    • Due to COVID-19, Accreditation on its own no longer permits access to Supercars Events. All attendees must register and be approved to be at each event. Access will be permitted with an accreditation pass when used in conjunction with the Supercars electronic contact tracing and WH&S system. Attendance approvals may be subject to regulations imposed by government including but not limited to your place of residence, hotspot locations and overall attendance regulations at the event. Access can be denied at any time by Supercars

    • Media Accreditation is restricted to professional journalists and photographers only.

    • Photographers cannot apply as individuals.

    • All applications for photographers must be made in writing by a publication or media outlet.

    • Each publication will only be permitted a limited number of photography media passes per event.

    • Support categories will only be permitted accreditation for one (1) photographer per event at the discretion of Supercars.

    • There are strict restrictions around the use of Supercars images on social media and websites. Please read full terms and conditions before applying for accreditation.

    • If any pass holder is found producing moving images or videos of any kind of any Supercar event without direct permission from Supercars Media (separate to Media Accreditation), their accreditation will be withdrawn and the pass holder will not be admitted to any Supercars event for the foreseeable future

    • Media Accreditation for websites will be granted at the discretion of Supercars. Blogs, forums and other personal websites or social media pages will not qualify.

    The Media Event Pass and Media Access Pass are considered a working tool and are only to be used by working media members.

    Under no circumstances will media accreditation be supplied to advertising and public relations companies and the like or representatives of sponsors, suppliers, engine suppliers, teams and drivers (this includes media managers and public relations officers).  

    Series Media Accreditation

    Series Media Accreditation is allocated to mainstream media and select motorsport media who are attending all, or most of, the Supercars Championship events in the one season.

    Series Media Accreditation is subject to the applicant holding a permanent position with a major metropolitan or national newspaper, magazine, television station, radio or endorsed website. Evidence of the applicant’s position is required in writing from the Editor (or similar).

    Applicants granted with Series Media Accreditation are required to lodge a headshot.

    In some cases, media will be required to provide examples of work / published content.

    Freelance Media will only be granted Series Media Accreditation if an approved outlet contacts Supercars directly and independently via letter or email to verify the applicant’s authenticity. These media will be required to be working for a major metropolitan newspaper, magazine or designated website and then produce their work once published or aired.

    Please note that lodgement of this application does not mean your application will be approved.

    • Media applying for Series Accreditation for the Supercars Championship must meet the below guidelines. Supercars recognises the value of media coverage and reporting of the Supercars Championship, provided that coverage respects ethical and industry standards and does not breach any copyright legislation.

      Media applying for accreditation are encouraged to read the Guidelines thoroughly prior to submitting their application.

       1.    ACCREDITATION PRINCIPLES

      Media Accreditation is restricted to professional journalists and photographers only. The Media Event Pass and Media Access Pass are considered a working tool and are only to be used by working media members.

      Under no circumstances will media accreditation be supplied to advertising and public relations companies and the like or representatives of sponsors, suppliers, engine suppliers, teams and drivers (this includes media managers and public relations officers).

      Note: Publishers, marketing personnel, sub-editors, publications secretarial staff and technical or service staff will not be accredited as media.

      Supercars Australia only accredits publications and agencies:

      a) with a minimum circulation of 20,000 for magazines and 50,000 for newspapers

      b) with a format and quality which fulfil the criteria

      c) which are available to the public in sales outlets (for publications only)

      d) only the official Supercars Australia website or websites with more than 60,000 unique monthly visitors or a minimum of 40,000 Nielsen unique monthly visits

      Internal magazines of companies, trade magazines and newsletters cannot be accredited as media. However, at the sole discretion of Supercars Australia, and where the quality and circulation criteria justify their consideration, such magazines may be eligible for accreditation on a case-by-case basis.

      Applicants who wish to undertake a commercial venture (this includes but is not limited to website, television, radio and commercial photographers) must send their accreditation application to and receive prior approval in writing from Supercars Australia.

      Event Media Passes and Media Access Passes are granted at the discretion of Supercars Australia and if at any stage Supercars Australia reasonably suspects that photographic images or similar are being used for commercial purposes, accreditation will be revoked without notice. Event Media Passes and Media Access Passes remain the property of Supercars Australia and may be removed at any time.

      Note: All Media Accreditation is issued at the sole discretion of Supercars Australia and decisions will not be reversed.

      Television media / or motion cameras except the Broadcast Rights holder are only permitted to capture / record vision on pre-specified days by Supercars Australia. This will be advised in a timely fashion prior to each event.

