    Contingency plans in the face of force majeure
    MBS is aware that while no one can predict the future, force majeure may affect our school. Although rare, they do happen. The MBS definition of force majeure includes, but is not limited to: natural disasters, sometimes legally described as “natural disasters,” such as tornadoes, hurricanes, or earthquakes; major biological events such as epidemics or pandemics; and other disruptions such as wars, riots, labor disputes, terrorist activities, and interruptions in power supply or communication systems.
    In the event that force majeure affects the ability of MBS to provide regular services, we will offer:

    Virtual Classes: if MBS is unable to deliver in-person classes, students will receive virtual instruction in lieu of a refund.
    Refunds: if MBS is unable to provide in studio instruction, nor virtual instruction, students will receive a credit.
    Notices and Deadlines: In the event of a Force Majeure Event, MBS will notify students of our plan to provide virtual lessons to our students prior to class starting, as described above. Upon notification, students can opt out of virtual classes in exchange for a refund prior to class. However, if force majeure occurs in the middle of the class and MBS offers virtual classes no refunds will be issued.

    Refunds
    MBS follows a No Refund Policy: tuition and fees are non refundable and non transferable. A full refund will be granted if MBS is to cancel the class and a virtual class is not offered. There are no refunds for partially attended sessions. Before registering your child, please make sure the class will fit your schedule and your child wants to dance. Please contact the Director with any questions regarding MBS tuition and policies.

    Late Fees
    MBS charges a $45 late fee to all payments received after 5th day of the tuition due date. The fee on all returned checks is $45. Failure to make payments on time may prohibit your child from participating in class.

    Dress Code
    The dress code for each level of ballet is posted on the MBS website.

    Attendance and Make-up classes

    Please contact Kirill Bak in advance of any absences or tardiness. Good attendance is critical to consistent student progress and advancement.
    Classes cancelled by MBS can be made up within the same session,
    in a class of equal or lower level.
    One make-up class is available for Dancers who attend one class a week.
    Two make-up classes are available for Dancers who attend two classes a week. Three make-up classes are available for Dancers who attend three classes a week. Four make-up classes are available for Dancers who attend four classes a week.

    Tardiness
    Students should be on time for the beginning of class. Late admittance to class is at the teacher’s discretion. Students that are more than 15 minutes late may be asked to observe class. This is to ensure the students safety and to not disrupt the flow of the class.

    Withdrawal
    60 days advance notice is required. You will be responsible for two months tuition after your last paid session, except for documented medical conditions. If circumstances require you to withdraw from a class or rehearsal, please fill out a “Withdrawal Form” at the front desk.

    Class Observation
    Classes can be observed at any time through the viewing windows or on the monitor screens in the waiting room. Parents/Guardians are not allowed into the studio rooms.

    Student Behavior
    All students must behave in a courteous manner towards each other. Disrespect to any staff member or volunteer, or disruptive behavior of any kind could be grounds for dismissal. Good behavior includes arriving on time, being quiet and attentive at all times, respecting rehearsal studios, not littering, and getting along with fellow dancers. Please also remember: no chewing gum, beverages or food may be eaten in the studios. Only light snacks may be eaten in the waiting area.

    This is a place of business; students/families must conduct themselves in a quiet, controlled, appropriate manner in all areas of the building. Please turn off cell phones. Young children should not be left unattended. No running. No meals should be eaten in studio or lobby. It is a very small space, and the smell can be distracting to dancers, especially when they have very long rehearsal days. Healthy snacks are encouraged for dancers during long rehearsal days, if needed. (energy bars and fruits are OK).  Meals for families should be eaten elsewhere. Also, please remember to clean up after eating snacks and drinking beverages.

    Student Pick Up
    Students must be picked up at the ending time of each class or program. After a 15-minute grace period has passed, a $1 per minute fee will be assessed for late pick up. Young children not enrolled in class should not be left unattended.

    Risks of Participation

    The Undersigned recognizes and understands that while Released Parties have undertaken reasonable steps to lessen the risk of transmission of communicable diseases, including but not limited to, COVID-19, in connection with participation in the activities, the Released Parties are not responsible in any manner for any risks related to communicable diseases in connection with Participant's participation in the activities. Specifically, the Undersigned understands that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes COVID-19 may result in significant personal injury or death. The Undersigned is fully aware that participation in the activities carries with it certain inherent risks related to transmission of communicable diseases ("Inherent Risks") that cannot be eliminated regardless of the care taken to avoid such risks. Inherent Risks may include, but are not limited to, (1) the risk of coming into close contact with individuals or objects that may be carrying a communicable disease; (2) the risk of transmitting or contracting a communicable disease, directly or indirectly, to or from other individuals; and (3) injuries and complications ranging in severity from minor to catastrophic, including death, resulting directly or indirectly from communicable diseases or the treatment thereof. Further, the Undersigned understands that the risks of all communicable diseases are not fully understood, and that contact with, or transmission of, a communicable disease may result in risks to the Participant including but not limited to loss, personal injury, sickness, death, damage, and expense, the exact nature of which are not currently ascertainable, and all of which are to be considered Inherent Risks. The Undersigned hereby voluntarily accepts and assumes all risk of loss, personal injury, sickness, death, damage, and expense for the Participant arising from such Inherent Risks.

    Acknowledgement of Risk and Waiver of Liability

    My child has no physical conditions that would limit his/her participation in dance activities.

    I hereby give permission for my child to participate in activities at MBS, to work on all of the necessary equipment, and to be transported to and from additional dance activities.

    In case of emergency the MBS staff has my permission to use their judgment with regard to treatment until I can be contacted. Moreover, I hereby authorize any qualified physician contacted to proceed with treatment. In case of emergency, I understand that my child will be transported to the nearest hospital or preferred hospital (please fill in Hospital name below) by the local emergency resource if rescue squad deems necessary. I understand that I will be responsible for all medical and emergency transportation expenses. It is understood that in some medical situations, the staff will need to contact the emergency resources before contacting the parent or other adult acting on the parent’s behalf.

    I understand and accept that touching in a professional manner in order to provide proper correction is a necessary part of dance instructions.

    I grant permission for photographs and video taken at the Minnesota Ballet School to be used by MBS in displays or for advertising purposes. I understand that no personal information will be associated with any photographs or video without my consent and that no compensation is offered. I also understand that all photographs and video taken by the MBS are the property of Minnesota Ballet School.

    Warning: injury can result from improper conduct of this activity.

    I accept full responsibility on behalf of my child for his/her use of any and all apparatus, appliances, facility, instruction, privilege or service whatsoever, owned, provided and operated by MBS at his/her own risk and shall hold MBS, its shareholders, members, governors, officers, employer’s representatives and agents harmless from any and all loss, claim, injury, damage or liability sustained or incurred by my child resulting therefrom.
