Safety Acknowledgement & Waiver of Liability Form

I acknowledge and agree that infectious and communicable diseases (i.e. COVID-19, influenza, etc.) are contagious, and I waive any liability for being exposed or for contracting a contagious disease that may occur or result from me attending or participating in any event or activity (the "Activity") of The Town of Paradise Valley Women’s Association - TPVWA Inc. (“TPVWA”).

I further acknowledge that TPVWA cannot prevent me or my spouse, children or guests ("Guests") from being exposed to, contracting, or spreading contagious diseases while participating in any TPVWA Activity, including travel to and from the Activity. I understand and acknowledge that any in-person interaction may increase my risk of contracting or spreading contagious diseases.

I understand, acknowledge and agree that TPVWA and TPVWA activities will be complying with and requiring the use of CDC guidelines (along with state and county guidelines) in regards to communicable diseases, and I agree to comply with any such requirements at a TPVWA Activity.

 I agree to stay home if I am sick or experiencing any symptoms related to a contagious disease.

As a participant, volunteer, or attendee, I recognize and agree that I assume the risk and consequences that my participation, involvement and/or attendance at any TPVWA Activity is voluntary and could result in personal injury (including death) and/or property damage to me. By attending, observing or participating in a TPVWA Activity, I acknowledge and assume all risks and dangers associated with my participation and/or attendance at the Activity. I understand that no amount of care, caution, instruction, or expertise can eliminate these dangers.  I also recognize and agree with the fact that with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated.  TPVWA activities are of such value to me that I accept the risk described herein in order to participate in-person at TPVWA Activities.

My participation in the TPVWA Activity is purely voluntary, and I knowingly elect to participate.  I expressly agree and promise to accept and voluntarily assume all risks, known or unknown, existing in my participation in any TPVWA Activity.

While TPVWA appreciates that its members understand how to conduct themselves in the highest manner at all events, we ask that each member, host or Guest abide by the following standards of conduct:

1. If alcohol is served at an event, please act responsibly and remember to not over-indulge.

2. If you are planning to drive, do not drink alcohol, or if you do, please make plans with a pre-designated driver or ride-share.

3. Members are responsible for their Guest's behavior. Members should ensure that their Guests who are not of legal drinking age do not consume or request alcoholic beverages at any TPVWA Activity.

By attending, observing or participating in the Activity, I agree that: (a) TPVWA (b) the property or site owner of the Activity, and (c) all past, present and future affiliates, successors, assigns, volunteers, hosts, activity chairs, organizers, vendors, partners, directors, and officers, of such entities (subsections (a) through (c), collectively, the "Released Parties"), will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of my participation in, attendance at, and/or observation of the Activity, regardless if any such injuries or losses are caused by the negligence of any of the Released Parties. I hereby forever release and waive all claims and rights against the Released Parties. I understand that this release and waiver prevents me from seeking damages in any way against the Released Parties, whether such damages are known or unknown, foreseen or unforeseen, or that occur now or in the future. I hereby agree to waive and release, on behalf of myself, my children, my parents, heirs, assigns, and personal representatives, any and all liability, claims or potential claims against the Released Parties based on my participation in any TPVW Activity, including any and all lawsuits, claims, costs, and attorneys’ fees. I also intend this release to apply, to the extent permitted under applicable law, to any claims my Guests could assert related to the subject matter of this Release.
