    N.A.B.A. TERMS AND CONDITIONS FOR PLAYERS 2021/22:

     

    1.            AGREEMENT IN RESPECT OF TRAINING AND AVAILABILITY

     

    1.1          The Player agrees to become a member of the Academy for the defined period within the identified season

    1.2          The player will make himself available for all training and games within the Academy-at least 90% attendance is expected.

    1.3          The Academy will provide the Player with training and training facilities within the stated period

     

    2.            THE PLAYER’S OBLIGATIONS:

     

    As a member of the Academy the Player accepts the following obligations:

    2.1          To undergo a full physical evaluation on arrival.

    2.2          The player will be offered accommodation advice only by the Academy. The cost will be negotiated directly by the provider and payment will be direct to them. Unless otherwise agreed.

    2.3          The Player is responsible for their own transport to and from the Academy and club practices.

    2.4          To adhere to Accommodation rules as set out by the provider-where a player is asked to be removed from the academy sourced accommodation, it will be the player and the player's responsibility to find an alternative source-should an an alternative source not be found that is deemed appropriate by the academy then the player will be loose his membership to the academy with no refund.

    2.5          A commitment to work towards achieving full potential in his/her sporting career and goals, if applicable.

    2.6          To attend all training, testing sessions and workshops as identified and requested by the Academy, unless where otherwise authorized by the Coach in advance

    2.7          To comply with all training requirements, inclusive of maintaining an appropriate level of fitness, as required by the Director or Coach, and to respond in a positive manner to feedback, advice or recommendations by the Head Coach or Director.

    2.8          To participate in all Academy and academic program classes.

    2.9          To participate in all competitions nominated or approved by the Academy.

    2.10        To participate in all research studies, nominated or approved by the Academy.

    2.11        To maintain at all relevant times his/her status as a registered member of the identified Irish and euro leagues.

    2.12        To inform the Academy of and discuss openly with it any change in circumstances that may affect the Player’s eligibility for or continued participation in the Academy programme.

    2.13        To wear the appropriate Academy uniform during training, competition events, media interviews, public related activities and at such other occasions as may be specified or required by the Academy.  The Player shall not wear the Academy uniform as a general item of clothing or permit the uniform to be worn by a third party who is not a current member of the Academy.

    2.14        The Player will be liable for the cost of any damages caused by him resulting from his negligent or criminal behaviour-fees paid will not be returned should premises where a player is living to be damaged in any way should it be associated to the academy. In all cases, Accommodation should be kept neat and tidy and appearance should be of the highest standard at all times whilst a member of the academy.

    2.15        To respect and abide by the law and spirit of the game of Basketball and accept both victories and defeat with dignity and grace.

    2.16        To behave and dress in a dignified manner when representing the Academy both on and off the Court.

    2.17        To refrain from smoking or consuming any substance that is detrimental to the Player’s sporting or athletic performance.

    2.18        The Player may consume alcohol in moderation at Academy social functions, only if over the age of 18 years and at the discretion of the Coach. Any excessive alcohol use outside of the academy main deem the player ineligible to continue in the program and could lead to dismissal of the player from the academy. Under no circumstances should an academy player/member be consuming alcohol during weekdays when academy training is in place. Where a player showing signs of alcohol consumption the night before academy duties or has been suspected of missing academy activities due to alcohol consumption the player will be subjected to disciplinary procedure up to dismissal from the Academy.

    2.19        To provide support and co-operation with any promotional or fundraising activity or like event undertaken by the Academy.

    2.20        To disclose in writing to the Coach of the Academy any commercial agreements or obligations that the Player may have, including contractual arrangements and obligations with agents, clubs, employers, academic institutions or sponsors.

    2.21        To notify the Coach and Academy Director in writing before entering into or participating in any private sponsorship arrangement with or accepting monies or other benefits from any private sponsor and consulting with the Coach and Academy Director regarding whether any such arrangement might clash with the sponsorship arrangements with the Academy.

