This Release and Waiver of Liability (the “Release”) executed on the date indicated above by the Volunteer or Tutor named above ("Volunteer) in favor of Tacoma Area Literacy Council, a nonprofit corporation organized and existing under the laws of the State of Washington and each of its directors, officers, and agents (collectively “TALC”).
The Volunteer desires to provide services as a volunteer for TALC and engage in the activities related to being a volunteer for TALC (the “Activities”). The Volunteer understands that the Activities subject to this Release relate to all volunteer services provided by the Volunteer for TALC, wherever the Activities may take place.
The Volunteer understands and acknowledges that the scope of the Volunteer’s relationship with TALC is limited to a volunteer position and that no compensation is expected in return for services provided by the Volunteer; that TALC will not provide any benefits traditionally associated with employment to the Volunteer; and the Volunteer is responsible for the Volunteer’s own insurance coverage in the event of personal injury or illness as a result of the Volunteer’s service to TALC. TALC reserves the right to terminate the Volunteer’s relationship with TALC at any time for any reason.
The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms:
1. Waiver and Release : The Volunteer releases and hold harmless TALC and its successors and assigns from any and all liability, claims, and demands of whatever kind of nature, which arise or may hereafter arise from the volunteer services the Volunteer provides to TALC. The Volunteer understands and acknowledges that this Release discharges TALC from any liability or claim that the Volunteer may have against TALC with respect to bodily injury, personal injury, illness, death, or property damage that may result from or occurring while the Volunteer is providing the Activities.
2. Insurance: Further, the Volunteer understands that TALC does not assume any responsibility to provide the Volunteer with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance, and the Volunteer understands and acknowledges that no such financial or other assistance will be provided. The Volunteer expressly waives any such claim for compensation or liability on the part of TALC.
3. Medical Treatment: The Volunteer hereby Releases TALC from any claim which may arise on account of any first-aid, treatment, or other medical services rendered to the Volunteer in connection the Volunteer’s Activities.
4. Assumption of Risk: The Volunteer expressly and specifically assumes the risk of injury or harm associated with the Activities or otherwise occurring while providing volunteer services to TALC, and the Volunteer releases TALC from all liability related in any way to the Activities.
5. Non-disclosure: Information and documents provided to Volunteer by TALC in connection with Volunteer Activities, including, without limitation, organizational information, contact information of other volunteers, and information regarding student(s) or other participants (collectively, “Confidential Information”), is proprietary and confidential. Volunteer agrees not to transmit, disclose, or otherwise reveal to any third party any Confidential Information without the express prior written consent of TALC. Volunteer also agrees not to use any such Confidential Information, except in connection with the Activities.
6. Other: As a volunteer, the Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Washington and that this Release shall be governed by and interpreted in accordance with the laws of the State of Washington. The Volunteer agrees that in the event any clause or provision in this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
