External use of RMC property requires the following insurances.
Purchaser shall provide a certificate of insurance for the coverages listed in the paragraphs below no less than thirty (30) days before the first date appearing on the agreement contract.
-The certificate shall be an original; fax and photocopies are not acceptable.
-The certificate shall be issued to College [Rocky Mountain College, Billings, Montana].
-College should appear as an additional insured on all policies of insurance except for the insurance required in paragraph 10.1.7.3.
-The certificate of insurance shall also indicate that there is no applicable cross suits liability exclusion (allows an insured to sue another insured).
- Purchaser and its insurers agree to waive their right of subrogation against College for any general liability, auto liability, or worker’s compensation claims made against Purchaser’s policies.
- All such insurance should not include any restrictions of governmental immunities built into the insurance coverage and policies.
- Limits of Insurance
--Purchaser shall provide evidence of General Liability insurance or Tenants Purchasers Liability Insurance (TULIP or Special Events) of an amount not less than one million ($1,000,000.00) per occurrence. If the use of facilities includes physical activities, such as sports camps, the General Liability limit should be two million ($2,000,000.00) per occurrence with no athletics activities exclusion. If College's pool is used, the General Liability per occurrence limit should be five million ($5,000,000.00) with no athletics activities exclusion.
-- Purchaser shall provide evidence of Owned, Non-owned, and Hired Auto Liability insurance of an amount of not less than one million ($1,000,000.00) per occurrence.
--Any Purchaser with Purchaser employees on campus shall provide evidence of statutory Workers Compensation insurance and one-hundred thousand ($100,000.00) of Employers Liability insurance.
--Any Purchaser with minors on campus shall provide evidence of Sexual Misconduct/Abuse Liability insurance of an amount of not less than one million ($1,000,000.00) per occurrence. Coverage endorsed onto the General Liability policy is acceptable.
-- Any Purchaser approved for serving liquor on campus in accordance with Section 5.1.2. shall provide evidence of Liquor Liability insurance of an amount of not less than two million ($2,000,000.00) per occurrence/two million ($2,000,000.00) in the aggregate. Coverage endorsed onto the General Liability policy is acceptable.
--Any Purchaser providing Athletic Trainers on campus shall provide evidence of Medical Professional Liability insurance of an amount of not less than two million ($2,000,000.00) per occurrence/two million ($2,000,000.00) in the aggregate. Coverage endorsed onto the General Liability policy is acceptable.
--Any Purchaser deemed to be high public profile or controversial shall provide evidence of Active Shooter insurance in the amount of not less than three million ($3,000,000.00) per occurrence. Coverage shall include deadly weapon attack including bomb.
-If Purchaser is a wedding or family reunion only the insurance required in paragraphs 10.1.7.1 and 10.1.7.5 are required.
-All vendors/service providers hired by Purchaser must be preapproved by College and provide evidence of insurance as required by College.
-All insurance policies shall be primary and noncontributory.
