This Participant Registration and Liability Release & Waiver must be completed for every person participating in any event at Dream Big Gymnastics, including but not limited to gymnastics training and meets, tumble classes, camps, clinics, open gym, parents’ night out, wrestling training, birthday parties and special events. You acknowledge that all activities at Dream Big Gymnastics come with an inherent risk of injury given the nature of the sports participated in, and the facility including, but not limited to, the gymnasium equipment, ropes, spring boards (including the spring floor), bars, balance beam, vault, etc. Further, I have asked questions about and received answers regarding the activities so that I know about the general dangers inherent therein and the specific nature of the activities so that I fully understand the same

BY SIGNING THIS LIABILITY RELEASE & WAIVER, YOU ACKNOWLEDGE THAT THE UNSUPERVISED USE OF ANY AREA OF FACILITY IS STRICTLY PROHIBITED AND SOLELY AT THE RISK OF THE PARTICIPANT. THAT IN LIGHT OF THE INHERENT RISK OF INJURY, YOU ARE PARTICIPATING IN ANY ACTIVITIES SOLELY AT YOUR OWN RISK. YOU FURTHER ACKNOWLEDGE THAT YOU ARE OBLIGATED TO CLOSELY FOLLOW ALL OF DREAM BIG GYMNASTICS’ RULES AND REGULATIONS GOVERNING PARTICIPATION IN ANY ACTIVITIES AND THAT YOU SHALL FOLLOW THE DIRECTION OF TRAINERS, COACHES AND DREAM BIG GYMNASTICS’ STAFF AT ALL TIMES.

Representation of Ability to Participate

I understand that it is my responsibility as an adult participant or parent not to participate or allow participation if there are any physical, emotional, and behavioral or other problems that might compromise safe participation. I am aware of my experience and capabilities and/or those of my minor child, and hereby acknowledge and represent I and/or my minor child that is qualified, in good health, and in proper physical condition to participate in the activities offered by Dream Big Gymnastics. I understand that Dream Big, Inc. and Dream Big Gymnastics do not carry or provide medical insurance for participants and forever release and discharge Dream Big, Inc. and Dream Big Gymnastics, its officers, agents, employees and independent contractors from any and all liability for medical insurance deductibles, medical
expenses, and/or other damages incurred by my child, myself, or other family members while participating in activities at Dream Big Gymnastics’ facilities and equipment or at camps, meets or clinics other than those at Dream Big Gymnastics. I expressly agree and promise to accept and assume all of the risks existing in this activity as outlined above. I understand the nature of the activities that I or my child will participate in and I represent that the participant
is qualified, in good health, and in proper physical condition to participate in the activities. If at any time any of the above representations are no longer true, or if I come to believe that the activities are no longer safe for the participant, then I shall immediately notify Dream Big Gymnastics and I shall discontinue participation in the activities.

Covenant Not to Sue for Injury or Damages

This Liability Release & Waiver is a legally binding agreement between Dream Big Gymnastics and participant. By signing this Liability Release & Waiver, I hereby waive my right to bring any claims for personal injury or initial any legal proceedings against Dream Big Gymnastics or Dream Big, Inc. to recover compensation or to obtain any other remedy for myself or my property in any way arising out of use of the facilities and equipment of Dream Big Gymnastics now or in the future. I hereby acknowledge and agree that the sport of gymnastics, wrestling and any of the facilities and accompanying equipment has INHERENT RISKS. I have full knowledge of the nature and extent of all of the risks inherent in the activities of participant and the use of the facilities of the gym, including but not limited to: (1) All manner of injury resulting from falling off of the gymnastics equipment, climbing ropes, trampolines, or any other area of the facility; (2) cuts and abrasions resulting from skin contact on various surfaces and equipment; (3) failure of any equipment or part of the equipment; (4) injuries occasioned by the other users of Dream Big Gymnastics and its facilities; (5) injuries resulting from landing on the landing surfaces; and (6) injuries to bones, joints, tendons, or death. I further acknowledge that the above list is not inclusive of all possible risks associated with the use of the Dream Big Gymnastics’ facilities and equipment and that above list in no way limits the extent or reach of this Liability Release & Waiver. In consideration of my use of Dream Big Gymnastics’ facilities and equipment, I agree not to claim or to sue for any injury or damages resulting from risks inherent in the activities participated in, including but not limited to the risks that have been outlined above.

