In consideration of participating in the Midwest Battle of the Rims and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence against the Midwest Battle of the Rims and its owners, directors, officers, employees, facilities, agents, volunteers, participants, and any other persons or entities acting for them (hereinafter collectively referred to as a "Release), on behalf of myself, my players, my team(s), my children, parents (including all family), heirs, assigns, personal representative and estate and also agree as follows:
I acknowledge that the participation and the participation of my team in sporting events can involve unknown and unanticipated risks which could result in physical or emotional injury, illness, paralysis, permanent disability, property damage and possible death. Risks include but are not limited to, medical conditions resulting from physical activity, physical altercation, damaged/stolen clothing and or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment and/or precautions set in place.
I expressly accept, on behalf of myself and my team, all the risks inherent in this activity. My and my team’s participation in this event/activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that the event or practice conditions are unsafe or that my players are unable to participate due to physical or medical conditions, then I will immediately discontinue participation per my choice.
I hereby voluntarily release, forever discharge, and agree to identify and hold harmless from all claims, demands, or causes of action which are in any way connected with my participation in the Midwest Battle of the Rims events or my use of their equipment or facilities.
I represent that I, as well as my players, have adequate insurance to cover any illness, injury, or damage I, or my players, may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I, nor my team, have any medical or physical condition which could interfere with the safety in this activity, or else I am willing to assume - and bear the costs of all risks that may be created, directly or indirectly, by any such condition.
Furthermore, I grant full permission, on behalf of myself, my parents and my team, to Midwest Battle of the Rims to use photographs, videos, and other types of recording of me, and/or my players, spectators and staff in any/all advertising, trade or any other commercial purposes in legitimate accounts and promotions of this event. I waive the right to inspect versions of any images used for publication or the written copy used in connection with the images/videos. On contrary, I understand and accept that all photography/videos taken within the event, must first be released/approved by Midwest Battle of the Rims before the use in/by myself, players, parents, or any outside source. This includes being used/shared on personal social media platforms of any kind. If any images or videos are used/shared without the permission of Midwest Battle of the Rims, I understand that I, as well as the responsible party, will be held fully responsible for the legal repercussions that come with using privately owned images from our event.
I agree that if I become ill, hurt or my property is damaged during my participation in any practice, tournament or activity for any reason, with Midwest Battle of the Rims or their affiliates/facilities, I may be found by a court of law to have fully waived my rights to maintain a lawsuit against the parties being released on the basis of any claim for negligence and/or harm.
I have had sufficient time to read this entire document and, should I choose to do so, consult with legal counsel prior to signing. Also, I understand that this activity might not be made available to me if I refuse to agree to the above terms.
I have read and understood this document and I agree to be bound by its terms.
