Federal law does not prohibit employers from asking about your criminal history. But, federal EEO laws do prohibit employers from discriminating when they use criminal history information. MHSC does not discriminate against an applicants criminal history.
However, a new arrest or a pending charge(s) does directly affect an applicants professional licenses with the state. Typically, when an applicant is arrested, within 2 weeks the Department of State sends licensed security guards (and their employers) a letter notifying them that they received the arrest notification. The state will either suspend your license, or request more information to determine if they will suspend your license.
MHSC will conduct a background check and submit an inquiry to the Department of State to determine the hiring eligibility of all new applicants. It is strongly suggested that applicants voluntarily disclose the following:
