  • Terms and Financials

  • This rental agreement governed by the laws of the State of Ohio

    is between you, the undersigned,

    and Oberlin Avenue Self Storage, LLC (Owner).

    You've agreed to to rent the storage unit identified as

    located at 4620 Oberlin Avenue, Lorain, OH 44053 for storage use only.

    No business is to be conducted on premisis. 

  • Duration

    Recurring rental payments shall be made per the terms and conditions of this agreement and continue month to month until terminated or revised. The unit is clean and undamaged upon tenant occupancy unless otherwise reported with-in 48 hours of possession. Oberlin Avenue Self Storage, LLC reserves the right to revise, amend, or cancel this agreement with 30 days advance notice to tenant. Changes do not require a tenant signature to become valid.

  • Rent Payments

    Occupant shall pay Owner a monthly rental rate of $117.00 plus Ohio sales tax. Rents are to be paid on the monthly anniversary date of this agreement by automated recurring payment and will be considered delinquent the following day. No monthly invoices or statments are sent to Occupant. Rents are due in full and partial payments are not accepted. Owner reserves the right to adjust rental rates with 30 days advance notice.

    Other Fees

    • Late Charge: $10.00 after 3 days delinquent.
    • Lock Out Charge: $15.00 re-instatement fee. 
    • Returned Payment: $30.00 non sufficient funds.
    • Default Unit: $75.00 inventory fee.
  • Default

    If Occupant fails to pay rent or satisfy any part of this agreement they will be considered in default. The Owner may pursue action for restitution of the Premises as allowed by Ohio law. Additionally, Owner may deny Occupant access to leased storage unit by overlocking and/or gate code deactivation if rent is delinquent 5 days.

  • Notice of Lien

    The Ohio Lien Law, Revised Code, Section 5322, gives the Owner a lien on Occupant's stored property for rent and other charges. Occupant's property may be sold to satisfy the lien if rent and other chages are not paid when due.

  • Property of Others

    Owner shall not be liable to Occupant or any third person for the removal or sale of personal property which is not Occupant's property or upon which a prior lien has attached, unless the Occupant notifies Owner in the space provided.

  • Responsibilities

  • Insurance and Liability

    Owner does not provide insurance for stored contents or goods and assumes no liability over such. Oberlin Avenue Self Storage, LLC highly encourages obtaining a renters insurance policy to cover all stored belongings and personal liability.

    Occupant agrees all personal property within leased unit shall be stored at their own risk. Occupant is soley responsible for contents and Owner is not liable whatsoever for any loss or damages accordingly.

    Occupant assumes all risks from all natural conditions and effects, such as temperature, humidity, atmosphere, etc. as may cause or contribute to change in any stored property, such as mildew, warping, unglueing, discoloring, etc.

    Owner shall not be liable in event of injury or death as a result of Occupant, Occupant's agents, employees, invitees or guests use of storage space and facility including instances of active or passive acts of negligence.  

  • Locks

    Secure unit with your lock. Occupant shall provide, at Occupant's own expense, a lock that Occupant deems sufficient to secure the space. Occupant agrees to keep unit locked when not on premises. If the space is found unlocked, Owner may, but is not obligated to, take whatever measures Owner deems reasonable to re-secure the space with or without notice to Occupant. Occupant may only use one lock per storage door; Owner will remove any additional locks placed on storage space by Occupant.

  • Maintenance

    Occupant shall report any damage or problem immediately upon discovery or could be held responsible for the cost. Owner will not be liable for any repair materialized by Occupant neglect. Our complying with or responding to any oral request regarding security or nonsecurity matters doesn’t waive the strict requirement for written notices under this rental agreement. Occupant must promptly notify us in writing of: roof leaks; electrical problems; malfunctioning lights; broken or missing door latches; and other conditions that pose a hazard to the property, or your health, or safety. We will respond to repair or remedy the situation as deemed necessary.

  • Contact Information

    Occupant shall notify Owner of any change in Occupant's or Alternate's contact information including address, phone number, and email as necessary within 10 days of the change.

  • Policies and Procedures

  • Access

    Occupant is provided 24 hour access to storage space. Restrictions to the premises may be conditioned in any manner deemed reasonable necessary by Owner to maintain order on the premises. Such measures may include, but are not limited to, verifying occupant's idenity and/or limiting hours of operation.

  • Facility Rules

    Owner shall have the right to establish or change hours of operation or to promulgate rules and regulations for the safety, care, and cleanliness of the premises, or the preservation of good order on the premises.

    • Occupant must observe a 5 mph speed limit on driveways.
    • Occupant must maintain the premisis in good condition.
    • Occupant shall not perform any practices which may injure the buildings.
    • Occupant must not become a nuisance or a menace to other occupants of facility.
    • Occupant must keep driveways clean and free from rubbish, dirt, and other debris.
    • Occupant shall remove all rubbish at their expense.
    • Occupant is responsible for cost to repair any and all damage to unit of facility caused by Occupant, Occupant's agnts, employees, invitees and/or guests.
  • Use of Storage Space

    Owner is not engaged in the business of storing goods for hire and no bailment is created under this agreement. Owner excerises neither care, custody nor control over Occupant's stored property.