       2.    ACCREDITATION CRITERIA

      Supercars distribute two forms of Media Accreditation; Event-only Media Accreditation and Series Media Accreditation.

       

      2.1   Event-only Media Accreditation

      Event-only Media Accreditation will be granted for media only attending select Supercars Championship events. Additionally, Event-only Media Accreditation will be assessed on the merit by the relevant Event promoter with the final approval by Supercars.

      For Event Only Media Accreditation, priority is given to publications intending to publish a report specifically related to the event which accreditation has been requested.

      Event only passes can also be allocated to general news, specialist, business and lifestyle consumer publications who do not intend to publish conventional race reports, but the coverage is considered to be of editorial benefit to Supercars Australia.

      In most circumstances a maximum of two representatives (journalist / photographer) per publication may be accredited for any one round of the Supercars Australia Championship.

      All applicants must fulfil the following criteria to be granted Media Accreditation.

      2.2    Coverage

      Daily newspapers are required to produce a substantial amount of coverage per event. For example (coverage is not limited to) an introductory article in the Thursday edition, follow-up articles on Friday and Saturday (and Sunday where applicable) plus a race report in the Monday edition.

      Weekly and monthly publications should cover a substantial amount of coverage per event and the major portion of the content should be on the subject of Supercars Australia.

      Publications and agencies applying for Event-only Media Accreditation for a photographer must supply evidence of independent coverage of a minimum of 15 images per pass from the previous year.

      2.3 Quality

      Supercars Australia expects the utmost standards of fairness and accuracy as minimum quality requirement from the pass.

      2.4 Circulation

      Accreditation decisions are based on the relative ‘media market’ in the country of the applicant. As previously stated, Supercars Australia will only accredit applicants with a minimum circulation of 20, 000 for magazines and 50, 000 for newspapers.

      Photo agencies must be able to supply evidence that images have been regularly sold to publications that meet Supercars Australia Media Accreditation criteria and have been paid for at the normal commercial rate. The purchasing publication must be able to prove the pictures are the original work of the accredited photographer.

       3.    PHOTOGRAPHER ACCREDITATION

      Photographers cannot apply as individuals. All applications for photographers must be made in writing by the publication or media outlet. There will be stringent guidelines applied and it may be a case that the media outlet may need to use agency or supplied photography.

      Media outlets applying for photographer accreditation must write to:

      All Series photographers must possess a CAMS Gold Level Accreditation. Limited exceptions may be made for CAMS Silver Level Accreditation and this will be determined in the absolute discretion of Supercars Australia and only on the request from the publication / outlet.

      All Series Accredited Media must be working directly for a major metropolitan or national news outlet, a dedicated Supercars Australia / motorsport magazine, an international news agency or an endorsed Supercars Australia news-based website. Supercars Australia will only accept bonafide media producing work certain for publication, no speculation.

      Rights free images for editorial use only will be made available on direct request to Supercars Australia, and will be distributed / issued at the organisations discretion.

      4.    WEBSITES

      In the main non-SC related websites will not be granted accreditation. Websites that are operated by major media outlets (ie news.com.au or yahoo.com.au) are generally serviced by the masthead or the broadcaster but can apply in writing on a needs basis.

      Websites are permitted to display single Supercar images however they must be watermarked, not able to be downloaded or saved, of low resolution and not for commercial use. Images must accompany news articles only and should be contained within the article page or opened from the article page and not used for other content within the site. ie. photo galleries of the event are not permitted.

      Image dimensions cannot exceed 800 pixels in height and width and be no greater than 500 kilobytes and 200 pixels per inch.

      Websites must employ their own journalists and not syndicated content.

      Failure to comply with the stipulated conditions may result in accreditation being revoked by Supercars Australia and in its discretion Supercars Australia may take further action.

      Media Accreditation for websites will be granted at the discretion of Supercars Australia.

      Applicants must also provide satisfactory evidence the website is a professional Championship or professionally run general news or sport website with a clear Supercars Australia / motorsport section. Evidence should include Supercars Australia coverage of each Championship for the past three Championship seasons, with publication dates and correct by-lines. In each case all coverage on the Championship must be free of charge to the public. Blogs, forums and other personal websites will not qualify.

      If the above requirements are met a maximum of one representative journalist per website per event may be accredited. Websites associated with a print or broadcast media organisation that has already applied for, and been granted, any other form of media accreditation will not qualify for accreditation.

