Eight Waves Student Registration

My minor child, (“the Minor”) has been accepted as a tutee and mentee in the Eight Waves Corporation (hereinafter “Program”).  The Minor has my consent to attend. I understand the nature and requirements of the Program. With that understanding, it is my judgment that the Minor is qualified and able to participate in the Program. I acknowledge that the Minor’s participation in the Program is voluntary.

Due to the age of the Minor, Eight Waves Corporation to be executed by me in consideration of the Minor’s being permitted to enroll in the Program. I agree to and acknowledge the following:

(1) I am the Minor’s parent or legal guardian.

(2) I agree to drop the Minor off just prior to the start of the Program period and will pick up the Minor immediately following the end of the Program period. I understand that neither the faculty member, teaching assistant, any other student nor any administrator or staff member of Eight Waves Corporation shall be responsible for supervision of the Minor both before and after the Program times.

(3) I agree that the Minor will abide by all of the rules and regulations and, if found in violation, may be removed from the Program either temporarily or permanently. I understand that Eight Waves Corporation may withdraw the Minor’s participation if these programs are disrupted or altered in any way by the Minor’s behavior. 

(4) I agree that the Minor may be photographed, audio or videotaped by Eight Waves Corporation. I agree that photographic image(s) and information that correspond with the photographic image(s) may be disseminated for any public usage by Eight Waves Corporation.

(5) As parent of the Minor, I understand that there are safety risks associated with the Minor’s participation in programs and activities designed for children. I acknowledge and agree that I have had the opportunity to ask questions of Eight Waves Corporation officials concerning these matters, and all questions have been answered to our satisfaction.

(6) On behalf of ourselves, our heirs, executors, and administrators, I waive and release forever any and all rights for claims and damages I may have against Eight Waves Corporation (both individually and jointly), their trustees, officers, employees, and agents in any manner due to any personal injury or property loss sustained as the result of the Minor’s participation in the Program. I hereby indemnify and hold harmless from and against any and all claims, demands, judgments, losses and expenses, including, but not limited to, attorneys’ fees for personal injury or death to the Minor or damage to the Minor’s property during the Program period arising out of or resulting from the negligent or wrongful acts or omissions of Eight Waves Corporation, and their employees and agents with the exception of gross or willful misconduct.

(7) I agree that should there be disagreements or problems with the implementation of this agreement, the laws of Florida will govern any resolution. I further agree that should litigation or grievances result, the forum for any lawsuit, hearing or adjudication shall be in Florida.

8) As parent of the Minor, we agree that I will promptly communicate any problems or issues associated with the Minor’s participation in the Program. 

9)  I give my permission for the school to share progress reports and/or subject grades with the Eight Waves Program. This information will be used to track the progress of students, but individual data will remain confidential with the Program and will not be disseminated.

10) My child has my permission to participate in the Eight Waves Programs; tutoring, mentoring, and community experiences, and or Birthday Club.  I have read the policies and expectations and agree to follow them. If I choose, I may remove my child from participation in this program at any time.

I hereby grant Eight Waves the irrevocable right and permission to use photographs and/or video recordings of me on Eight Waves and other websites and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation to me.  

I understand and agree that such photographs and/or video recordings of me may be placed on the Internet.  I also understand and agree that I may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs and/or video recordings of me.  I waive the right to approve the final product.  I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of the Eight Waves.  

I hereby release, acquit and forever discharge Eight Waves, its current and former trustees, agents, officers and employees of the above-named entities from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.

I hereby warrant that I am eighteen (18) years old or more and competent to contract in my own name or, if I am less than eighteen years old, that my parent or guardian has signed this release form below.  This release is binding on me and my heirs, assigns and personal representatives.

If individual photographed/recorded is under eighteen (18) years old, the following section must be completed:  I have read and I understand this document.  I understand and agree that it is binding on me, my child (named above), our heirs, assigns and personal representatives.  I acknowledge that I am eighteen (18) years old or more and that I am the parent or guardian of the child named above.

I give permission for my child/children {studentName} to be transported in a motor vehicle driven by a staff member or  volunteer of Eight Waves Corporation. I understand that my child/children is expected to follow all applicable  laws regarding riding in a motor vehicle and is expected to follow the directions provided by the driver  and/or other adult volunteers. 

I have read, understand, and discussed with my child/children that: 

(1) They will be traveling in a motor vehicle driven by an adult, and they are to wear their safety belt while traveling. 

(2) They are expected to respect each other, the vehicles they ride in, and the people they travel  with during the trip. 

(3) Riding in a motor vehicle may result in personal injuries or death from wrecks, collisions, or  acts by riders, other drivers, or objects. 

(4) They are to remain in their seats and not be disruptive to the driver of the vehicle. 

I recognize that by participating in this activity, as with any activity involving motor vehicle transportation, my child/children may risk personal injury or permanent loss. I hereby attest and verify  that I have been advised of the potential risks, that I have full knowledge of the risks involved in this  activity, and that I assume any expenses that may be incurred in the event of an accident, illness, or  other incapacity, regardless of whether I have authorized such expenses. 

As a condition for the transportation received, I, for myself, my child/children, my executors, and  assigns, further agree to release and forever discharge Eight Waves Corporation, its Board of Directors, their officers, employees and volunteers from any claim that I might have myself or that I could bring on my child/children’s behalf with regard to any damages, demands or actions whatsoever, including those  based on negligence, in any manner arising out of this transportation. I have read this entire waiver and  permission form, fully understand it, and agree to be legally bound by its terms.