    2.22        Not to accept money or other benefits from any Tobacco or tobacco-related company.

    2.23        In the Player’s dealings with the media, the Player must:

    2.23.1    Wear the official Academy uniform

    2.23.2    Make every possible effort to acknowledge the support of the Academy and offer a positive perspective about the academy; and

    2.23.3    Not disclose without the prior approval of Coach or the person authorised by the Academy for the purpose, any information relating to policy matters of the Academy.

     

    3.            DRUG TESTING

     

    The Player acknowledges and agrees to the following:

    3.1          The Player will make every effort to become aware of and understand his obligations under the FIBA doping provisions applicable to the sport of Basketball and the consequences any breach of such provisions.

    3.2          On Request, to provide a sample of his own bodily fluid for analysis by the by the Academy for laboratory testing

    3.3          The Player consents to the Academy communicating the results of such tests to the relevant sporting body.

    3.4          The Player will adhere to and comply with any legislation dealing with drug testing or doping applicable to the sport of Basketball.

     

    4.            ANTI-HARRASMENT

     

    4.1          The Player will make every effort to become aware of and understand the Player’s obligations regarding harassment and the Academy’s policy of anti-harassment in Basketball.

    4.2          The Academy’s policy of anti-harassment aims to deal effectively and appropriately with offensive, abusive, belittling or threatening behaviour directed towards a co-sportsman or opponent whether on the court or off.

    4.3          The Player shall refrain from acting in any manner in an abusive or belittling manner towards any other person or group on basis of their gender, race, disability, sexual orientation, age or status whether as a sportsman or otherwise.

     

    5.            MEDICAL HEALTH INSURANCE

     

    5.1          The Player hereby acknowledges that the Academy will in no manner be liable for any medical, dental, ophthalmological or hospital costs incurred due to any injury suffered by the Player incurred during any session or otherwise.

    5.2          The Player acknowledges his/her responsibility for taking out and obtaining adequate medical, hospital and ancillary health insurance which is Valid in the residing country.

    5.3          The Player further authorises any medical practitioner, sports scientist, physiotherapist or other therapists whom he/she at any relevant time consult, to provide the Academy with such full details of his/her injury or illness which may affect his performance as a sportsman and availability for selection as a basketball Player.

     

    6.            PROBATION

     

    6.1          The Player agrees that he will be on probation during a period of 2 (two) months after the commencement of the programme. Should the player behave in an unprofessional or improper manner the Programme Manager may at his discretion exercise the right to expel the player with no disciplinary procedure and no reimbursement of any fees paid to date.

    6.2          The Academy may review the Player’s participation in the programme and membership to the Academy at the end of the said probation period-and if necessary, extend this probation period should there be just cause.

     

    7.            BREACH OF CONTRACT

     

    7.1          The Player will act in breach of the terms of this contract if the Player acts in any manner or takes part in any action which brings the good name of the sport of basketball or the good name of the Academy or the good name of the Irish Leagues or the sponsor into disrepute, inclusive of but not limited to the following:

    7.1.1       If the Player is suspended from competition by an affiliated Board, the leagues or any national or international sporting organization.

    7.1.2       If the Player provides false information to the Academy.

    7.1.3       If the Player fails to observe or perform any of his obligations under this agreement.

    7.1.4       If the Player refuses or declines to provide samples of his bodily fluids when called to undergo drug testing referred to in Clause 3 above, or if any such test or sample results in the detection of a prohibited drug or stimulant or prohibited substance.

    7.1.5       If the Academy is not satisfied with the Player’s performance or behaviour within the duration of this contract.

     

    7.2          Should the Player be in breach of this agreement as stated above and below, the Academy will be entitled to cancel their agreement with the Player forthwith.  In the event of such cancellation, the Player will return to the Academy uniform, equipment, training materials or other property of the Academy within one week of such cancellation-no refund of fees is offered to players in breach of this agreement.

