibility to ensure that all equipment brought to or utilised at the event by the Stallholder has been erected securely and is operated in a safe manner.
3.3 SLSNSW may direct the Stallholder where to place certain equipment or signage, and require the Stallholder to remove dangerous, faulty or unsightly equipment.
4.1 It is solely the Stallholder’s responsibility to arrange their own power / a portable generator prior to the event, at the Stallholder’s expense.
4.2 SLSNSW reserves the right to request that a Stallholder turn off any generator where in the opinion of SLSNSW the generator is causing nuisance.
5.1 The Stallholder must leave its stall as secure as possible over night and on non-competition days to avoid any losses. SLSNSW recommends the complete removal of all equipment, stock and tent walls.
5.2 SLSNSW will employ security for the entire event site compound however will not be responsible for the replacement of any stock if theft occurs or the rectification of any damage if vandalism occurs.
6. Retail Location
6.1 The positioning of stalls is wholly at the discretion of SLSNSW, with exact stall location advised closer to the Championship.
6.2 SLSNSW makes no representations as to the suitability or otherwise of the stall or its location for Stallholder’s products or purposes.
7. Event Relocation
7.1 If the event is re-located (e.g. due to weather conditions or unfavourable surf conditions), the Stallholder, in consultation with SLSNSW, will be responsible for the relocation of its stall to the alternate venue.
7.2 SLSNSW will not be responsible for any loss of revenue if the event is relocated. There is no guarantee that contingency locations will be able to accommodate stallholders. SLSNSW will ensure communication to stallholders is done at the earliest possible time.
7.3 Should SLSNSW cancel any component of the Championships due to changed COVID restrictions which result in SLSNSW being unable to stage the Championships, the deposit will be fully refundable. Should the Championships be cancelled during the Championships for this reason, SLSNSW will determine a refund of the balance of the fees based on the time of the cancellation.
8.1 Stallholders are required to act in a professional manner, and be polite to other Stallholders, staff and the general public at all times.
8.2 Bringing SLSNSW, the event and/or its affiliates into disrepute, negatively influencing the public, customers or fellow stallholders, and/or not listening to instruction given by appropriate representatives of SLSNSW is not acceptable.
8.3 Any behaviour deemed unacceptable will result in Stallholder removal from the event and banning from any future attendance, with no refund and at the cost of the Stallholder.
9.1 SLSNSW will not be responsible for any unsuccessful business goals that the Stallholder may set to achieve.
9.2 The Stallholder will release, indemnify and save SLSNSW from and against any and all obligations, damages, penalties, claims, costs, charges and expenses (including legal fees on a solicitor client basis), expenses and court costs that may arise to, by or from any person as a consequence (whether direct or indirect) of Stallholder’s act or omission (including negligence) in operating its stall.
10.1 By accepting to be a Stallholder you agree and adhere to everything that is stated in this document and that the risk is solely on the Stallholder.
