    This agreement outlines the terms and conditions of a Guardian Home arrangement

    between the Guardian(s) and Heather Wilson of Kisses and Cuddles Chihuahuas  (referred to herein as “the Breeder”).

    2. Ownership

    Ownership of the dog remains with the Breeder until the dog reaches 5 years of age 

    females and 7 years for males. After that, legal ownership will be transferred to the

    Guardian(s) in writing. All litters produced by the female or semen collected from the male

    remain the sole property of the Breeder.3. Breeding Terms

    For Female Dogs:

    - Expected to have 4 litters, provided she remains in good health.

    - Breeding will not continue past 5 years old.

    - She will be returned to the Breeder during her heat cycle for breeding.

    - If pregnant, she returns to the Breeder approximately one week before her due date

    (gestation is ~63 days).

    - She stays with the Breeder until the puppies are weaned at 8 weeks, then returns to the

    Guardian.

    - No vaccines should be administered during pregnancy. Antibiotics or medications should

    be approved for pregnant dogs and checked with the Breeder.

    For Male Dogs:

    - Males may be used for breeding until approximately 5 years of age, assuming continued

    good health and fertility.

    - The dog will need to be made available to the Breeder for breeding, and any required

    fertility or health testing.

    - Advance notice will be given whenever possible, but flexibility is required, as female

    ovulation timing is unpredictable.

    - If natural breeding the male dog will typically be returned the 7-10 days later. Some females can take longer to breed, but having the Male present helps identify the right time.

    The male may be returned sooner if they start breeding right away.

    - Guardian(s) are expected to maintain the dog in good health, and promptly report any

    behavioral or physical concerns that might affect fertility.

    4. Breeder Responsibilities

    - Covers all veterinary expenses related to breeding and required health testing (e.g., OFA

    hips, eyes).

    - Provides all care and veterinary attention while the female is with the Breeder for

    breeding and whelping.

    - Since vaccinations are not given during pregnancy the Breeder will update any

    vaccinations needed when the puppies are weaned and before they return the female to the

    Guardian.

    5. Guardian Responsibilities

    Provide general vet care, including:

     


    Routine care such as vaccinations and annual checkups.

    - All treatments must be reported to the Breeder with documentation.No elective procedures (e.g., spaying, surgeries) without written approval from Breeder.

    Maintain a healthy environment and exercise to avoid being overweight.

    Feed high-quality food according to the Breeder’s guidelines to avoid dogs being under or

    overweight.

    - Ingredients in major dog food brands to avoid as they can negatively affect reproduction:

    peas, lentils, chickpeas, soy, flaxseed, canola/vegetable oil, corn or wheat as 1st ingredient.

    Not chronically crate the dog for more than 4-6 hours per day on a regular basis.

    Make the dog available for breeding and required vet visits with reasonable notice.

    The dog may not be used for breeding by anyone other than the Breeder.

    All household members must understand and comply with this agreement.

    6. Penalties for Breach

    The Guardian agrees to pay $10,000 to the Breeder if any of the following occurs:

    - Unauthorized spaying or neutering.

    - Injury or death caused intentionally or through negligence.

    - Refusal to return the dog or ceasing communication.

    - Transfer of the dog to anyone other than the Breeder.

    7. Illness, Injury, or Death

    In the event of illness or injury, the Guardian must seek immediate veterinary care and

    notify the Breeder.

    Emergency treatment is allowed, but ongoing care decisions must involve the Breeder.

    If the dog dies due to negligence, the Guardian agrees to pay $4,000.

    Negligence includes:

    - Leaving the dog unsupervised or uncontained.

    - Failure to use a leash or secure fencing, leading to the dog escaping or being injured

    - Leaving the dog in a hot vehicle.

    - Allowing access to toxic substances.

    - Failure to treat known medical issues in a timely manner, including visible infections,

    limping, vomiting, diarrhea, or abnormal behavior.

    If death occurs due to circumstances beyond the Guardian’s control, no penalty applies.

    Examples include:

    - The dog develops a congenital health condition or genetic disorder.

    - The dog passes away during or following surgery performed with Breeder’s consent

    - The dog suffers fatal injury or illness during a natural disaster (e.g., tornado, flood, fire).

    - The dog chokes or suffocates on a toy or object designed for dogs and labeled safe, with

    no prior indication of risk.8. Ownership Transfer

    At the end of the contract (or sooner if agreed upon), the dog will be spayed/neutered at the

    Breeder’s expense, and legal ownership will be transferred to the Guardian(s).

    9. Return of Dog

    The Guardian may return the dog to the Breeder at any time, for any reason, thereby

    terminating this agreement.

    10. Communication & Updates

    Guardian(s) agree to provide regular updates, including photos or videos, to the Breeder

    every 2–3 months or upon request.

    11. Training & Socialization Requirements

    Guardian(s) agree to ensure the dog is properly socialized and trained using positive

    reinforcement methods. Group puppy training classes are highly recommended. Dogs must

    not be subjected to aggressive training techniques.

    12. Travel & Relocation Notification

    Guardian(s) agree to notify the Breeder of any travel plans exceeding 48 hours. If the

    Guardian plans to move residences, they must notify the Breeder at least 14 days in

    advance. New living arrangements must meet normal standards for care such as a securely

    fenced yard (not applicable for apartments), free of hazards, dog must sleep indoors, and if

    other animals are present they are dog-safe and not aggressive.

    13. Grooming Requirements

    Guardian(s) agree to maintain regular grooming (every 6–8 weeks) and keep the coat

    brushed and free of mats. If matting is severe or persistent, Breeder reserves the right to

    schedule professional grooming and bill the Guardian.

    14. Reimbursement for Missed Litters

    If a Guardian’s actions (e.g. missing a heat, failure to return for breeding, unauthorized

    treatment) prevent the dog from fulfilling breeding obligations, the Breeder may seek

    reimbursement up to $2,000 per missed breeding opportunity.15. Right to Reclaim Dog

    Breeder reserves the right to reclaim possession of the dog if Guardian(s) fail to meet the

    terms of this contract or if the Breeder has reasonable concerns for the dog’s health, safety,

    or well-being. No compensation shall be due to the Guardian in this event.

    16. Photo/Marketing Use Permission

    Guardian(s) grant the Breeder permission to use the dog’s photos and name for marketing,

    social media, and website purposes.

    This document represents the full agreement between the Breeder and Guardian. No verbal

    or written warranties outside of this contract apply.__
