This Participant Registration and Liability Release & Waiver must be completed for every person participating in any event at Dream Big Gymnastics, including but not limited to gymnastics training and meets, tumble classes, camps, clinics, open gym, parents’ night out, wrestling training, birthday parties and special events. You acknowledge that all activities at Dream Big Gymnastics come with an inherent risk of injury given the nature of the sports participated in, and the facility including, but not limited to, the gymnasium equipment, ropes, spring boards (including the spring floor), bars, balance beam, vault, etc. Further, I have asked questions about and received answers regarding the activities so that I know about the general dangers inherent therein and the specific nature of the activities so that I fully understand the same

BY SIGNING THIS LIABILITY RELEASE & WAIVER, YOU ACKNOWLEDGE THAT THE UNSUPERVISED USE OF ANY AREA OF FACILITY IS STRICTLY PROHIBITED AND SOLELY AT THE RISK OF THE PARTICIPANT. THAT IN LIGHT OF THE INHERENT RISK OF INJURY, YOU ARE PARTICIPATING IN ANY ACTIVITIES SOLELY AT YOUR OWN RISK. YOU FURTHER ACKNOWLEDGE THAT YOU ARE OBLIGATED TO CLOSELY FOLLOW ALL OF DREAM BIG GYMNASTICS’ RULES AND REGULATIONS GOVERNING PARTICIPATION IN ANY ACTIVITIES AND THAT YOU SHALL FOLLOW THE DIRECTION OF TRAINERS, COACHES AND DREAM BIG GYMNASTICS’ STAFF AT ALL TIMES.

Representation of Ability to Participate

I understand that it is my responsibility, as an adult participant or parent/legal guardian, not to participate or allow participation if there are any physical, emotional, behavioral or other conditions that might compromise safe participation. I am aware of my experience and capabilities and/or those of my minor child, and I represent that I and/or my minor child are qualified, in good health and in proper physical condition to participate in the activities offered by Dream Big Gymnastics.

I understand that Dream Big, Inc. and Dream Big Gymnastics do not carry or provide medical insurance for participants. I release and discharge Dream Big, Inc. and Dream Big Gymnastics, including their officers, agents, employees and independent contractors, from liability for medical insurance deductibles, medical expenses and/or other damages incurred by my child, myself or other family members while participating in activities or using Dream Big Gymnastics facilities and equipment.

I expressly agree and promise to accept and assume all risks existing in the activities described in this waiver. I understand the nature of the activities in which I or my child will participate and represent that the participant is qualified, in good health and in proper physical condition to participate. If any of these representations are no longer true, or if I believe the activities are no
longer safe for the participant, I will immediately notify Dream Big Gymnastics and discontinue participation.

Covenant Not to Sue for Injury or Damages

This Liability Release & Waiver is a legally binding agreement between Dream Big Gymnastics and the participant. By signing it, I waive my right to bring claims for personal injury or initiate legal proceedings against Dream Big Gymnastics or Dream Big, Inc. to recover compensation or obtain any other remedy for myself or my property arising from the use of Dream Big Gymnastics facilities and equipment, now or in the future.

I acknowledge and agree that gymnastics and the facilities and accompanying equipment involve inherent risks. These include, but are not limited to: (1) injuries resulting from falling from gymnastics equipment, climbing ropes, trampolines or any other area of the facility; (2) cuts and abrasions resulting from skin contact with surfaces and equipment; (3) failure of equipment or
any part of equipment; (4) injuries caused by other users of Dream Big Gymnastics and its facilities; (5) injuries resulting from landing on landing surfaces; and (6) injuries to bones, joints or tendons, or death.

I acknowledge that this list is not inclusive of all possible risks associated with the use of Dream Big Gymnastics facilities and equipment and does not limit the extent or reach of this Liability Release & Waiver. In consideration of my use of Dream Big Gymnastics facilities and equipment, I agree not to make a claim or sue for injury or damages resulting from risks inherent in
the activities, including risks outlined above.

Release, Indemnification, Liquidation, Damages and Agreement to Arbitrate

In consideration of my use of Dream Big Gymnastics facilities and equipment, I, the undersigned participant or parent/legal guardian, agree on behalf of myself, my ward, my heirs, representatives, successors, executors, administrators and assigns to release Dream Big, Inc. and Dream Big Gymnastics, including their officers, agents, employees and independent contractors, from any cause of action, claims or demands of any nature whatsoever, including, but not limited to, claims of negligence, that I or my ward may now have or may have in the future, regardless of whether participation is supervised or unsupervised or how the injury or damage was caused, including, but not limited to, negligence by Dream Big, Inc. or Dream Big Gymnastics, their officers, agents, employees or independent contractors.

In consideration of participation, I agree to indemnify and hold harmless Dream Big, Inc. and Dream Big Gymnastics, including their officers, agents, employees and independent contractors, from any and all causes of action, claims, demands, losses or costs of any nature whatsoever arising out of or in any way related to the use of Dream Big Gymnastics facilities and equipment or participation in any activities.

PARTICIPANT CERTIFICATION

I certify that I have full knowledge of the nature and extent of the risks inherent in the use of Dream Big Gymnastics facilities and equipment and voluntarily assume all such risks. I further certify: (1) that the participant is in good health and has no physical limitations that would preclude safe use of Dream Big Gymnastics facilities and equipment; (2) that I have sufficient health, accident and liability insurance to cover bodily injury or property damage incurred while participating in any activities; and (3) that if Dream Big, Inc. or Dream Big Gymnastics incurs attorney's fees or costs to enforce this Liability Release & Waiver, or any portion of it, I agree to indemnify and hold them harmless.

Notwithstanding the foregoing, I agree for myself, my heirs, representatives, successors, executors, assigns and administrators that, if I seek damages or compensation from Dream Big, Inc. or Dream Big Gymnastics for any reason, any such claim must be submitted to binding arbitration through and in accordance with the rules of the American Arbitration Association. I understand that I will be bound by the terms and conditions of the arbitration award or decision.

DREAM BIG PAYMENT POLICIES

 

1. Registration fees. Fees are due before enrollment and are based on the registration date. Each fee includes one registration leotard and/or shirt for the registered athlete.

2. Families must keep a valid credit card on file at all times.

3. Tuition is withdrawn monthly on the 25th from the card on file.

4. All remaining account balances will also be charged on the 25th of each month. This includes, but is not limited to, merchandise, beverages, equipment, birthday parties, kids' night out, clinics, private lessons, choreography, music, meet fees and USAG fees.

5. No student will be allowed into class without a current registration form and waiver on file.

6. Class availability is first come, first served.

7. Tuition is based on classes meeting from September through August and is divided into 12 equal monthly payments. Tuition remains the same regardless of the number of classes held in any given month.

8. All tuition is non-refundable. Credit will not be given.

9. A $15 fee will be applied to accounts outstanding by the 10th of the month.

10. 30-Day Withdrawal Notice. A 30-day written notice is required before withdrawing an athlete from any class or program. Notice may be submitted in writing or by email. Verbal notice will not be accepted. Tuition remains due throughout the 30-day notice period, regardless of attendance.

11. A $20 returned-payment fee will be assessed for returned checks or invalid credit-card payments.

12. Tuition is due on the 25th of each month for the upcoming month. The credit-card agreement must be completed accurately to ensure placement in class. If a card is declined, payment attempts will continue until payment is received.

If another form of payment will be used, it must be received before the 25th. Otherwise, the card on file will be charged.