    7.3          Should the Player terminate the contract with the Academy he will notify the Academy of such termination at least 30 days before such termination.

    7.4          If the Player terminates the contract within the duration of this contract, he will forfeit all fees paid to the Academy

     

    8.            ATHLETE ETIQUETTE

     

    8.1          The Player must comply with the Athlete Etiquette as set out hereunder.

    8.1.1       The Academy is designed to assist and help the Player to achieve his optimum and full potential skills in the game of basketball, but it is the Player’s responsibility to access the programme and services available to him to ensure that he meets the requirements of the programme.

    8.1.2       The Player is required to list a number of performance goals/measures which he and the coach will set for the upcoming season or year.  The Academy will review these goals on an ongoing basis throughout the period of the programme.

    8.1.3       The Player must attend all appointments, practices, matches and other sessions on time.

    8.1.4       If the Player is unable to make such appointments or sessions on time, notice must be given prior to the scheduled appointment time.

    8.1.5       If the Player is unable to attend any session, the Player must contact the Coach during the 24 hours prior to the session.  If the Player fails to attend the sessions, organised by the Academy, without prior notification, such failure will be seen as a direct breach of the terms of agreement and his continuation as a member of the programme could be reviewed.

    8.1.6       Should the Player fail to comply with any of the above requirements, the Academy may, by written notice to the Player, place such Player on probation for a period specified in the notice or terminate the contract forthwith without reimbursement of any fees paid.

    8.1.7       The Player must respect not only his/her teammates, coach, staff members and any person involved in his/her participation in this program, but also all the facilities and shared spaces (i.e.: dressing room, court, classroom, office, players’ lounge…), through its proper utilization and maintenance.

    8.1.8       A refundable security deposit of €250.00 will be held for any damage to the Academy’s equipment or if the stated on 8.1.7 is not respected. This deposit is separate to the fees presented below and is fully refundable on successful completion of the school term.

     

    9.            EXCLUSION OF LIABILITY AND INDEMNITY

    9.1          The Players agrees that the Academy or its employees, agents and contractors, will not belittle to the Player or any of his dependents, agents or representatives for any injuries or illness which he may suffer (including death) for any loss of or damage to the Player’s body or property arising out of or in connection with the Player’s participation in the Academy programme.

    9.2          The Player indemnifies the Academy, its employees, agents or contractors against any costs, damages or losses that he may suffer as a result of any action or omission by those indemnified therein and incurred as a result of any injury illness or damage

    9.3          Without imposing any obligation on the Academy, the Player authorises the Academy to do anything on the Player’s behalf (including the incurring of expenses) that the Academy may reasonably consider being necessary for the Player’s benefit in connection with any injury, illness (including death), loss or damage referred to above.

     

    10.         PAYMENT

    10.1.1    Should be made by the agreed deadline dates.

    10.1.2    All payments to the ACADEMY are subject to the academy’s terms of payment below

    10.1.3    In all cases, full academy fees should be paid in full before the player commences in the program, he/she is enrolled.

    10.1.4    NABA PAYMENT TERMS ARE AS FOLLOWS:

    1.     All program fees should be paid to NABA on acceptance of placement unless otherwise indicated

    2.     NABA offer a payment instalment plan as per offer letter

    3.     Where Payment instalment plan is chosen, a 10% surcharge will be added to the quoted cost due. 

    4.     Surcharge will be added at the beginning and spread across all payments. 

    5.     All payments are due on the last day of the subsequent month from the previous or initial payment. 

    6.     As there is significant outlay for all NABA programs, late payments are subject to a 5% surcharge

    7.     If more than 2 payments are late, then the placement offer can be withdrawn with 7 days’ notice. 

    8.     If a student/athlete withdraws following acceptance and payment to the academy has been made, a refund of 75% will be given if within 4 weeks of acceptance and initial payment been made between 4-8 weeks of acceptance and initial payment, 50% of fees paid will be refunded c. After 8 weeks from of acceptance and initial payment, no refund will be given d. In addition to terms 8a, 8b and 8c- Any outlay by the academy will be subtracted from the amount paid in addition-In all cases if the program has already started and the place reserved is take from the start date, no refund is given once a player starts in the program.