      The applicant must provide audited traffic figures confirmed by an Internet auditor or industry repute accepted by Supercars Australia for the last three years (express as unique IP address per year) along with a geographical breakdown of users i) for the website or ii) in the case the website is not dedicated to the Championship, the section which compiles the Championship section of the website.

      The representative journalist must be (i) a full time professional journalist and (ii) must be employed or engaged by the website as a journalist, wholly or primarily for the coverage of the Championship.

      The website must maintain a clear “contacts” section with a link from the website homepage and which must contain full contact details for the website including a full postal address (PO Boxes not accepted), telephone and fax numbers, email address; and (ii) all contributing journalists must be named either on their articles or elsewhere on the website, photographs must be accompanied by a photographer’s credit and all sources must be credited in accordance with editorial best practice.

      The website must have a suitable written Privacy Policy, a Right to Reply/Complaints Policy and otherwise comply with all laws, regulations, guidelines and good practice relating to the operation of a website.

      The applicant must respect others’ intellectual property rights. This shall include the strict prohibition on the taking of any moving picture images, sound recordings, use of trademarks, title or logos or the transmission of certain kinds of results. If any pass holder is found producing moving images of any kind of the Event (or any part thereof), their accreditation will be withdrawn and the pass holder will be not be admitted to any Supercar Event for the foreseeable future.

      Supercars Australia will allocate Internet Accreditation taking into account the above criteria in order to ensure that Championship coverage on the Internet is carried out responsibly and that coverage is as widespread as possible.

      5.    PIT LANE

      Series and Event-only Media Accreditation does not include pit lane access.

      Pit lane access is restricted to specified photographers only; these photographers have been notified.  

      Media, with exception of authorised Broadcast Rights personnel and the photographers noted above, are not permitted into pit lane at any time whatsoever whether prior to, during or after racing, subject always to Supercars Australia discretion.

      Fire suits are compulsory in pit lane during all Supercars Australia sessions unless otherwise advised.

      6.    INTERVIEW PROTOCOL

      Interviews must be conducted at the media conferences held after practice, races or at the team garages/transporters with the permission of the team.

      All interview requests with Supercar / officials must be requested through the Supercar GM of Media and Communications

      7.    ACCREDITATION PROCEDURES

      All Journalist Accreditation applications must be submitted through the Supercars Australia Media Accreditation Portal, which will be provided to those who express their interest.

      Applicants must complete all mandatory fields and accept the terms and conditions stipulated in this document.

      The applicant will be notified of their application status (approve / decline) via email from Supercars Australia.

      Event-only Media Passes and Media Access Passes will be distributed to successful media applicants via post or other requested collection methods.

      7.1 Event-only Media Accreditation Procedure

      Applications must be received three weeks before the requested event. Applications lodged after the deadline, incomplete or sent via fax may not be considered.

      Requests must include a formal application letter written on the applicant’s letterhead which must include;

       a) name/s of representative/s who will be covering the event

       b) job title/s of representative/s (journalist or photographer)

      c) information on publication (circulation, readership, frequency etc)

      d) pdf files of material published following the previous Championship events (in most cases the content the applicant was accredited for)

      e) a formal approval from the editor to publish a report related to the requested event and an indication of the anticipated publication date

      This document must be signed and approved by the editor/senior member of the editorial staff. Signed by other clerical / general staff will not be accepted.

      Supercars Australia will verify whether the application meets the relevant criteria and will send a confirmation/ declination email to the applicant.

       

       7.2 Photographer Media Accreditation Procedure

      Photographers cannot apply as individuals as per the above guidelines.

      All applications for photographers must be made in writing by the publication or media outlet. There will be stringent guidelines applied and it may be a case that the media outlet may need to use agency or supplied photography.

    • GENERAL ACCREDITATION TERMS & CONDITIONS  
    • GENERAL ACCREDITATION TERMS & CONDITIONS

      Accreditation will be issued by V8 Supercars Australia Pty Ltd (“Supercars”) for the exclusive use by the Applicant specified above (“you”, “your”). The Accreditation entitles you to enter the Supercars events specified above in this Application for Series Accreditation (“the Events”). Accreditation is conditional upon you being at least 18 years old, abiding by the terms and conditions of Accreditation applying from time to time and by your agreement to the below provisions. Accreditation may be revoked by Supercars at any time.

