Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement

READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE INDICATES YOU UNDERSTAND IT AND AGREE TO ITS TERMS. BY SIGNING THIS AGREEMENT YOU (AND YOUR CHILD) ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR RECOVER DAMAGES IN CASE OF INJURY, DEATH OR PROPERTY DAMAGES FOR ANY REASON, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE STABLE, ITS OWNER, EMPLOYEES AND AGENTS ("THE RELEASEES") INCLUDE, BUT ARE NOT LIMITED TO: ABUNDANT RAIN MINISTRIES INC, ABUNDANT REIN HORSE RIDING CENTER, CHRISTI NG, KYLER NG, RON SPRADLIN, TERRY SPRADLIN, JACLYN LAKE, SADIE RANDALL, HEATHER WAGNER. The Oklahoma Livestock Activities Liability Limitation Act provides that a livestock activity sponsor, a participant or a livestock professional acting in good faith and pursuant to the standards of the livestock industry shall not be liable for injuries to any person engaged in livestock activities when such injuries result form the inherent risk of livestock activities. Oklahoma also has a unique provision that explicitly states that Livestock Activities Liability Limitation Act (citation: OK ST T.76, 50.1).

In consideration for allowing me (or my minor child) to handle and ride a horse on behalf of myself, my child or our personal representative, heirs, next-of-kin, spouses and assigns, I HEREBY:

Expressly agree that the foregoing release and assumption of risk, and indemnity agreement is governed by the laws of the State of Oklahoma and is intended to be as broad and inclusive as is permitted by Oklahoma Law, and that in the event any portion of this Agreement is determined to be invalid or enforceable for any reason, the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effort.

I HAVE READ THIS DOCUMENT. I UNDERSTAND IT IS A PROMISE NOT TO SUE AND TO RELEASE THE STABLE, ITS OWNERS, EMPLOYEES AND AGENTS FOR ALL CLAIMS. I HAVE MADE A FREE AND DELIBERATE CHOICE TO SIGN THE RELEASE AND WAIVER AS A CONDITION TO RELEASEES ALLOWING ME OR MY CHILD TO RIDE OR HANDLE A HORSE. I HAVE CONCLUDED THAT THE RISKS INVOLVED AND THE RELEASE AND WAIVER OF LIABILITY IS WORTH THE PLEASURE OF HORSEBACK RIDING EXPERIENCE.

We require a 24 hour notice for cancellations as a courtesy to other riders who may be waiting for appointments. We understand that conflicts may arise, and we will be happy to reschedule your appointment if possible. If you are a no show, without notice, we reserve the right to bill you in full for that appointment. Any cancellations which may occur in less than the 24 hour notification zone may be billed for their lesson fee. Riders who pay in bulk and need to cancel may forfeit their lesson. Abundant Rein will offer makeups if they are available but is not required to add an extra lesson time for their week. I understand that I may forfeit prepaid lessons if I cancel my scheduled time.

I understand if at any time I cancel my enrollment at Abundant Rein, there is a "no refund" policy for lessons I have already booked and prepaid for. If a participant chooses to pay a tuition fee for lessons in advance, I understand that Abundant Rein does NOT give refunds on these lessons. All funds must be used within one calendar year of payment date. Payments do not role over to the next year. If a student plans to cancel their enrollment, they will not receive a refund. Abundant Rein is happy to finish out any lessons which are already prepaid for within one calendar year. This includes students who pay through EPIC.

LATE ARRIVAL: I understand that if my rider is more than 15 minutes late to their lesson, they will forfeit their lesson and be charged in full for the session.

I give Abundant Rein Horse Riding Center permission to take photographs and/or videos of my child (or myself if 18 years of age and older) for the purpose of posting on Abundant Rein's Social Media Platforms, including, but not limited to, Facebook, Youtube, Instagram, and the Abundant Rein website. I hereby release and discharge Abundant Rein from any and all claims arising from the use of the photos and/or videos.

Social Media: I understand that LIVE recording is prohibited. Abundant Rein has the right to request individuals remove any photo or video from social media which they see as unfit.

I may choose to store my tack and personal belongings at Abundant Rein Horse Riding Center and Abundant Rain World Outreach Church Inc., at my own risk for a storage space fee. I understand that my property is not insured and Abundant Rein is not responsible for theft or damage of my property.
