PUPPY PURCHASE AGREEMENT, HEALTH GUARANTEE & SPAY / NEUTER ENFORCEMENT

2. PURPOSE OF SALE
The puppy is sold strictly as a companion animal.
NO breeding rights are granted under any circumstances.
3. PURCHASE PRICE & RISK OF LOSS
Buyer agrees to pay the full purchase price by 6 weeks of age.
All risk of illness, injury, loss, or death of the puppy shall transfer to the Buyer immediately upon the puppy leaving the Seller’s possession, custody, or control. This transfer of risk shall apply regardless of the method of transport or delivery selected or arranged by the Buyer, including but not limited to ground transport, air transport, third-party carriers, or personal pickup by the Buyer or the Buyer’s agent.
4. HEALTH AT TRANSFER
Seller represents that the puppy is believed to be in good health at the time of transfer and has received age-appropriate vaccinations and deworming and has had a veterinary exam before leaving.
5. BUYER VETERINARY EXAM REQUIREMENT
Buyer must have the puppy examined by a licensed veterinarian within three (3) business days of taking possession.
Failure to complete or provide proof of this examination voids all warranties and guarantees.
6. LIMITED GENETIC HEALTH GUARANTEE
Seller provides a limited two (2) year genetic health guarantee covering only life-threatening conditions. Conditions or abnormalities that are present at birth and arise from prenatal developmental causes, whether apparent at the time of birth or discovered at a later date, are expressly excluded from coverage under this guarantee. Only genetic abnormalities that are directly attributable to the animal’s parentage shall be considered for coverage, provided such conditions are diagnosed and documented in writing by a licensed, reputable veterinarian. The Seller reserves the right to obtain a second veterinary opinion of their choice, at the Seller’s discretion, before any determination of coverage is made.
• INSURANCE ACTIVATION REQUIREMENT
As a condition of this Agreement, the Buyer is required to activate the Trupanion® 30-day free pet insurance coverage. Failure to activate said coverage shall render this contract null and void and all guarantees and obligations under this Agreement unenforceable. BR1HB12721
•Buyer’s sole and exclusive remedy is a replacement puppy of their choice, as close to their first puppy as possible, of equal or lesser value, when available.
NO REFUNDS WILL BE GIVEN.
The original puppy does not need to be returned.
7. EXCLUSIONS FROM GENETIC WARRANTY
This warranty DOES NOT COVER:
• Viral illnesses
• Bacterial or fungal infections
• Kennel cough
• Improper bites or dental alignment
• Stress-related illness
• Hernias
• Hypoglycemia
• Seizures
• Endoparasites or ectoparasites (including Giardia, Coccidiosis, fleas, mites etc)
• Cancer
• Endocrine disorders
• Intervertebral Disc Disease (IVDD)
• Chondrodystrophy (CDDY)
• Any disease or condition not expressly listed as covered
This warranty also excludes any condition caused by:
• Ingestion of foreign objects
• Food, chemicals, toxins, or medications
• Accidental injury, trauma, falls, jumping, or physical harm
8. NO GUARANTEE OF SIZE, COLOR, OR TEMPERAMENT
Any estimates provided regarding adult size, coat color, or temperament are opinions only.
NO guarantees are made regarding size, color, or temperament.
9. BREEDING PROHIBITION & LIQUIDATED DAMAGES
Breeding is strictly prohibited, whether intentional or accidental.
Any breeding violation constitutes material breach and results in:
• Forfeiture of all warranties
• Seller’s right to pursue legal remedies
10. SPAY / NEUTER REQUIREMENT & ENFORCEMENT
Buyer agrees to spay or neuter the puppy by six (6) months of age, unless medically contraindicated and approved in writing by Seller.
Failure to comply results in:
• Immediate forfeiture of all warranties
• Seller’s right to pursue legal enforcement
11. NON-DISPARAGEMENT
Buyer agrees not to make or publish false, misleading, or negative statements regarding Seller in:
• Public settings
• Private communications
• Social media, reviews, or online forums

12. NO-CHARGEBACK AGREEMENT
Buyer agrees not to initiate chargebacks, payment disputes, or reversals for any reason.
Any chargeback constitutes breach of contract.
13. NO REFUNDS POLICY (INCLUDING DEPOSITS)
NO REFUNDS WILL BE GIVEN UNDER ANY CIRCUMSTANCES.
This includes, but is not limited to:
• Deposits
• Reservation or holding fees
• Partial or full payments
Regardless of reason, cancellation, illness, delay, or dissatisfaction.
14. NO MEDICAL / VETERINARY EXPENSE LIABILITY
Seller does NOT accept responsibility for any veterinary bills, medical care, or health-related expenses at any time.
15. ARBITRATION & MEDIATION CLAUSE
Any dispute arising from this Agreement must first be submitted to mediation.
If unresolved, the dispute shall be settled by binding arbitration in Seller’s home state.
Buyer waives the right to a jury trial.
16. LIMITATION OF LIABILITY
Seller’s total liability shall never exceed the original purchase price of the puppy.
Seller shall not be liable for:
• Veterinary costs
• Emotional distress
• Loss of companionship
• Consequential or incidental damages
17. GOVERNING LAW & ENTIRE AGREEMENT
This Agreement shall be governed by the laws of the United States and Seller’s home state.
This document constitutes the entire agreement between Buyer and Seller and supersedes all prior discussions.
Seller Discretion Clause
The Seller agrees to act in good faith and to address each matter on a case-by-case basis. Any resolution offered shall be determined at the Seller’s sole discretion, based on what the Seller reasonably believes to be fair and appropriate under the circumstances.

Buyer agrees to pay the seller a non-refundable deposit total of $ and the remaining balance of $ at 6 weeks of age or you will be subject to losing your deposit or have to move to another future litter.