Release, Indemnification, Liquidation, Damages and Agreement to Arbitrate

In consideration of my use of Dream Big Gymnastics’ facilities and equipment, I the undersigned participant, hereby agree to release on behalf of myself, my ward, my heirs, representatives, successors, executors, administrators and assigns, and HERBY DO RELEASE Dream Big, Inc. and Dream Big Gymnastics, its officers, agents, employees and independent contractors from any cause of action, claims or demands of any nature whatsoever, including but not limited to, any claims of negligence, which I, my ward, my heirs, representatives, successors, executors, administrators and assigns may now have, or have in the future against Dream Big, Inc. and Dream Big Gymnastics, regardless of whether my participation is supervised or unsupervised, how the injury or damage was caused, including but not limited to negligence of Dream Big, Inc. and Dream Big Gymnastics, its officers, agents, employees or independent contractors.

In consideration of my participation, I the undersigned participant, hereby agree to INDEMNIFY and HOLD HARMLESS Dream Big, Inc. and Dream Big Gymnastics, its officers, agents, employees and independent contractors from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to to my use of the Dream Big Gymnastics’ facilities and equipment or participation in any activities.

PARTICIPANT CERTIFICATION

I hereby certify that I have full knowledge of the nature and extent of the risks inherent in the use of Dream Big Gymnastics’ facilities and equipment and that I am voluntarily assuming all such risks. I further certify: (1) that I am in good health and that I have no physical limitations which would preclude my safe use of Dream Big Gymnastics’ facilities and equipment; (2) that I have sufficient health, accident and liability insurance to cover any bodily injury or property damage I may incur while participating in any activities; and (3) should it become necessary for Dream Big, Inc. and Dream Big Gymnastics to incur attorney's fees and costs to enforce this Liability Release & Waiver, or any portion hereof, I agree to indemnify and hold harmless thereon.

Notwithstanding all of the foregoing, I agree for myself, my heirs, representatives, successors, executors, assigners, and administrators that in the event that I seek damages or compensation from Dream Big, Inc. and Dream Big Gymnastics for any reason, I agree that any such claims must be submitted to a binding arbitration procedure by, through and in accordance with the rules of the American Arbitration Association. I fully understand that I will be bound by the terms and conditions of the arbitration award/decision.

DREAM BIG PAYMENT POLICIES

1. There is a yearly Family Registration Fee of $150, $100 for one child due annually upon registration of Academic Session. Payment must be received prior to enrollment. Fee will be prorated on a quarterly basis.
2. Families must keep a valid credit card on file at all times.
3. Tuition will be withdrawn monthly on the 25th from the credit card on file.
4. All remaining balances on your account will also be charged on the 25th of each month from the credit card on file.
***This will include, but is not limited to; merchandise, beverages, equipment, birthday parties, Kids Night out Parties, Clinics, hair elastics, private lessons, choreography, and music, meets fees, USAG/ USA Wrestling fees.
5. No student will be allowed into class without a current registration form and waiver on file.
6. Class availability is first come/first serve.
7. Tuition is based on the all classes that meet from September through June. For your convenience tuition is divided into 10 equal payments. Therefore, tuition remains the same regardless of the number of classes held in any given month.
8. All tuition is NON-REFUNDABLE, NON-TRANSFERABLE, CREDIT WILL NOT BE GIVEN
9. A $15 late fee will be applied to accounts outstanding by the 10th of the month.
10. Once you register for a class, we will reserve your spot for the remainder of the Academic Session, unless you notify the office, in writing that you wish to withdraw. Therefore, you will be responsible for the monthly tuition unless notice is received by the 25th of the previous month, regardless of attendance.
11. A $20 returned check fee will be assessed for all returned checks or credit cards that are not valid.
12. Tuition is due on the 25th of each month for the upcoming month. This credit card agreement must be filled out completely and accurately to ensure placement in class. If credit card is declined for Insufficient Funds or Issuer declined reasons we will keep trying until payment is received.
**If you would like to pay with another form of payment you may do so, but it must be received before the 25th of the month. If we do not receive payment before the 25th of the month, your credit card will be charged.
