Equine Release & Waiver of Liability, Assumption of Risk, and Indemnity Agreement

Important Notice

BY SIGNING THIS AGREEMENT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOUR RIDING OR USE OF THE STABLE'S HORSE AND/OR PARTICIPATION IN EQUINE ACTIVITIES AT STABLE, INCLUDING INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE NEGLIGENCE OF YOU OR STABLE.

READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE INDICATES YOUR UNDERSTANDING OF/AND AGREEMENT TO ITS TERMS.

By signing this form, I hereby acknowledge on behalf of myself and/or as the parent or guardian of a minor child that I have familiarized myself and/or the minor child with the activities thatI and/or the child will be allowed to participate in, and that I and/or the minor child do hereby acknowledge and agree that I and/or the minor child will participate in these activities without restriction or limitation. I and/or the minor child recognize the inherent risks involved in riding and working with horses, including but not limited to:

• Bites, kicks, abrasions or contusions from horses
• Being thrown or bucked off by horses
• Scratches or other injury from stalls or enclosures
• Scratches or other injury from grooming tools and other equine equipment and tack
• Allergic reactions to animals, hay, or other allergens
• Tripping in holes or on materials or equipment
• Slipping, falling or otherwise being injured in the barn, in stalls, or on the grounds, which can be slippery, muddy, wet, or contain or present other hazards.

 I and/or on behalf of the minor child hereby specifically forever waive and release Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran and their principals and agents from any liability for injury arising out of the inherent risks from riding, working or participating in a stable environment and/or with horses, as well as from the active negligence of Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran and their principals and agents.

I FOR MYSELF AND ON BEHALF OF MY MINOR CHILDREN, AM AWARE OF, UNDERSTAND, AND ASSUME THE RISKS INHERENT IN ALL HORSE RELATED ACTIVITIES, INCLUDING BUT NOT LIMITED TO, DEATH, BODILY INJURY AND PHYSICAL HARM TO A HORSE, A RIDER, BYSTANDER, SPECTATOR OR OTHER PARTICIPANT IN ADDITION, I AM FAMILIAR WITH THE MARYLAND EQUINE ACTIVITY STATUTE WHICH PROVIDES:

I and/or minor child agree to hold harmless and release Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran, its owners, agents, employees and others acting on Stable's behalf, of all claims, demands, causes of action and legal liability, whether known or unknown, anticipated or unanticipated.

I and/or minor child further agree not to bring any claims, demands, legal actions and causes of actions against Stable and its associates for any economic and/or non-economic losses due to bodily injury, death, property damage and injury to, or loss by death, sustained by myself and/or minor child in relation to the use of the premises and operations of this Stable, to include being near horses owned by or in the care, custody and control of Stable, whether on or off the premises of Stable.

By signing this agreement, I and/or on behalf of the minor child hereby acknowledge that although there may be supervision during my and/or the minor child's time spent at Stable, there will not be a nurse or doctor on the premises and Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran and their principals and agents bear no responsibility for my and/or the minor child's health or medical care.

I and/or on behalf of the minor child agree to indemnify, save and hold harmless, Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran and their principals and agents from and against any loss, liability, damage, attorney's fees, or costs that they may incur arising out of or in any way connected with either my and/or the minor child's presence or participation at Claddagh Manor Farm, LLC or any off premise location with the use of their horse that was authorized by Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran and their principals and agents.

By signing this Agreement, and by initialing the paragraph(s), I and/or on behalf of the minor child hereby acknowledge my complete understanding, agreement and consent to my and/or the minor child's presence and/or participation in the activities at Stable, without restriction, without liability to Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran and their principals and agents, and with full knowledge and understanding of the disclosures, waivers, and release herein.

If I and/or the minor child are present at and participate in the activities of Stable, I and/or the minor child do so at my and/or the minor child's own risk, and I and/or the minor child hereby acknowledge and agree that Claddagh Manor Farm, LLC, Dennis Moran and Patsy Moran and their principals and agents shall bear no responsibility or risk associated with injuries that could arise from my and/or minor child's presence or participation at Stable.

Claddagh Manor Farm, LLC mission is to develop a rider's skills through the care and connection with their mount that will foster responsibility, accountability and compassion through life as well. To better serve our families and students, Claddagh Manor has adopted this Social Media Code of Conduct and Ethics that will prescribe the appropriate behavior for our participants and ensure a healthy and happy environment. This Code is a guide to uphold the personal commitment from all participants in order to safeguard the best interests of the sport, the riders and the horse riding community as a whole. In order to promote a healthy competitive atmosphere both individually for horse and rider and collectively as a riding team, Claddagh Manor Farm, LLC has a zero tolerance for disrespectful and unsportsmanlike conduct whether at the barn or a competition. This principle applies to both verbal interactions and written communications including social media forums. As a valued member of Claddagh Manor riding team, whether a competitor in horse shows or rider for leisure, everyone must conduct themselves in a sportsmanlike manner and treat all people with respect at all times. Disrespectful conduct of any sort including the use of disparaging remarks whether direct, implied or anonymous will not be tolerated.

Social Media websites, such as Facebook, Twitter, YouTube, SnapChat, Instagram, Askfm, and text and email messaging are powerful tools of communication that have significant impact on your personal reputation as well as the reputation of others and leave a permanent footprint and record.

With respect to posting and messaging, use the following guidelines to determine the appropriate remarks:

• THINK! before posting. Is it true? Is it Helpful? Is it inspiring? Is it Necessary? Is it Kind?
• Be respectful and thoughtful.
•  Do not post anything you wouldn't want friends, parents, grandparents, teachers, employers, or college admission counselors to see.
• Know the rules. Follow a code of ethics. Become familiar with the terms of service and policies of the Social Media sites and networks in which you participate and the appropriate code of ethics required for responsible online communications.
• Always remember that Cyber bullying is the willful and repeatedly bullying or harassment of another person or group of persons through the medium of Social Media, which includes, electronic text and email.

 

Claddagh Manor Farm, LLC is not in the profession of monitoring and policing social media forums and content. However, if disrespectful and unsportsmanlike content or behavior is brought to our attention involving a Claddagh Manor Farm, LLC participant, the behavior will be brought to the attention of the participant and/or participant's parent or guardian. If there is any subsequent disrespectful or unsportsmanlike conduct or content, the participant will be asked to leave the facility. Any remaining paid lessons, board, lease payments and show expenses will be forfeited. Claddagh Manor Farm, LLC takes pride in the achievements of all of our riders and mounts. Our goal is for all of our participants to share in those accomplishments through encouragement and positive reinforcement. Remember the Golden Rule: "Do unto others as you would have them do unto you."