      You agree to act in accordance with the International Sporting Code of the FIA, any applicable National Competition Rules of the Confederation of Australian Motor Sport Limited which are not in conflict with the rules of the Supercars Operations Manual, Supplementary Regulations, any Further Supplementary Regulations, instructions and any Bulletins issued (collectively “Rules”). You must not carry out any activities at Events for a commercial purpose (whether directly or indirectly) except where specifically authorised by Supercars. The Accreditation cannot be transferred. Transfer or misuse of the Accreditation, or breach of the Rules, may be cause for suspension or termination of the Accreditation by Supercars in its absolute discretion and is subject to civil and criminal penalties, including liability resulting from injuries to the person or property of anyone purporting to use an Accreditation without the express written permission of Supercars.

      In consideration for the granting of Accreditation (including entering the Events), you unconditionally and irrevocably agree:

      • to release Confederation of Australian Motor Sport Ltd ("CAMS") and Australian Motor Sport Commission Ltd, Supercars Australia Pty Limited; TouringCar Entrants Group Australia Pty Ltd, promoters, sponsor organisations, land owners and lessees, organisers of Events, their respective servants, officials, representatives and agents (collectively, the "Associated Entities") from all liability for your death, personal injury (including burns), psychological trauma, loss or damage (including property damage) ("harm") howsoever arising from your participation in or attendance at the Events except to the extent prohibited by law; whether caused by the negligence of any of the Associated Entities or otherwise;

      • to indemnify and keep indemnified the Associated Entities and each of them from loss, liability, damage and costs they may suffer or incur arising out of or related to your attendance at or participation at an Event;

      • that CAMS and the Associated Entities make no warranty, implied or express, that Event services will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose for which they are supplied; 

      • Supercars may provide your personal information provided in this Application to CAMS and Associated Entities for the purpose of performing their responsibilities at Events and in defence of any claims brought by you against them.

      • to attend and/or participate in the Events at your own risk and that you voluntarily assume all risks (inherent and otherwise) arising from participation in or attendance at the Events, whether caused by the negligence

       DISCLAIMER – EXCLUSION OF LIABILITY, RELEASE AND ASSUMPTION OF RISK

      In exchange for being able to attend or participate in the Event(s) (and as condition of this Accreditation), I agree:

      - that the nature of motor racing involves inherent risks and dangers to persons attending the Events, and acknowledge that I have been warned that in attending the Event(s) there is the possibility of an accident causing injury, death or property damage.

      - I agree to waive any rights or claims I may have now or at any time in the future against, and releases from all liability, not to sue and indemnify Supercars Australia Pty Ltd, TouringCar Entrants Group Australia Pty Limited (TEGA), Confederation of Australian Motorsport Ltd (CAMS),the promoters, any particular Team or driver, the circuit owner, landowners and lessees, and other organisations connected to the Event(s) and their directors, members, officers, employees, agents, representatives and contractors (together the Associated Bodies) for any personal injury, death, damage or loss of any kind that I may suffer or sustain as a result of and in connection with its presence at the Event(s) or its use of the media pass which is not due to the proven negligence of the Associated Bodies.

      - to indemnify the Associated Bodies against any claims by a third party for personal injury, death, damage or loss of any kind suffered or sustained by that third party as a result of my proven negligence at the Event(s).

      - no official timing, results or other data relating to the Event(s) may be reproduced, stored in a retrieval system or transmitted in any form or by any electronic, mechanical, photocopying, recording, or broadcasting means or otherwise without the prior express written permission of Supercars Australia Pty Ltd except for reproduction by local, national or international press in regular publications on sale to the public or accessible on their corresponding authorised Internet sites.

      - I will not make or use sound recordings or radio broadcasts and / or take moving picture images of the Event(s) without the prior express written permission of Supercars Australia Pty Ltd.

       - I agree to comply with all reasonable instructions from all Officials at the Event(s) and will ensure that at all times that I will remain in permitted or designated areas as advised by the Event(s) throughout the course of the Event(s). 

      *PHOTOGRAPHERS PLEASE NOTE

      - I may take still photographic images solely for customary editorial use in the print media (and their corresponding authorised Internet sites), and will be responsible for obtaining all necessary third party consents, as well as the prior express written permission of Supercars Australia Pty Ltd, for any non-editorial or commercial use of these still photographic images.  I acknowledge and agree, and will do all things necessary to ensure, that any intellectual property rights in photographic images taken at the Event(s) will on creation vest in, and remain the property of, Supercars Australia Pty Ltd.

    • RELEASE, WAIVER, ASSUMPTION OF RISK & INDEMNITY  
    • This is an important document which affects your legal rights. Reading the document in its entirety and obtaining legal advice is recommended. 

