Atlanta Truck Parking LLC Rental Agreement • Terms and Conditions • Rules and Regulations
1. The Licensee/Driver has entered into this agreement with Atlanta Truck Parking LLC, for the purpose of storage and parking commercial trucks, tractors, trailers, and heavy equipment. This Agreement is effective the date signed below by the Licensee/Driver.
2. Licensor provides a completely fenced, secured, parking yard at: 5857 Lees Mill Road, Forest Park, GA 30297 Phone# 404-362-9988. Office hour staffing are weekdays, Monday thru Friday from 8:00AM To 4:00PM. After Hours contact# 678-439-9405. Security guards and security cameras are present, on-duty and active twenty-four (24) hours a day, seven (7) days a week.
3. Monthly parking payments are due on the first (1st) of each month and will be accepted no later than the third (3rd) of each month. Failure to make payment by the third (3rd) of each month no later than 4:00 PM will result in the following late penalties:
(3.1). A $15.00 late fee is imposed on each vehicle for every day late; an additional increase
(3.2) A $30.00 late fee is imposed on the (10th) day past due on each vehicle, an additional increase
(3.3). A $75.00 late fee is imposed on the (14th) day past due on each vehicle, at which this time vehicle(s) is now deemed as in ‘Default’ status and fees shall accumulate.
4. Payment Methods Accepted: Cash, Money Order, Check, Credit/Debit Card or ACH
(4.1) Atlanta Truck Parking LLC. Charge a convenience fee of 3.50% for all credit/debit transactions.
(4.2) Atlanta Truck Parking LLC. Charge a fee of $10.00 for all ACH online transactions.
(4.3) Customers have the option to pay by mail in the form of a check or money order without any additional fee.
(4.4) All payments regardless of method must be received by due date to avoid late fees.
5. Checks and money orders should be made payable to Atlanta Truck Parking LLC. A service charge of $38.00 will be added to Licensee’s account if any checks are returned for insufficient funds. If Licensor receives more than two (2) returned checks, Licensor will no longer accept checks from the Licensee in the future.
6. Refund of security deposit will be issued upon receipt of Licensee/Driver's (30) day written notice. Licensee/Driver agrees they have maintained compliance throughout this licensing agreement and will vacate the parking yard of the Licensor. Any infraction/violation committed during licensing agreement which resulted in late fees, fines or any other non-compliance automatically creates a "Default". Therefore, NO security deposit refund will be issued and remains in possession of the Licensor. Qualified security deposit refunds are processed and paid on the 10th day of the following month. NO Exceptions!
7. Any Licensee/Driver vehicle(s) stored and/or parked on the Licensor’s parking yard fourteen (14) days late, non-payment is actively in Default status and s a result has Abandoned the vehicle(s). The charge for an abandoned vehicle is seventy-five dollars ($75.00) each vehicle for every day. The vehicle will be towed, booted and/or impounded while Atlanta Truck Parking LLC petitions court order to establish legal ownership of the abandoned vehicle(s).
8. Failure to adhere to the required monthly payment on or before the due date shall be deemed as non-compliant and in current default status. Under the terms of this Agreement all non-payment for (14) days, constitutes an abandoned vehicle. Court order will be adjudicated to provide Atlanta Truck Parking LLC legal ownership of the abandoned vehicle. All Court and administrative cost pertaining to this action is the sole responsibility of the Licensee/Driver. Upon receipt of the court documents signed by Judge, the vehicle(s) will no longer be the property of the Licensee/Driver.
9. Licensee/Driver is required and shall carry both Collison and Liability Insurance on their vehicles with no exceptions. All Licensees/companies must have Workers Compensation on all Drivers/employees that may enter Atlanta Truck Parking LLC's parking yard/facility.
10. No repairs of any kind are allowed on Atlanta Truck Parking LLC's property due to Licensor's compliance commitment with Environmental Protection Agency (EPA) regulations and insurance guidelines. There are no exceptions for any service truck or outside mechanic repairs on this parking yard. No tire repairs, oil changes, minor or major repairs are permitted at any time. Licensee's or outside mechanic companies discovered performing work on a vehicle will receive an immediate demand to vacate the parking yard/facility.
11. Licensor observes any damages to the Licensee/Driver designated parking area, it shall be promptly reported to Licensee in writing, with an opportunity to inspect such damage. If damages are of result to Licensee/Driver negligent actions, actual costs to repair the damages may be deducted from any deposit.
12. Licensee/Driver is responsible for any damages to the Licensor’s property, buildings, gates, parking yard, roadway, lights, fencing or guard shack. Licensee/Driver shall immediately report the accident or damages to security personnel and follow up with photos, email and/or call to office staff. If damages are a direct result due to Licensee’s negligent actions, actual costs to repair the damages may be deducted from any deposit.
13. Licensee/Driver actions or negligence causes damage to another customers vehicle and/or property or cause bodily injury to persons on the parking yard requires an immediate notification to the security personnel. Security personnel will declare Atlanta Truck Parking LLC’s emergency protocol and contact appropriate local authority, if necessary, to ascertain required actions by law and prepare accident report.
