Policies and Procedures. Carefully read this Summer Guest Housing Contract. It is a legal and binding agreement with the University of Evansville. As a condition of this contract, the Guest agrees to maintain a proper standard of behavior and not disrupt the residential community. Illegal drugs and alcohol are not allowed on campus. If all Guests in the unit are 21 or over, a request for approval for limited quantities of alcohol can be made by contacting the Office of Residence Life. All campus buildings and grounds are tobacco, smoke, and vape free. The Guest agrees to provide reasonable daily housekeeping and to use reasonable care within their assigned room and common areas, including all furniture and equipment. All furniture is to be left in their designated locations. Violations of the terms of this contract or of any of the rules and regulations outlined in the University of Evansville Student Handbook will be treated as a breach of contract. Guests dismissed from University housing for disciplinary reasons are not entitled to a refund.
Novel Coronavirus (COVID-19). Due to COVID-19 pandemic and planned changes in the operation of UE response to information, guidelines, requirements, orders and acts of Federal, state or local government authorities related to COVID-19, UE aims to protect the health and safety of the Guest and minimize the potential spread of disease within our community. As always, UE will endeavor to update the Guest with timely information about specific health and safety guidance important for students. The Guest is expected to abide by the policies and protocols published on the UE’s Coronavirus webpage: www.evansville.edu/coronavirus which are subject to update and change without notice. The policies and protocols are incorporated into this Contract and are applicable to the Guest.
UE expects all on campus to act in a manner that demonstrates respect and consideration for those around them, including the Guest using UE Facilities. These policies will evolve as the public health crisis evolves and may include, but are not limited to, social distancing, limitations on gatherings based on a percent of room capacity such as 50%, wearing of face covering, submitting required COVID-19 documentation before arriving to campus, and following hand washing and sanitizing protocols. Adherence to health and safety requirements apply to the Guest and visitors while on campus.
In the event the capacity of UE’s available facilities is limited due to information, guidelines, requirements, orders or acts of Federal, state or local government authorities related to COVID-19, UE reserves the right, upon reasonable notice to the Guest, to adjust any previously agreed upon attendance level or room capacity, to cancel any scheduled event, and to terminate or temporarily suspend performance of any part of this Contract.
Moving into Summer Guest Housing. Full payment is due prior to arrival by cash, check, or Credit Card. All checks should be made payable to: University of Evansville. Upon arrival to campus please check-in at the Summer Staff Office (location will be shared prior to moving in) during designated hours or during a pre-determined check-in appointment. Detailed information and contact information will be sent to Guests at least one week prior to arrival. Upon checking in, Guests will sign a unit condition report form, indicating the condition of the unit prior to move in.
Moving out of Summer Intern Housing. Guests must check out of campus housing by noon on the end-date of this contract. A check-out appointment must be made 48 hours in advance. Guests that do not schedule a check-out appointment may be charged an improper checkout fee. Specific information regarding checking out will be communicated to the Guest prior to departure. When checking out, residence life staff will inspect the assigned unit for any damages that occurred during the Guest’s stay. The Guest is responsible for any damages caused during his or her stay that were not initially recorded on the Unit Condition Form. Repair charges will be charged to the Guest. The $250 Commitment and Damage Deposit will be returned within 30 days of the end of this contract pending no damage or cancellation fees.
The University reserves the right to change housing assignments as needed including, but not limited to, space allocation, filling vacancies, consolidations, contract cancellations, and disability accommodations. The University reserves the right to terminate your housing contract, including (but not limited to) the following reasons: employer work program termination, non-payment for services, breach of contract, criminal behavior, or violations of rules of conduct and/or housing regulations as outlined in the Student Handbook.
Indemnification / Hold Harmless. The Guest agrees to indemnify, defend, and hold harmless UE, (together with UE’s successors, assigns, directors, trustees, officers, employees, agents and any other person for whom UE may be legally responsible) from and against any loss, liability, cost, claims or expense, including attorneys’ fees, for any and all property damages, bodily injury or personal injury that results from actions or inactions of UE, its successors, assigns, directors, officers, trustees, employees or agents, except where such loss, liability, cost, claim or expense resulted solely from the gross negligence or willful misconduct of UE. The Guest hereby releases UE and all its employees, officers, volunteers, and agents from any liability for damages to property, arising out of or in connection with residing in University housing.
Force Majeure. UE may terminate or temporarily suspend performance of any part of this Contract without notice, in the event UE’s obligations and/or duties under this Contract are prevented or delayed either directly or indirectly, by consequences of a Force Majeure Event. A Force Majeure Event means a cause or event beyond the reasonable control of UE, including, but not limited to, and not be responsible for any failure to provide facilities or food service during or after a Force Majeure Event act of God, natural disaster, act of war, act of terrorism, or act of the public enemy; national emergency, moratorium, riot, public protest, or demonstration; flood, fire, explosion, windstorm, tornado, sinkhole, earthquake, or other casualty, disaster, or catastrophe; epidemic, pandemic, infectious disease, or other similar causes; any existing or future laws, orders, rules, or regulation or acts of any Federal, state or local government, official or agency (including but not limited to an order resulting in a complete or partial shutdown of the University); or any other causes (whether or not similar in nature to any of those specified above) beyond UE’s reasonable control, irrespective of whether such contingency is specified herein or is presently occurring or anticipated. UE assumes no responsibility or liability for failure to perform any terms or conditions of this Contract due to a Force Majeure Event, UE shall not be responsible for any failure to provide facilities or food service during or after a Force Majeure Event.
The University of Evansville and the Office of Residence Life assume no responsibility for theft, damage or loss of money, valuables, food stuffs or personal belongings of any Guest. No personal property insurance is available through the University. Guests should check with their families to determine the extent of coverage, if any, under existing insurance policies or purchase independent personal property insurance.
Damage / Contract Cancellation. The $250 Commitment and Damage Deposit will be forfeited for damage, Contract termination, or if there is a reduction to the contracted length of stay. Additional charges may be assigned for damages exceeding the deposit amount.
Payment. If any payment is not paid when due, the entire balance, including accrued interest, shall, at the option of the University of Evansville, become due and payable on demand. In the event of any default, including failure of payment by company sponsorship, the Guest will be obligated to pay all outstanding fees, collection costs and/or attorney fees incurred by the University of Evansville in the collection of these charges.
Legal Jurisdiction. This Contract shall be governed by and construed under the laws of the State of Indiana, without regard to the choice of law principles of Indiana or any other jurisdiction. The parties hereby agree to grant exclusive jurisdiction and venue to any federal or state court of competent jurisdiction in Vanderburgh County in the State of Indiana for any disputes arising out of this Contract or the relation of the parties.
Statement of Non-Discrimination. The University of Evansville expects all members of its community to treat each other with respect and civility. Harassing behaviors directed towards any member of our community will not be tolerated. As part of its commitment to non-discrimination, the University specifically prohibits harassment based on any characteristics set forth in its nondiscrimination statement as follows: including race, color, gender, gender identity and expression, sexual orientation, creed or religion, national origin, age, disability, veteran status and all federally protected groups/classes.
The University of Evansville will provide campus housing to the Guest whose signature appears on this Summer Guest Housing Contract, starting and ending at noon on the dates stated on this Contract. The Guest’s signature below (digitally signed or physically signed) indicates that he or she has read and understand the terms of this contract, and agrees to all its terms and conditions, including payment of charges and forfeitures when due. This Contract contains the entire agreement of the parties hereto and shall be deemed to supersede any and all prior Contracts. Any changes to this Contract must be in writing and signed by both parties.
