3.0 PERIOD
The contract is not pensionable. The period of the contract is for 6 probationary period followed by evaluation by management. After this evaluation, if deemed appropriate by management, a fixed 2 year contract will be adopted.
4.0 TERMINATION
The Organization may terminate the contract without notice if the Employee is in serious breach of the contract. This includes but is not restricted to:
* Any material dishonesty, gross misconduct, or neglect of duty.
* Deliberate failure to follow the Organization policies and procedures.
* Breach of the duty of fidelity.
* Any conduct likely to bring the Employee or the Organization into dispute, including any conduct that renders him/ her unsuitable to perform the duties required.
* Any physical, verbal, sexual abuse or violent action towards, but not limited to, any employee, patient, client, family member, or visitor affiliated with Love One International, or any violent act against any property belonging to or affiliated with Love One International. Termination of this severity could be followed by criminal charges.
** The Disciplinary policy is as follows:
-Verbal warning: for first offense. This verbal warning is documented in the supervisor's employee chart, along with a plan to assist employee in not making transgression again.
-Written warning: If employee commits another transgression, a written warning will be given to employee which he/she must sign. This is put in to the chart. This is a serious warning and another transgression will result in termination.
-Termination
5.0. LOCATION:
The employee will work out of both the office in Masindi, and Gulu depending on the need.
6.0 LEAVE:
Sick, Compassionate, Maternity, Paternity, Vacation
6.1. The employee is entitled to four (4) paid sick days per this contract. For any Illness over three (3) days, the employee must return with doctors note and sick leave forms must be filled out and signed by supervisor within 24 hours of the return to work.
*Where an employee becomes temporarily incapacitated due to a prolonged illness, the employee will continue to receive wages and applicable benefits for the first 60 calendar days of such incapacity. After 60 calendar days, if the sickness persists, the employee will receive half wages for the next 60 days. After 120 days, if all available sick leave has been exhausted, the employee will be placed on un paid leave for the next 60 calendar days but will maintain employee position. If at the expiration of 180 calendar days the incapacity of the employee continues, the employer is entitled to terminate the employment.
*In the event of chronic/disabling mental/physical illnesses, management shall request the opinion of at least two registered medical practitioners to determine the employee's fitness for continued employment or retirement on medical grounds.
6.2. Compassionate leave: 3 days+/- at discretion of the team leader. This is per 30 days period.
6.3 Holidays: Love One International observes some local and international holidays. (see list below). Love One International administrative offices will be closed on these days. If a staff member is required to work on a holiday, a compensatory leave day will be granted. The employees direct supervisor along with the Organizational Director, must approve this. The leave form should be used to document the comp day.

6.4. Vacation: As per Ugandan law, Love One International employees will be entitled to 21 days of paid annual leave for each completed year of service (at a rate of 1.75 days per month). Employees may not borrow against leave that has not yet been earned. Staff members are expected to use all of their leave days that are earned. In order to ensure that leave is taken in a regular and consistent manner, Love One International mandates that employees must take a minimum of 4 leave days per quarter. At the end of each quarter, Love One International will deduct 4 leave days from the employee’s balance, whether or not the leave has been taken. This is intended for employees to take leave on a quarterly basis, and not stockpile leave days until the end of each year.
**In some cases, it may be necessary for a supervisor to deny a leave request due to unusual workload requirements. In such cases, the supervisor must notify the HR officer in writing of this decision, and must find a suitable time for the employee to take the requested leave within the following two months.
6.5. Maternity Leave: Maternity leave will be granted only to female staff. A total of sixty (60) paid working days will be allowed upon giving birth or miscarriage of which at least 40 days shall follow the childbirth or miscarriage. The eligible staff is permitted to leave work 4 weeks prior to the anticipated date of delivery, or may use the allocated days in the manner she chooses. Staff may use their sick and annual leave to extend their maternity leave. After exhausting their maternity, sick and annual leave balances, a staff may request for leave without pay approved by Director.
6.6. Paternity Leave: Paternity leave will be granted only to male staff upon the birth of a son or daughter or miscarriage. Only 4 days in the year will be allowed for male employees. Staff may use their annual leave and sick leave to extend their paternity leave. This leave is valid with immediate effect after childbirth or miscarriage, it may not be taken later.