14.Licensee/Driver parking of any Vehicle in a non-designated location is strictly forbidden. All of Licensee/Drivers vehicles that park on Licensor’s parking yard has an area that is designated for Licensee only and each Vehicle will have a row and space number.
15. Safety is our number One priority. The maximum speed on the parking yard is three (3) MPH.
(15.1) First Warning, Licensee/Driver is given a written and verbal warning for speeding.
(15.2) Second Warning is a $100.00 fine for speeding on Licensor’s property to be issued to Licensee/Driver.
(15.3) Third Warning, is a $200.00 fine for speeding on Licensor’s property to be issued to Licensee/Driver.
(15.4) Last/Final Warning, Licensee/Driver will be asked to vacate the yard for not obeying the safety rules and regulations of Atlanta Truck Parking LLC.
16. No fluid leakage of any kind are allowed on Licensor’s parking yard. If fluid leakage is observed on Licensor's parking yard, Licensee/Driver will be asked to vacate the parking yard with NO Exceptions. There should not be any loitering or dumping of trash/garbage in parking yard by Licensee/Driver. The Licensee/Driver is responsible for the removal of their own trash/garbage. If trash/garbage is not removed a $75 penalty will be imposed and charged to Licensee/Driver. Dumpsters are provided for trash and garbage only. Rubbish items such as discarded tires are to be removed from the parking yard/facility by Licensee/Driver and must not be placed in dumpsters. Licensee/Driver will incur seventy-five dollars ($75.00) charge per tire for improper disposal if left discarded on Licensor’s parking yard.
17. Fluid leaks must be repaired prior to parking. Truck and trailers must be free of all leaks. There shall be no oil changes or engine work performed on this parking yard. Oil leaks must be cleaned up immediately. Cost of larger spill clean-ups will be charged and billed to the Licensee/Driver.
18. Licensee/Driver is responsible for providing accurate and complete information, any updated contract changes on vehicle(s) and/or equipment, includes such as change in insurance carrier, payment method and other relevant information to Licensor. Licensees/companies must notify Licensor immediately of information on any Drivers no longer actively driving their fleet.
19. Loud noises of any sort {music, television, etc.}, illegal activities, solicitation, violation of other Licensee’s vehicle/equipment will NOT be tolerated on Atlanta Truck Parking LLC's parking facility/yard.
20. Licensee/Driver is not allowed to transport, park or store any vehicle or equipment which may contain hazardous materials, human trafficking, illegal weapons, contraband, illegal drugs/substance materials on Licensor's yard/facility.
21. The Licensee is responsible for their employee (driver), property and/or vehicles while under agreement with Licensor. Licensor is not responsible for any damage or theft which may occur while Licensee's vehicles are stored on Licensor's parking yard. All risks are Licensee/Drivers responsibility.
22. All personal vehicles must park only in the designated area and not on other customers parking areas. Licensee/Driver owns full liability and are solely responsible for their vehicles/trailers and its contents.
23. Atlanta Truck Parking LLC. Prohibits Licensees/Driver from conducting any sale transactions on their property VIA Social Media, Print/Electronic, or Advertising anything that displays “For Sale". Violations will include Licensee’s Truck and/or Trailer being towed/ booted/ impounded at the expense of the owner.
24. Licensee’s Truck and/or Trailer is sold to a buyer that does not have a contract agreement with Atlanta Truck Parking LLC. Licensee agrees they must notify Licensor the equipment has been sold. Licensee must remove the sold Truck and/or Trailer from the property immediately from Atlanta Truck Parking LLC. The new buyer may accompany the Licensee to remove the equipment. If Licensee does not adhere to this process, Licensee is actively non-compliant and in default of this agreement. The Licensor reserves the right to impose any penalty of fees.
25. Licensee/Driver agrees to Hold Harmless Atlanta Truck Parking LLC., all claims, actions, damages, liabilities, and expenses, including attorney's fees and other professional fees, in connection with the loss of life, personal injury and/or damage to property arising from or out of an occurrence in, upon or within use of parking yard/facility. Licensee/Driver maintains all risk and responsibility to include but not limited to natural causes, acts of nature, theft, vandalism, fire, flood, accidental damage, motorist damage, wind, rain, hurricane, earthquake, volcanic, structural damage, tree damage, terrorism, or any type of possible damage or loss. Losses of any kind, theft, vandalism, damages, acts of terrorism, Acts of Nature, Weather, Floods or of any loss is the sole responsibility of the Licensee/Driver. Further by signing this agreement, the Licensee agrees to Hold Harmless Atlanta Truck Parking LLC., from any liability resulting from their Driver/employee use of the parking yard and premises, including damage or liability caused by the Licensee and Driver/employees.
26. Hold Harmless governs and protect Atlanta Truck Parking LLC’s Officers, Officials, Affiliates, Employees and Volunteers from and against any and all claims, suits, actions, or liabilities for injury or death of any person, or for loss or damage to property, which arise out of Licensee's use of Premises, or from the conduct of Licensees business, actions, vehicles, Driver/employee or from any activity, work or actions permitted, or suffered by any of the Licensee's actions.