      This document will also sit within the Supercars electronic contact tracing and WH&S system, and will be required to be agreed to before event access is granted.  


      DECLARATION

      You accept the conditions of, and acknowledge the risks arising from, attending or participating in the Motorsport Activities being provided by Motorsport Australia and the Entities.

       

      RISK WARNING AND ASSUMPTION OF RISK

      A Series Pass (Accreditation/Pass) will be issued by V8 Supercars Australia Pty Ltd (Supercars) for the exclusive use by the applicant specified above (You, Your). The Accreditation entitles You to enter the Supercars events specified above in this application (the Events). The issue of Accreditation is conditional upon You being at least 18 years of age,(unless parent/guardian permission is provided below) and by using the Accreditation You agree to abide by the terms and conditions of Accreditation applying from time to time the below provisions. Accreditation may be revoked at any time by Supercars.

       

      RISK WARNING AND ASSUMPTION OF RISK

      Motorsport Activities are inherently dangerous recreational activities and there is significant risk of injury, disability or death.

      If you do not wish to be exposed to such risks, then you should not participate in the Motorsport Activities.

      You acknowledge that the risks associated with attending or participating in Motorsport Activities include but are NOT LIMITED to the risk that You may suffer harm as a result of:

      •  motor vehicles (or parts of them) colliding with other motor vehicles or persons or property;

      •  other participants acting dangerously or with lack of skills;

      •  high levels of noise exposure;

      •  acts of violence and other harmful acts (whether intentional or inadvertent) committed by persons attending or participating in the event; and

      •  the failure or unsuitability of facilities (including grand-stands, fences and guard rails) to ensure Your safety.

       

      EXCLUSION OF LIABILITY, RELEASE & INDEMNITY

      In exchange for being able to attend or participate in the Motorsport Activities, You agree:

      •  to release Motorsport Australia and the Entities to the extent that any or all of them are providing Recreational Services from all liability for:

      a) your death;

      b) any physical or mental injury (including the aggravation, acceleration or recurrence of such an injury);

      c) the contraction, aggravation or acceleration of a disease;

      d) the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs:

             i.      that is or may be harmful or disadvantageous to You or the community; or

             ii.     that may result in harm or disadvantage to You or the community,

      howsoever arising from Your participation in or attendance at the Motorsport Activities;

      • to indemnify and hold harmless and keep indemnified the Entities to the maximum extent permitted by law in respect of any Claim by any person; and

      • to attend at or participate in the Motorsport Activities at your own risk.

       

      You understand that:

      • nothing in this document excludes, restricts or modifies any rights that You may have as a result of significant personal injury that is caused by the Reckless Conduct of the Entities as the supplier of the Motorsport Activities / Recreational Services;

      • nothing in this document prevents the Entities from relying on any laws (including statute and common law) that limit or preclude their liability;

      • nothing in this document excludes any term or guarantee which under statute cannot be excluded; however, the liability of the Entities is limited to the minimum liability allowable by law;

      • nothing in this document precludes You from making a claim under a Motorsport Australia insurance policy where You are expressly entitled to make a claim under that insurance policy; and

      • Motorsport Australia has arranged some limited personal injury insurance coverage which may provide You with some protection for loss, damage or injury that You may suffer during Your participation in the Motorsport Activities. However, You acknowledge and accept that the insurance taken out by Motorsport Australia may not provide You with full indemnity for loss, damage or injury that You may suffer during Your participation in the Motorsport Activities, and that You may have to pay the excess if a Claim is made under an insurance policy on Your behalf. You agree that Your own insurance arrangements are ultimately Your responsibility and You will arrange any additional coverage at Your expense after taking into account Motorsport Australia insurance arrangements, this document and Your own circumstances.

      Where Motorsport Activities are held in the following jurisdictions, You acknowledge that You have also read and accepted the following warnings:

      WARNING APPLICABLE IN RELATION TO MOTORSPORT ACTIVITIES UNDER COMMONWEALTH LAWS

      Under Australian Government Consumer Law (which is part of the Competition and Consumer Act 2010 (Commonwealth)), several guarantees are implied into contracts for the supply of certain goods and services. I agree that the application of all or any of the provisions of Subdivision B of Division 1 of Part 3-2 of Australian Consumer Law (i.e. guarantees relating to the supply of services), the exercise of rights conferred by those provisions, and any liability of Motorsport Australia and the Entities for a failure to comply with any such guarantees, are excluded. However, such exclusion is limited to liability for:

      ● death, physical or mental injury (including aggravation, acceleration or recurrence of such an injury of the individual);

      ● contraction, aggravation or acceleration of a disease of an individual; or

      ● the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual that is or may be harmful or disadvantageous to the individual or the community, or that may result in harm or disadvantage to the individual or the community.