    • Occupant agrees to use storage space only for the storage of property wholly owned by occupant.
    • Occupant may not assign this agreement or sublet unit to others.
    • Occupant may not reside in storage unit under Ohio law.
    • Occupant may not use storage space for illegal purposes.
    • Occupant may not store flammables, stolen property, perishables, guns or ammunition, anything alive or dead.
    • Occupant shall waive any claim for emotional or sentimental attachment to antiques, heirlooms, collectables, or any property having special or personal value to Occupant. 
  • Move-Out

    Occupant agrees to give 48 hours advance notice to vacate and end services. Email a picture of the empty unit to storage@oberlinavenue.com to finalize move out and stop montly charges. Owner does not prorate rents will continue until Occupant's lock is removed. Unit must be left empty, broom clean, and in good condition. Occupant will be responsible for cost of any and all damage.

    Owner may dispose of any property left in the storage space or on the premises by Occupant after tenancy is terminated. Occupant shall be responsible for all costs incurred to Owner in disposing of such property.

  • Notices

    All notices required of Occupant by this rental agreement shall be sent via email to storage@oberlinavenue.com. Delivery of such notices must originate from Occupant's email address of record. Owner reserves the right to notify Occupant by any form necessary or as required by law.

    Additional Terms and Conditions
  • Right of Entry

    Occupant grants Owner access and/or any representative of any govermental authority, including police and fire officials, access to unit upon one (1) days advance notice to Occupant for non emergency situations. In the event of an emergency, suspected illegal use of the unit, or structural/mechanical repair to the building, Owner and/or representative of governmental authority shall have the right to enter the premises without notice to Occupant, and take such actions as may be necessary or appropriate to preserve the premises, to comply with applicable law, to enforce Owner's rights or to protect the safety, health, and welfare of others and other's stored property.

  • Relocation

    Owner reserves the right to relocate Occupant, without expense to Occupant to any unit of comparable size.

  • Limitations

    Other than vehicles, Occupant agrees not to store property with a total value in excess of $5000 without written permission if the Owner. If such written permission is not obtained, the value of Occupant's property shall be deemed not to exceed $5000. 

    Nothing herein shall constitute any agreement or admission by Owner that Occupant's store property has any value, nor shall anything alter the release of Owner's liability set forth in this agreement.

    If Owner is held liable for any reason under the law, the maximum amount the Owner shall be responsible shall not exceed six (6) months rent.

  • Hazardous Materials

    Occupant is strictly prohibited from storing or using materials in the storage space or on the facility classified as hazardous or toxic under any local, state, or federal law or regulation, and from engaging in any activity, which produces such materials. Occupant's obligation of indemnity is set forth below specifically includes any costs, expenses, fines or penalties imposed again the Owner, arising out of the storage or use of any hazardous or toxic material by Occupant, Occupant's agents, employees, invitees or guests. Owner may enter the storage space at any time to remove or dispose of prohibited items.

  • Pest Disclaimer

    Occupant acknowledges the risk of pests in the storage unit. Owner strives to prevent infestations but cannot guarantee complete protection. Occupant assumes all risks and waives claims against the owner for any damages. Occupant agrees to take preventive measures, like no food storage and utilizing traps if needed.

  • Idemnification

    Occupant agrees to idemnify, hold harmless and defend Owner from all claims, demands, actions, or causes of action (including attorney's fees and all costs) that are hereinafter brought by others arising out of Occupant's use of the premises, including claims for Owner's active negligence except that Occupant shall not be liable for Owner's sole negligence.

  • Severability

    It is understood and agreed that if any provision of this agreement shall be held to be invaid, this agreement shall be considered to be amended to exclude any such invalid provision and the balance of the agreement shall be read independently of said excluded provision and shall remain in full force and effect.

  • Waiver

    The failure of either party to enforce any covenant or other provision of this agreement shall not constitute a waiver of the right to do so thereafter nor shall give rise to any cause of action or defense on the part of the Occupant.

  • Survival of Covenants

    All portions of this agreement which by necessity are required to be enforced by either party beyond the date of the termination of this agreement.

  • Survivorship

    All provisions of this agreement shall be binding upon the heirs, executors, administrators, representatives, successors and assignees of the parties hereto.

  • Recurring Payment Authorization

    Automated billing initiated on monthly anniversary date.
  • Total Monthly Charges
    $124.60
    Includes Sales Tax.
  • {customerName}, {businessName} (Occupant) authorizes Oberlin Avenue Self Storage, LLC (Owner) to charge the agreed amount listed above to my account provided herein on or about the monthly anniversary date of this agreement.

    Occupant undestands this authorization will remain in effect until cancelled in writing with Oberlin Avenue Self Storage, LLC. In addition, {customerName}, {businessName} agrees to notify Owner of any changes to payment information at least 10 days prior to next authorized payment date.

    I certify that I am an authorized user of this credit card/bank account and will not dispute the scheduled transactions with my bank or credit card Company; provided the transactions correspond to the terms indicated in this authorization form.
