STATEMENT OF VOLUNTARY CONSENT, GENERAL RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISKS, AND HOLD HARMLESS AGREEMENT
BY SIGNING THIS DOCUMENT YOU WILL WAIVE LEGAL
RIGHTS INCLUDING THE RIGHT TO SUE
I, the undersigned, wish for myself and my child to use the equipment and engage in play and activities at “Play Studio” (the “Play Studio”) at 3005 Belknap Street, Fort Worth, TX 76111 (the “Premises”) owned and operated by Green Space Learning and Development, a Limited Liability Company organized under the laws of the State of Texas.
RELEASE OF LIABILITY
I acknowledge that I am responsible for supervising my child at all times while at the Play Studio Premises to include the parking lot, and I hereby agree for myself and my minor child, and my estate, heirs, administrators, executors and assigns, to release, discharge and hold harmless Green Space Learning and Development, LLC, the owner and operator of Play Studio, including their respective officers, directors, employees, representatives, agents, and volunteers (collectively, “Green Space”), for, from and against any and all liability and responsibility whatsoever, for any or all claims of negligence, gross negligence, and strict liability related to the use of the premises. Such claims or causes of action may include, but are not limited to, injuries or accidents, trips and falls, choking, scratches, bumps, insect bites, injuries from other participants, property loss, damages to vehicles in the parking lot, as well as any and all other claims, or causes of action, that my minor child or I may have for any loss, personal injury, or death, arising out of any injury or accident sustained by my child.
By signing, I acknowledge and represent that I have read and understand this agreement; that I sign it voluntarily and for full and adequate consideration, fully intending to be bound by the terms; that I am at least eighteen (18) years of age and fully competent; and that I am the legal guardian of minor child participant registered under my family name.
This Liability Waiver and Release shall be governed by the laws of the State of Texas, and any action, claim or proceeding under this Liability Waiver and Release shall be commenced exclusively in the courts of Fort Worth, Texas. This agreement may not be revoked, terminated or amended verbally, but only by a written instrument signed by me and an authorized representative of Green Space. All covenants contained herein are severable, and in the event of any being held invalid by any competent court, this Agreement shall remain intact except for the omission of the invalid covenant.