      This exclusion does not apply to significant personal injury suffered by me as a result of the reckless conduct of Motorsport Australia and the Entities.

      WARNING APPLICABLE IN RELATION TO MOTORSPORT ACTIVITIES HELD IN VICTORIA

      WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012:

      Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you:

      • are rendered with due care and skill;

      • are reasonably fit for any purpose which you either expressly or by implication, make known to the supplier; and

      • might reasonably be expected to achieve any result you have made known to the supplier.

      Under section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic), the supplier is entitled to ask you to agree that these conditions do not apply to you. If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.

      NOTE: The change to Your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission.       WARNING APPLICABLE IN RELATION TO MOTORSPORT ACTIVITIES HELD IN SOUTH AUSTRALIA

      Your rights:

      Under sections 60 and 61 of the Australian Consumer Law (SA), if a person in trade or commerce supplies you with services including recreational services), there is:

      • a statutory guarantee that those services will be rendered with due care and skill;

      • a statutory guarantee that those services, and any product resulting from those services, will be reasonably fit for the purpose for which the services are being acquired (as long as that purpose is made known to the supplier); and

      • a statutory guarantee that those services, and any product resulting from those services, will be of such a nature, and quality, state or condition, that they might reasonably be expected to achieve the result that the consumer wishes to achieve (as long as that wish is made known to the supplier or a person with whom negotiations have been conducted in relation to the acquisition of the services.

      Excluding, Restricting or Modifying Your Rights:

      Under section 42 of the Fair Trading Act 1987 (SA), the supplier of recreational services is entitled to ask you to agree to exclude, restrict or modify his or her liability for any personal injury suffered by you or another person for whom or on whose behalf you are acquiring the services (a third party consumer). If you sign this form, you will be agreeing to exclude, restrict or modify the supplier's liability with the result that compensation may not be payable if you or the third party consumer suffer personal injury.

       

      Important:

      You do not have to agree to exclude, restrict or modify your rights by signing this form. The supplier may refuse to provide you with the services if you do not agree to exclude, restrict or modify your rights by signing this form. Even if you sign this form, you may still have further legal rights against the supplier. A child under the age of 18 cannot legally agree to exclude, restrict or modify his or her rights. A parent or guardian of a child who acquires recreational services for the child cannot legally agree to exclude, restrict or modify the child's rights.       Agreement to exclude, restrict or modify your rights:

      You agree that the liability of Motorsport Australia and the Entities for any personal injury that may result from the supply of the recreational services that may be suffered by You (or a person for whom or on whose behalf You are acquiring the services is excluded.

      DEFINITIONS

      a. Claim means and includes any action, suit, proceeding, claim, demand or cause of action however arising including but not limited to negligence, BUT does NOT include a claim under a Motorsport Australia insurance policy by any person expressly entitled to make a claim under that insurance policy;

      b. Entities means event and competition organisers/promoters/managers, land and track owners/managers/administrators/lessees, Motorsport Australia affiliated clubs, state and territory governments and insured listed in Motorsport Australia’s public/product/professional indemnity insurance policies and each of their related bodies corporate (including their related bodies corporate) and each of their organs and agencies, officers/president/directors/executives, employees, servants, agents, partners, providers, members, competitors, drivers, co-drivers, navigators, officials, crew members, pit crew, delegates, licence holders, representatives, commissions, committees, advisers, trustees, councils, panels, shareholders, volunteers, officials, appointees, delegated bodies and sponsors.

      c. Motorsport Activities means any motorsport activities or Recreational Services which are permitted or approved which Motorsport Australia regulates or administers or otherwise under the responsibility / control of Motorsport Australia;

      d. Motorsport Australia means the Confederation of Australia Motor Sport Ltd. trading as Motorsport Australia;

      e. Reckless Conduct means conduct where the supplier of the recreational services is aware, or should reasonably have been aware, of a significant risk that the conduct could result in personal injury to another person and engages in the conduct despite the risk and without adequate justification;

      f. Recreational Services means (unless otherwise defined in this document) services that consist of participation in:

           i. a sporting activity; or

           ii.  a similar leisure time pursuit or any other activity that:

                 A. involves a significant degree of physical exertion or physical risk; and

                 B. is undertaken for the purposes of recreation, enjoyment or leisure.
