Vertical Fusion COVID-19 Liability Release Waiver 2.0

Vertical Fusion LLC is requesting that you sign the Vertical Fusion Liability Waiver. This is a requirement to participate in any part of our program. To decline, please contact the studio at 720-318-1749 for cancellation options.*

Do you consent to signing this legal document electronically?*

Due to the 2019 outbreak of the novel Coronavirus (COVID-19), Vertical Fusion is taking extra precautions with the care of every client to include health history review and enhanced sanitation/disinfection procedures in accordance with the State, County, and City orders and guidance.

Symptoms of COVID-19 include:

Cough
Shortness of breath or difficulty breathing
Fever
Chills
Muscle pain
Sore throat
New loss of taste or smell
(This list is not all possible symptoms. Other less common symptoms have been reported, including gastrointestinal symptoms like nausea, vomiting, or diarrhea.)

Vertical Fusion and Grace Pilates is following these enhanced procedures to prevent the spread of COVID-19:

The CDC recommends that those who are not fully vaccinated, wear masks indoors.
Prepayment of services is required to minimize crowding in our lobby
Services are rendered only if reservations are made in advance; drop-ins are not allowed
Clients may not have guests accompany them for their reservations
Each client and employee is required to wash and sanitize their hands upon arrival and before leaving
Personal belongings must be limited and are not allowed beyond the lobby with the exception of valuables and items critical to program participation
Shoes must be removed before entering the dance space
All surfaces and occupied floor space will frequently be wiped thoroughly with hospital grade disinfectant
Gymnastics mats will be disinfected between clients
Community yoga mats will not be available; clients must bring their own personal mat and may not store it at the studio
Hammocks may be shared, however, if you desire to have your own hammock you must rent one

I agree to the following:

I understand the above symptoms and affirm that I, as well as all household members, do not currently have, nor have experienced the symptoms listed above WITHIN THE LAST 14 DAYS.
I affirm that I, as well as all household members, have not been diagnosed with COVID-19 WITHIN THE PAST 14 DAYS.
I affirm that I, as well as all household members, have not knowingly been exposed to anyone diagnosed with COVID-19 WITHIN THE PAST 14 DAYS.
I affirm that I, as well as all household members, have not traveled outside of the country, or to any city considered to be a "hot spot" for COVID-19 infections WITHIN THE PAST 14 DAYS.
I understand that Melanie Piek, Rende Brockwell, Vertical Fusion, LLC, and Grace Pilates, LLC cannot be held liable for any exposure to the COVID-19 virus caused by misinformation on this form or the health history provided by each client.
I understand that masks are recommended for those not fully vaccinated.
I understand that I must wash my hands upon entering and exiting the facility and as much as possible while in the facility.
I understand that I must maintain a distance of at least six feet from others as much as possible.
I understand that under Level Yellow, Blue, Green, and Clear restrictions, the sharing of apparatuses is allowed. I understand that I may be expected to share an apparatus with others and by attending class, I certify that I am willfully doing so. I agree that when sharing an apparatus, I will sanitize it between each use.
I understand that I should not share or reuse towels and that used towels should be placed in the designated bin for laundering.
I understand that I must comply with capacity limitations and therefore, must follow studio rules regarding class reservations.

COVID-19 WAIVER OF LIABILITY AND INDEMNIFICATION
(If you are in agreement, select "Agree" in the drop down for each of the following paragraphs.)

Electronic Signature Agreement. By selecting the "I Accept" button, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting "I Accept" you consent to be legally bound by this Agreement's terms and conditions.*

I agree that I am personally responsible for my safety and actions while using the Vertical Fusion LLC and Grace Pilates LLC facilities. I agree to comply with all Vertical Fusion and Grace Pilates policies and rules, including but not limited to all policies, guidelines, signage, and instructions. Because the aforementioned facilities are open for use by other individuals and that in some instances, I will have to share equipment with others, I recognize that I am at higher risk of contracting COVID-19. With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue Vertical Fusion LLC nor Grace Pilates LLC, its officers, agents, servants, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party using the facilities, or otherwise, while participating in any activity while in, on, or around the facilities and/or while using any products, tools, equipment, or materials.*

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.*

By signing below I acknowledge and represent that I have read the foregoing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in using the facilities to decide whether to sign this document; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this Wavier of Liability shall be governed by and construed in accordance with Colorado law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Wavier of Liability as a whole. This waiver remains in effect until the State of Colorado lifts all COVID-19 related mandates.*