6.7. Unpaid leave: Love One International may provide leave without salary on a case-by-case basis. Leave without salary must be approved in advance by the Employee’s direct supervisor and signed off on by the Director. If unauthorized leave is taken, salary will be deducted on a pro-rated basis for the number of days taken and appropriate disciplinary action will be taken. Leave without pay will not normally exceed 14 days. Staff members that are gone longer than 14 days will be terminated unless the Love One International Board determines otherwise. At the discretion of the Director, he/she may grant leave beyond the leave listed above on extraordinary circumstances. Unpaid leave shall be taken after all outstanding leave has been taken. All benefits shall cease during the period of unpaid leave.
7.0 CONFIDENTIALITY:
7.1 As a result of employment at Love One International, Employees may acquire and have access to confidential information belonging to Love One International of a special and unique nature and value, relating to such matters as Love One International personnel, patient/family information and compensation information. As a condition of employment, Employees agree that all such information is the exclusive property of Love One International, and he/she will not at any time divulge or disclose to anyone, except in the responsible exercise of his/her job, any such information, whether or not it has been designated specifically as “confidential.”
7.2 Love One International’s information and technology resources must also be protected from internal and external threats to information integrity, availability and confidentiality. Compliance with information security policies, standards and procedures is mandatory. This applies to the integrity, availability and confidentiality of information obtained, created, or maintained by employees, third parties and joint ventures with other organizations.
7.3 This includes paper documents, electronic data formats, and all computer-related activities across computer platforms.
8.0 WORKING HOURS
8.1 Being a health facility, hours of operation are 7 days a week/24 working hours a day. Working week consists of 40 hours per week and schedule to be given by the supervisor. The working hours does not include the one hour taken for lunch.
8.2 Any approved overtime will be given in compensatory time on a day decided by the employee and agree upon by his/her supervisor and the organizational Director.
9.0 NOTICE:
9.1 Either party may terminate this contract and minimum period of notice to be given as by Labor Law-(Employment Decree 1975):
*One week if the service has lasted less than twelve months
*Fifteen days if the service has lasted at least twelve months but less than three years
*One month if the service has lasted at least three years but less than five years
*Two months if the service has lasted at least five years.
*Three months if the service has lasted at least ten years.
9.2 An Employee may terminate his service by giving a notice period as per labor law the (Employment decree Act 1975) in writing to the Board or Director. An employee could serve the notice or pay in lieu to the employer. The employer shall pay all the final dues to the employee at the end of the notice period. He/she shall be paid salary up to and including the last day on which he was present on duty. Love One Uganda, as the Employer, shall do likewise.
9.3 An exiting employee shall be issued with a Certificate of Service on request when he/she leaves the organization’s service whether on his own accord or through termination under the provision of these Terms and conditions of service.
10.0 CONFIDENTIALITY AND CONFLICT OF INTEREST
10.1 The Employee will not disclose either, during or after the termination of his employment any information of a confidential nature relating to the Organization, its customers, Beneficiaries, student/pupils or any third party that may have been obtained in the course of his/her employment without first obtaining the written permission of the Organization.
10.2 The Employee will not make any public statement or any statement to a person employed or associated with the media concerning the Organization, its suppliers, customers, students/pupils, Beneficiaries or their activities without first obtaining the written consent of the Board of Directors.
10.3 The Employee will not place himself in a position in which his interest conflicts with that of the organization.

11.0 WORKING FOR OTHER ORGANIZATIONS/INSTITUTIONS
11.1 The employee shall not, during the employment, work for any other organization/institution without obtaining the written consent from Love One International. Such consent shall not be unreasonably withheld.
12.0 RESTRICTIONS
12.1 The Employee shall not for a period of Twelve (12) months prior to the termination of his/her employment directly/indirectly on his own behalf of any third party induce, solicit or endeavor to entice away any managerial, professional, technical employee or representative with whom he/she had direct contact in the twelve (12) months prior to the termination of his/her contract.
13.0 POLICIES
13.1 The Employee is required to comply with any policies that Love One International may issue from time to time.
14.0 REPLACEMENT
This contract supersedes any agreement or arrangement that may have been made between the parties.
15.0 LAW OF THE CONTRACT
This contract is subject to Ugandan laws.