    9.     In the case of cancellation of players/student own placement an administration fee of 10% will apply on all refunds due.

    10.  Where possible, NABA management will help facilitate all means of payment from our student/athletes

    11.  All payments to NABA are subject to terms within NABA player agreement

    12.  Program Fees paid to the academy do not include additional grinds or tutoring sessions that may be needed by the student

    13.  Program Fees paid to the academy do not include additional costs for exams, books and uniforms or playing apparel that may be needed by the student to complete the year 

    14.  The academies preference is that all payments are done by EFT to the below details

    15.  In the case of Force Majure, no refunds are offered due to the financial outlay and commitments the academy has already committed too year on year.

     

     

     

     

     

    11.         Accommodation

     

    Accommodation is not provided as part of this placement agreement-Any conditions of accommodation are to be dealt directly with the accommodation provider and agreement should be reached directly with them and is of no responsibility of the academy

     

    12.         ACKNOWLEDGMENTS

     

    12.1        The Player acknowledges and agrees that any information which may be held by the Academy regarding the Player’s participation in the Academy programme and the results of any sports science tests may be used as and for research purposes and published in scientific journals and disclosed to the leagues and to national sporting organisations.

    12.2        The Player acknowledges and agrees that information of a biographical nature, including the Player’s name, date of birth, performance results, career highlights, hobbies and interests, may be released to the public and media.

    12.3        The Player and players family acknowledges and agrees that photos and videos taken during the academy activities will be used for promotional purposes during and at any time in the future.

    12.4        The Player acknowledges and agrees that any approach by a third-party club/agent/academy/governing body/area board their agents, subsidiaries or partner franchises must be reported to the Academy management and such breach of this policy will result in immediate dismissal from the Academy

    12.5      The player and the players family acknowledge were a player is persistently in breach of the academy Terms and conditions that the academy operate on a three ‘’strikes and your out’’ policy- This policy is in place to protect the player, his/her peers and the academy -Under no circumstances can continuous ‘bad behaviour’’ be tolerated by the academy management team. 

    12.6      By signing our Player agreement both player and players parents understand and accept the full academy terms and conditions and willing to proactively work with the academy staff to ensure the best possible outcome for their child while being a member of NABA.

    12.7      The player and the players family acknowledge that all aspects of the commercial offering from the academy to the player are strictly confidential and that any proven breach  of this will deem any agreement invalid and void and that full fee will apply to you.

    12.8      Where a player is receiving a concession/partial scholarship on academy program costs, a minimum of 6 hours of community service will be provided in helping the academy develop the game of basketball in the local community

     

     

    Declaration of Health: COVID-19

     

    By agreeing with these terms and conditions you are declaring and confirming that:

     

    ·        You have not had any of the following symptoms in the last 14 days:  sore throat, cough, fever 38C or above, Breathlessness etc or / Other: specific by email to development@northatlanticbasketballacademy.com

     

    ·        You have travelled outside the country in the last 14 days, please specify travel details in an email to development@northatlanticbasketballacademy.com giving name of country, date of arrival and date of departure. If you are attending our academy from another country , you will be required to quarantine for 10 days as per Irish government guidelines before you attend our academy for any program.

     

    ·        You or any immediate family member have come in close contact with a confirmed case of the coronavirus in the last 14 days.

     

    ·        If there are any other details you feel you need to declare in relation to COVID-19 

    or knowledge of contact outside of the above, please contact us and your GP.

     

    ·        Please ensure hygiene (respiratory hygiene and handwashing) etiquette while present in our facilities. Please use the hand sanitising stations located among the building.

     

    ·        Maintain a 2-metre distance from staff and other club members at all times.
