The annual storage fee for the above-mentioned dog is due for renewal. Please review the terms listed below, sign and date at the bottom of this form. The Village Veterinary Medical Center annual storage fee is $89.96 for up to 30 inseminations per dog. Please return signed copy of this form along with payment to Village Veterinary Medical Center. We will also be sending an option for electronic payment to follow this form.
Late payment is subject to a 1.5% per month (18% APR) interest with a minimum $4.50 late fee per month. After 90 days of non-payment, the account will be placed in inactive status. There will be a $20 fee for reactivation. After 180 days (6 months) of non-payment, the frozen semen will be subject to disposal and the account submitted to a collection agency. Accounts must be current in order for frozen semen to be released. The semen owner is repsonsible for keepng account and contact information up to date. Failure to maintain accurate contact methods by the semen owner are not valid reasons for account status being overdue.
Village Veterinary Medical Center provides semen collection, freezing and storage which are charged at the time of collection. Storage is charged annually. There are additional fees charged by Village Veterinary Medical Center when the stored semen is prepared and shipped for breeding or transfer. These fees are usually termed shipping preparation, shipping tank rental, and actual shipping charges to ship the semen to its destination and for the return of our empty tank. These fees will vary, depending on quantity and destination of the frozen semen.
I understand that Village Veterinary Medical Center shall not be responsible for loss or accidental thawing of semen which results from (i) storage failure; (ii) any act by non-employees of Village Veterinary Medical Center (or its affiliates) who may be retained to transport semen; (iii) any acts by employees or agents of Village Veterinary Medical Center or its affiliates unless such acts constitute gross negligence; or (iv) from any other cause beyond the reasonable control of Village Veterinary Medical Center, including, but not limited to acts of government, acts of nature, fire, explosion, typhoon, flood, earthquake, tide, lightning or war. If any of the foregoing events occur, Village Veterinary Medical Center's sole liability will be the return of any prepaid fees. IN NO EVENT SHALL VILLAGE VETERINARY MEDICAL CENTER BE LIABLE UNDER ANY LEGAL THEORY FOR ANY LOST PROFITS, EXEMPLARY, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING THE VALUE OF ANY ANIMAL SEMEN, WHICH ARE HEREBY EXPRESSLY EXCLUDED BY AGREEMENT OF THE PARTIES REGARDLESS OF WHETHER VILLAGE VETERINAY MEDICAL CENTER HAS BEEN ADVISED OF EITHER THE POSSIBILITY OF SUCH DAMAGES OR OF THE VALUE OF THE SEMEN. NO FUTURE LOSSES, PSYCHOLOGICAL DAMAGES OR UNNECESSARY PROCEDURES WILL BE COMPENSATED.
Owner shall indemnify and hold harmless Village Veterinary Medical Center and its affiliates, veterinarians, employees, and agents from any and all claims, actions, lawsuits, expenses, including reasonable attorney’s fees, and any other damages or monetary loss incurred in connection with the use of frozen semen in a breeding or otherwise
Sperm cells will eventually cease living, but no one knows or can predict when this will occur, and it can vary from dog to dog. Village Veterinary Medical Center shall not be held liable for, and cannot guarantee conception from frozen canine semen. Nor can Village Veterinary Medical Center guarantee that the frozen sperm cells will be viable at the time of thawing for insemination.
